Maryann Farquhar of Willow Lane Farms currently wishes to have the above stated dog cared for and fostered in the home of ______under the following terms and conditions stated below.
Terms and Conditions:
1. Maryann Farquhar of Willow Lane Farms is the owner of the above stated dog until the dog has
finished taking care of her third litter. Or in the case of a male, for 5 yrs from the contract date. After which the dog’s ownership will be transferred over in full to the above stated foster family.
2. Maryann Farquhar of Willow Lane Farms retains the breeding rights of the above stated dog for 3 live litters of puppies with a minimum of 18 puppies over the course of 3 litters. In the case of a male Maryann Farquhar retains the breeding right of the above stated dog for 5 yrs from the contract date.
3. Maryann Farquhar of Willow Lane Farms is the owner of all puppies produced by the above stated
dog while ownership is still in her name.
4. Maryann Farquhar of Willow Lane Farms takes the responsibility of all annual shots and vet checks for the dog while ownership is still in her name. Maryann Farquhar is also responsible for the cost of all genetic testing (of her choice). Any additional medical cost due to accident will be covered at covered at the cost of the Foster parents. The foster parents also agree that while Maryann Farquhar owns the above stated dog that they will agree to take the dog to the vet of her choice for all medical purposes. In the case of emergency the Foster parents will take the dog to the closest available veterinarian clinic and will call Maryann or Family immediately. Flea medication, heartworm and worming are at Foster Families expense.
5. The above stated foster parents are responsible for proper housing, training, and grooming while residing in their home. Foster parents agree to provide a fenced in yard, they agree that the dog will be a house dog. The above stated dog must be kept on leash when outside the home as to prevent accidental breeding or harm to the dog.
6. The above stated foster parents agree not to breed or have the dog spayed or neutered without written consent of the owner Maryann Farquhar while still under contract. After the transfer of ownership to the Foster Family it is at their discretion to breed or neuter the dog. However if the dog is not of breeding quality due to poor genetic testing results, the dog will not be used in the breeding program. The foster parents will still have ownership transferred in their name, however they must have it spayed/neutered first at their expense.
7. The above stated Foster Family is solely responsible for any damage or injury that may be caused by the above stated dog while in the Foster Families care. The Foster family releases Maryann Farquhar from any liability and does not hold Maryann Farquhar accountable relating to any damage or injury caused by the above stated dog.
8. The Foster Family agrees that until the above stated dog is transferred in their name that they do not have the right to sell or place the dog in another home without written consent. The dog is to be returned to Maryann Farquhar if problems occur and they can no longer care for the dog.
9. The Foster parents agrees to keep Maryann Farquhar informed of the dogs heat cycles and condition during pregnancy. The Foster family agrees that the dog will be brought back to Maryann Farquhar’s home for breeding to the stud of her choice for a minimum of 7 days and will return again one week prior to the birthing date. In the case of a male, the male will be returned at Maryann Farquhar’s request and will be kept for a min. of one week. Foster Family agrees to keep us informed the dogs location. If relocation occurs the dog must be located within a 2 hr driving radius, the foster family agrees to bring the dog back for scheduled breeding.
BREACH OF AGREEMENT
The Foster Family will be considered in breach of agreement for any of the following actions. Breach of agreement will result in the removal of the dog.
Breach of agreement is as followed:
a)If the Foster Family denies Maryann Farquhar access to the above stated dog for purposes of breeding or health testing or in any way knowingly hinders or attempts to prevent such breeding.
b)If the Foster Family neuters or spays the dog without written consent from Maryann Farquhar while the dog is still registered under her ownership.
c)If the Foster family fails to uphold any of the above mentioned duties and responsibilities outlined in this agreement.
d)If the above mention female is breed in their care, accidental or on purpose to a dog other than the choice of Maryann Farquhar. In the case of a male the Foster family is in breach of agreement if the male in their care accidental or on purpose, breeds another female.
If the above mention dog is injured in the Foster Parents care it is their responsibility cover the vet cost.
If the above mention dog is killed in the Foster Parents care they are responsible for the replacement cost of the dog in the amount of $1500.
By signing below the foster family is agreeing that they have read over, understand and agree to the above terms.
