AN ACT Relating to the Capitol Restoration Trust Fund

AN ACT relating to the Capitol restoration trust fund.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

SECTION 1. A NEW SECTION OF KRS CHAPTER 11 IS CREATED TO READ AS FOLLOWS:

(1)As used in this section, "trust fund" means the Capitol restoration trust fund.

(2)There is hereby created within the State Treasury a separate trust fund to be known as the Capitol restoration trust fund that shall be administered by the Finance and Administration Cabinet, with advice from the Historic Properties Advisory Commission.

(a)The Finance and Administration Cabinet shall likewise seek advice on the appropriate disbursement of proceeds from the trust fund from the Speaker of the House of Representatives, the President of the Senate, the Chief Justice of the Supreme Court of Kentucky, the Attorney General, and the Secretary of State.

(b)Proceeds from the trust fund shall be used for the sole purpose of the restoring and renovating the Kentucky State Capitol.

(c)Proceeds in the trust fund shall not lapse to the general fund, and all interest, dividends, and other income derived from the investment of the proceeds of the trust fund shall be credited to the trust fund.

(3)(a)The Commonwealth of Kentucky may accept private and corporate contributions to the trust fund, as well as appropriations from both the state and federal government.

(b)The Commonwealth shall not advertise or display the name, business identification symbol, brand, trademark, plaque, or any combination thereof of a private or corporate contributor on state property in return for a contribution to the trust fund, and no part of the Capitol structure, furnishings, or grounds shall be named after a private or corporate contributor to the trust fund. Nothing shall prohibit the contributor from mentioning the contributor's donation to the trust fund in its publications or advertisements.

(4)Funds from the trust fund may be used for any and all restoration and renovation expenses of the Kentucky State Capitol, including but not limited to the acquisition of period furniture, window treatments, historic reproduction lighting and furniture, historical reproduction floor coverings, historic paint stenciling, conservation of artwork, scagliola, and any other reasonable expenses associated with the Capitol restoration and renovation.

(5)The Finance and Administration Cabinet shall publish an annual financial report of the activities of the trust fund and shall provide a copy of that report and a complete and accurate list of the names of all contributors to the trust fund, to the Governor, the Legislative Research Commission, the Speaker of the House of Representatives, the President of the Senate, the Chief Justice, the Attorney General, and the Secretary of State.
