Reason for Waiver

A dispensation will only be granted where it is essential that the vehicle is parked close to the property in order to carry out works. If Cornwall Council deems that the vehicle is not essential to the works then the parking dispensation will be refused and therefore contractors must park legally.

Applications require a minimum of 1 working days’ notice (Monday to Friday) and can be submitted between the hours of 09:00 and 15:00 hours. Applications received outside of office hours will not be considered until the next working day.

Fees

The fee for a parking dispensation is £13.00 for the first day then £10 for each subsequent day. A Parking Dispensation will only be granted for a maximum of 2 weeks unless agreed otherwise by the street works department. Extensions can be requested; however these may not always be approved.

Notes for Applicants

1.The council in certain circumstances, will allow a dispensation to allow a vehicle or vehicle to park lawfully in what otherwise would be a contravention of a Traffic Regulation Order (TRO) by issuing a waiver.

2.A dispensation authorises a vehicle to park in contravention of a TRO. It allows parking where alternative arrangements cannot be made.

3.A dispensation does not permit ‘general parking’. It does not allow the vehicle to remain in the restricted/prohibited area once the dispensation purpose has been fulfilled. At that time the vehicle must be lawfully parked elsewhere. Based on the above qualifications and subject to Council policy.

4.The issuing of this dispensation does not relieve the applicant of their responsibilities for parking sensibly, and the highway authority cannot be held liable for any accident or incident that may occur however caused arising out of or in any way attributable to the applicant’s parking.

5.Dispensations for parking and a waiver can be issued for the following:

•Vehicles essential to filming operations

•Special events

•Other circumstances in which the council may reasonably regard the requirement to be essential.

6. Dispensations for parking will not generally be granted for:

•Applications where parking may adversely affect disabled/doctors /taxi ranks, loading Bays, bus stops and residential bays

•Applications where loading restrictions are in place if the request is for during the restricted periods

•Locations within 50 metres of a signal controlled junction

•The entry/exit to pedestrian crossing markings

•Acts of Loading/Unloading that would be covered by an exemption within the Traffic Regulation order.

•On a footway

•Other locations where parking may cause danger to pedestrians or other road users.

•Obstruction to the flow of traffic

7.Applications may be made by telephone, post, email or in person to this section. Applications require a minimum of 1 working days’ notice (Monday to Friday) and can be submitted between the hours of 09:00 and 15:00 hours. Parking dispensations can run for a maximum of 2 weeks, extensions can be requested; however, these may not always be approved.

8.Each application will be given a unique identification number and officers will consider applications on their merits.

9.Upon approval you will be issued with a Parking Dispensation Consent form. This form must be clearly displayed in the window of the vehicle. You will be given the unique identification number prior to receiving your consent form. Should you be required to park before receiving the consent form this number must be clearly displayed.

10.Applications for a Parking Dispensation Form require the applicant to nominate specific vehicles. Each vehicle will require a Parking Dispensation

11.Materials or Goods must not be deposited on the footway or carriageway (except at the rear of the vehicle and must be removed immediately, otherwise a licence to deposit is required obtainable from CC). Materials must not be passed across any part of the footway or carriageway in such a way as to interfere with other vehicles or pedestrians.
