In reference to the decision taken by the Directorate of Sugar vide file No.3-3/2010-ES/1758 dated 02-12-2011 for export of 19313 M.T sugar from different sugar factories of U.P. Cooperative Sugar Factories Federation Ltd.,Lucknow. The tender is being invited at the office of U.P. Cooperative Sugar Factories Federation Ltd., 9-A, Rana Pratp Marg, Lucknow on 29-12-2011 up to 1.00 pm to decide per quintal premium rate including export benefit payable by the tenderer/Sugar Exporter to U.P. Cooperative Sugar Factories Federation Ltd., if sugar to be exported is sourced from other sugar factory on the following terms and conditions:

1-Tender will be accepted only from those tenderers (export house /merchandise) who has prior experience of sugar export and having valid importer/exporter code.

2-All the tenderers except Govt./Coop. institutions will have to submit earnest money for Rs.25.00 lacs(Rupees Twenty Five Lacs. Only) in the form of D.D. issued in favour of U.P. Coop. Sugar Factories Federation Ltd, payable at Lucknow. The tender without earnest money will not be accepted.

3-Only those Govt./Coop. institutions are eligible to participate in tender in which State/Central Govt. has/have invested in share capital and such institutions are having sugar export license and have experience of sugar export.

4-The tenderer must be registered with Income Tax and Service Tax Departments.

5-The tenderer has to submit credit worthiness certificate of Rs.1.00 Crore issued by any Scheduled or Nationalized Bank.

6-The tenderer has to submit a certificate from Chartered Accountant regarding turnover of export in original for the year 2010-11.

7-If the premium rates received from the tenderers in the tender/ negotiation are similar then the export quantity for each tenderer will be decided by the Tender Committee.

8-In case of any change in rules and regulations and in Govt. policy pertaining to export of sugar, the tender committee reserves the right to call upon the successful tenderer/tenderers for further discussion and take necessary action in this regard.

9-It shall be the responsibility of the successful tenderer/exporter to ensure and fulfill all the formalities and standard norms required for export of sugar by Govt. of India.

10-The successful tenderer/exporter has to bear all the expenses related to export of sugar which include cost of sugar, taxes and duties, transportation, insurance and all other related expenses.

11-If any penalty or recovery is imposed on U.P. Coop. Sugar Factories Federation or any of its Coop. Sugar Factory, the same shall be borne by the successful tenderer/exporter, the Federation or any of its Coop. Sugar Factory will not be responsible for any such penalty or recovery.

12-In case the export is not taking place for whatever be the reason within the time limit permitted by the Govt. of India, the premium amount paid by the exporter to U.P. Coop. Sugar Factories Federation Ltd., shall stand forfeited and the exporter shall have no claim whatsoever.

13-The tender committee reserves the right to accept or reject any tender without assigning any reason and shall also be entitled to revise any of the tender condition to meet the requirement of law so as to ensure the legal safeguard of the interest of its Coop. Sugar Mills in consonance with such legal provisions which may come to the notice ofthe tender committee before the time of opening of the tenders. Such revisions shall be announced before the opening of the tenders to all those who have submitted the tenders.

14-The successful tenderer will serve as an agent of mills of U.P. Coop. Sugar Factories Federation Ltd., on whose quota the sugar is being exported. Therefore, the relationship between the Coop. Sugar Mills and exporter will be like principal and agent.

15-The tenderer will also submit a detailed calculation of premium quoted in this tender and will mention the present rate of sugar in International market as well as in domestic market and other related details.

16-No interest will be payable on earnest money deposit.

17- If the successful tenderer participates in the tender for the export of sugar under OGL at U.P. State Sugar Corporation Lucknow and/ or in Uttrakhand Sahkari Chini Mills Sangh Ltd., Dehradun and the rates finalized by them are higher then such higher rates shall be applicable at Federation also.

18-Conditional tenders shall not be accepted.

19-The successful tenderer/exporter will have to make payment of the total premium amount including export benefit payable on total quantity of sugar to be exported in the shape of D.D. favouring U.P. Coop. Sugar Factories Federation Ltd., payable at Lucknow within forty Eight hours (48 hours) from the date of work order.

20-Tenderer shall be responsible to abide by all the terms and conditions and time schedule fixed by the Directorate of Sugar vide Circular No.3-3/2010-ES/1758 dated 02.12.2011. If the entire allotted quantity for export is not exported within the stipulated time limit, the earnest money deposit, amount of premium including amount and all other deposits will be forfeited.

21-The successful tenderer/exporter shall within Seventy two hours (72 hours)from the date of work order has to enter into a tripartite agreement, with the source sugar mill from where the sugar is to be purchased and the coop. sugar mill of Federation against whose quota the sugar will be exported, in order to ensure that the quantity of sugar allotted for export by the Directorate of Sugar will be exported as per prescribed norms and within scheduled time limit. However, if the successful tenderer fails to deposit the entire amount of premium including export benefit or fails to enter into tripartite agreement within above scheduled time, the earnest money deposit of the ternderer will be forfeited , the work order will be cancelled and Federation will be at liberty to get the work done by successive tenderers and difference of premium rate (if any) shall be borne by the highest tenderer.

22-The successful tenderer/exporter shall be responsible for the quality, grade, packing as per prescribed norms for export of sugar and shall also be responsible to get the clearance from the Inspecting Agency, Excise and Custom & other Departments.

23- Earnest money shall be released after successful completion of export of sugar and submission of all requisite documents and certificate regarding export completion to U.P. Cooperative Sugar Factories Federation by the successful tenderer/exporter.

24-The successful tenderer/exporter shall ensure that if the Govt. of India allows any export benefit against this sugar export order the same shall be passed on to the concerned Cooperative Sugar Mill of U.P. Cooperative Sugar Factories Federation Ltd., Lucknow.

25-If the quantity of sugar allotted for export by the Directorate of Sugar is increased or decreased , the successful tenderer/exporter has to export the amended quantity accordingly and the payment of premium shall be paid on the basis of amended quantity and no claim shall be payable to exporter.

26-No tender shall be accepted after the expiry of time prescribed and no request in this regard on any ground or constraint whatsoever shall be entertained.

27-If any recovery is imposed on Federation or on any of its Sugar Factory due to any conduct of the exporter, the same shall be recovered from earnest money deposit and if the amount of recovery exceeds the earnest money deposit, the excess amount after adjustment of earnest money deposit shall be recovered as arrears of land revenue.

28-The Managing Director of U.P. Cooperative Sugar Factories Federation Ltd., 9-A, Rana Pratap Marg, Lucknow will be the Sole Arbitrator in case of any dispute that may arise among the exporter, U.P. Cooperative Sugar Factories Federation and its sugar factory and the source sugar factory during the performance of sugar export work order. The decision of sole arbitrator will be final, acceptable and binding on all the parties.

29-If any legal dispute arises, the same shall be under the jurisdiction of District Court, Lucknow only.
