Ticket Terms and Conditions 2016/2017

PLEASE READ THIS DOCUMENT CAREFULLY. THE TERMS BELOW APPLY TO YOUR USE OF TICKETS AND SEASON TICKETS.

These Conditions, together with the Club’s:

  • Website Terms and Conditions ( terms-and-conditions),
  • Privacy Policy ( and
  • Ground Regulations (

govern how the Club issues you with, and your use of, Tickets. If these Conditions are not accepted, your Ticket (and, if applicable, Season Card) should be returned to the Club immediately. The use of a Ticket will be deemed to constitute acceptance by the Ticket Holder (and any Guest) of these Conditions in full.

The Ticket Holder purchases a Ticket in accordance with these Conditions from Goodison Park Stadium Limited, a company registered in England with company number 4355318, registered office Goodison Park, Goodison Road, Liverpool L4 4EL, telephone number 0151 556 1878, fax number 0151 286 9119, e-mail using the URL and VAT registration number GB 786823478.

Capitalised words in these Conditions have the meanings given to them in Condition 14.

  1. ISSUE OF TICKETS AND ELIGIBILITY

General

1.1The Ticket Holder must comply with these Conditions and the Ground Regulations. The Club shall supply the Tickets in accordance with these Conditions.

1.2The price payable for each Ticket and/or Season Ticket shall be as set out on the Website or as otherwise notified by the Club from time to time. Unless expressly stated otherwise, all prices are inclusive of VAT.

1.3Season Tickets and Match Tickets (save for those expressly referred to as being located in the Away Fans Area of the Stadium) are for the use of supporters of the Club only. By applying for a Season Ticket or a Match Ticket (other than in the Away Fans Area of the Stadium), and/or using the same, you hereby warrant and represent that you are a supporter of the Club.

1.4Tickets in the Home Fans Area are available for purchase by Home Fans only. Tickets in the Away Fans Area are available for purchase by Away Fans only.

1.5By applying to purchase one or a number of Tickets to gain entry to the Stadium for a Match, you hereby warrant and represent that you are a Home Fan if the seat purchased under your Ticket is located in the Home Fans Area or an Away Fan if the seat purchased under your Ticket is located in the Away Fans Area.

1.6If you purchase a Match Ticket for a seat located in the Away Fans Area of the Stadium, you will not be permitted to transfer it for a seat located in the Home Fans Area of the Stadium and vice versa (regardless of whether you are asked to leave that section of the Stadium and/or where there is space in the opposing area).

1.7If the payment method or details are declined when the Club attempts to retrieve payment for any Tickets or any other associated fees the Club will use reasonable endeavours to contact the Ticket Purchaser (using the contact details provided by the Ticket Purchaser to the Club in their application) to arrange payment. Further, the Stadium’s access control system will not permit the holder(s) of the affected Tickets entry to the relevant Match(es) until sufficient payment is received, the affected Tickets may be cancelled if the Club is not successful in contacting the Ticket Purchaser having made reasonable attempts to do so and the Ticket Purchaser has not contacted the Club; and the Ticket Purchaser will be liable to the Club for any bank, other administrative charges and / or expenses incurred by the Club as a result of the Ticket Purchaser’s breach of this condition 1.7.

1.8All Tickets and Season Cards issued by the Club are and shall remain the property of the Club.

1.9The Ticket Holder (or any person purporting to be the Ticket Holder) may be required at any time to deliver up the relevant Ticket for inspection by the Club and to prove that they are the Ticket Holder. To access the Stadium, the Ticket/Season Card must be presented at the turnstile reader as directed by the turnstile operator. Admission will be refused to any person who attempts to use the same Ticket/Season Card on more than one occasion at the same match, or use a Ticket/Season Card which has been cancelled.

1.10A Ticket does not grant the Ticket Holder priority in respect of tickets for other matches or any other events at the Stadium or in relation to any other stadium.

1.11The Club may from time to time create images and/or audio-visual video footage of Ticket Holders attending the Stadium. The Club owns all rights in such images and footage and shall be entitled to use the same for the purpose of: (i) promoting the Club and its commercial partners; and (ii) any other commercial activity, provided such use does not intentionally harm the reputation of the relevant individual whose image is used.

1.12For the purposes of these Conditions: (i) a “Kid” is defined as a person aged 10 or under on 01/09/16; (ii) a “Junior” is defined as a person aged 11-18 years on 01/09/16; (iii) a “Youth” is defined as a person who is aged 19-22 years on 01/09/16; (iv) a “Concession” is defined as a person who is aged 65 years or older on 01/09/16; and (v) an “Adult” is defined as a person aged 23-64 years on 01/09/16.

1.13Season Ticket Holders must promptly notify the Everton Box Office in writing of any change of their address.

1.14Ticket Holders should be responsible for the security of their belongings and property whilst at the Stadium.

1.15Whilst the Club makes every effort to ensure that pricing and ticketing information provided on, but not limited to, the Website or any other literature or by a sales representative is correct at all times, errors may occasionally occur. If the Club discovers an error in the price or nature of the Ticket you have ordered, the Club will endeavour to inform you as soon as possible, and give you the option of reconfirming your order at the correct price/ specification (and paying the difference in price to the Club, if applicable), or cancelling it. If the Club is unable to contact you, it will unfortunately have to treat the order as cancelled. If the order is cancelled, a full refund will be provided via the payment method used to purchase the Ticket.

1.16Once purchased, a Ticket Holder is not entitled to cancel or change their Ticket or Season Ticket (save that a concessionary Ticket may be upgraded on payment of the applicable supplement) because the rights of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to these Conditions.

SEASON TICKETS

1.17Season Tickets shall allow access to all Home Matches played by the Club in the Premier League in season 2016/2017.

1.18Where Season Ticket Holders purchase their Season Ticket by direct debit, failure to complete any payments by the due date for payment may result in cancellation of their Season Ticket and no refunds shall be made in respect of services already provided by the Club.

1.19Any Season Ticket Holder wishing to upgrade their Season Ticket for any particular Match during the current Season may only be permitted to do so at the discretion of the Everton Box Office. Upgrades will be permitted for: (a) a Kid to a Junior, Youth or Adult, (b) a Junior to Youth or Adult, or (c) a Youth to Adult. Upgrade prices will be calculated in accordance with the individual Match Ticket price minus the pro-rata amount paid when purchasing the discounted Season Ticket. A downgrade policy is not in operation. Season Ticket Holders found guilty of abusing this facility will have their Season Ticket withdrawn (without refund).

1.20Any person entering the Stadium on an ineligible Season Ticket will have their Season Ticket withdrawn and no refund will be given in respect of remaining Matches. The Club reserves the right in such cases to pursue a criminal prosecution and/or a civil remedy.

1.21For non-Season Ticket Matches, the Club cannot guarantee that a Family Enclosure will be in operation. If a Season Ticket Holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with these Conditions and the Ground Regulations.

1.22References in these Conditions to Season Tickets shall apply to ‘Half Season Tickets’ (being Season Tickets purchased for half of the Season only), for the period to which the Half Season Ticket is applicable only.

CONCESSION TICKETS AND TICKETS FOR THE FAMILY ENCLOSURE

1.23Kids, Junior, Youth and Concession Season Ticket applications must be accompanied by a photocopy of a valid passport or birth certificate. Failure to produce the required identification will result in the Season Ticket being held back from release until such identification has been produced to the Club and the Club will not be responsible for, and shall not offer any refund in relation to, any Matches missed as a consequence. A Kid Season Ticket is only available with an accompanying Adult Season Ticket.

1.24Family Enclosure Season Tickets are eligible for family groups comprising of at least one Kid or Junior and one Adult per group and a maximum of two Adults to one Kid or Junior in the group.

1.25In order to maintain the safety and security of young patrons, the Club recommends that Junior Ticket Holders are accompanied to Matches by a responsible adult, but nevertheless insist that any person 11 years of age or under must be accompanied by a responsible Adult at all times.

1.26Ticket Holders expressly acknowledge and agree that by using a Ticket in the Family Enclosure they shall conduct themselves in a manner that is appropriate for a section which is ‘family friendly’ and includes children. Persons seated in this area shall, in addition to the other Conditions set out in this document and the Ground Regulations, also refrain from using bad language, swear words or otherwise behaving in a manner which is inappropriate in a ‘children friendly’ enclosure. The Club will seek to enforce the Conditions relating to conduct and behaviour more strictly in respect of persons seated in the Family Enclosure.

NON-PREMIER LEAGUE HOME MATCHES

1.27At the discretion of the Club, and in accordance with the requirements of Merseyside Police and Licensing Authority, the Club may offer Tickets for any non-Premier League Home Matches to Season Ticket Holders before they go on sale to the general public. Details of sale dates will be published on Home Match days, on the Website and where time permits, in the local press.

1.28For certain non-Premier League Home Matches, in order to comply with competition regulations and in accordance with the provision of the Club’s existing safety certificate it may not be possible for the Club to offer all Season Ticket Holders the opportunity of purchasing a Ticket for the seat they occupy at Premier League Home Matches. In this event, the Club will use reasonable efforts to offer those Season Ticket Holders the nearest available seat (subject to availability).

1.29The Club may, at its own discretion, for any non-Premier League Home Match make all or any seating area inside the Stadium unreserved and may offer Tickets for sale on that basis. In this event it will not be possible for Season Ticket Holders to purchase a Ticket for the seat they occupy at Premier League Home Matches.

NON-SEASON TICKET HOME MATCHES (AUTOCUP SCHEME)

1.30Season Ticket Holders can join the AutoCup Scheme up to, but no later than, 30 November 2016.

1.31Season Ticket Holders will receive written notification prior to the start of the Season confirming the Cup Home Matches for which they have applied (if applicable). Please note that receipts will not be issued on a Match by Match basis.

1.32The Club will use reasonable efforts to notify Season Ticket Holders of prices and payment dates at least 14 days prior to the Home Match via the Website, in Club publications and in the Everton Box Office. You can also receive details by email by contacting the Everton Box Office with your email address in accordance with the contact details.

1.33Season Cards for Season Ticket Holders who have joined the AutoCup Scheme will be activated for Cup Home Matches unless Season Ticket Holders are otherwise notified.

1.34Season Ticket Holders are not permitted to cancel single Cup Home Matches, but they may cancel their entire participation in the AutoCup scheme by notifying the Club in writing no later than 5 working days prior to the date of the next relevant Match to the Everton Box Office. Cancellation of the AutoCup Scheme means Season Ticket Holders are not permitted to re-apply for the AutoCup Scheme during that same Season. Where Tickets have already been issued, they must be returned to the Club 72 hours prior to the date of the relevant Match, at the cost of the Ticket Holder and will not be refundable if the Club receives the Tickets after this time.

1.35Change of payment details, including credit card or debit card expiry date, MUST be communicated in writing (but not email) by participants in the AutoCup Scheme to the Everton Box Office as soon as they become applicable.

1.36Participation in the AutoCup Scheme will be cancelled, and the option to participate in future AutoCup Schemes withdrawn, in the event that two failed payments occur in any Season.

AWAY MATCHES, CUP SEMI-FINALS AND CUP FINALS

1.37The Club’s allocation for Away Match Tickets will vary depending upon the capacity of the host stadium and/or the competition rules and regulations.

1.38In the event that anticipated demand is likely to outstrip supply, the Club may only accept applications by post or online. In these circumstances ticket priority will be given to those supporters with the relevant number of Away Match Ticket Credits defined according to pre-determined qualifying criteria. Specific details for each round will be announced by the Club once details are determined.

1.39In the event that progression is made to the semi-final or final round of a competition, priority will be given in the first instance to those Season Ticket Holders with the highest number of Away Match Ticket Credits. Specific details will be announced by the Club once allocation details are determined.

1.40No guarantee of Ticket allocation can be given in respect of Premier League Matches played at other stadiums.

1.41In order to receive Away Match Ticket Credits for attending Away Matches, you must provide your customer number (and those of any Guests) at the point of sale. Away Match Ticket Credits for attending Away Matches will not be given retrospectively in any circumstances.

1.42The Club expects Home Fans attending Away Matches to uphold the good name and reputation of the Club. Home Fans at Away Matches agree to conduct themselves at all times in a manner befitting a representative of the Club and agree not to do anything or procure anything to be done that will or is likely to bring the name or reputation of the Club into disrepute.

1.43The Club does not tolerate homophobic, sexual, sectarian, racial or discriminatory behaviour in any form (whether physical, verbal or other). Any Home Fan who is found or is reported to be abusing any football player, supporter, member of staff or any other individual in or around an Away Match, including any travel to and from an Away Match, will face arrest and prosecution by the police, as well as action by the Club.

SEATS

1.44Nothing in these Conditions shall constitute or imply any entitlement to occupy the seat indicated on the Ticket (or ticket confirmation) in any subsequent Match or Season. The Club may from time to time relocate a Season Ticket Holder from their usual allocated seat to an alternative seat within the Stadium where this is required for operational reasons.

1.45A Ticket does not confer to you title to the seat specified or any other seat in the Stadium and, unless expressly agreed in writing by the Club, a Ticket Holder is not granted an automatic right to reserve any such seat for any subsequent Match or Season.

1.46Ticket Holders must occupy the seat allocated to them by the Ticket provided that the Club reserves the right to relocate any Ticket Holder and/or Guest to any other seat in the Stadium at any time, for any reason.

1.47A Ticket admits the Ticket Holder to such areas within the Stadium and at such times as the Club may from time to time determine and in accordance with these Conditions and the Ground Regulations.

1.48Ticket Holders are not entitled to re-enter the Stadium if they leave the Stadium at any time on a Match day, except where the Club expressly approves such re-entry. The Club will only give such approval where a Ticket Holder had a compelling reason to leave the Stadium in the first instance (for example, reasons of medical emergency).

1.49Ticket Holders should be aware that access to the upper tiers of the Main Stand and Bullens Road Stands in the Stadium involves a substantial amount of climbing. Ticket Holders who have difficulty climbing or who suffer from vertigo are advised accordingly. Ticket Holders should also be aware that certain seats situated in the lower stands of the Stadium may be affected by adverse weather conditions.
