Theformofthemeasures are fixedduties EUR/tonne.

However, wewouldlike to drawyourattention to thefollowingrecitalsregardingundertakingssubmitted:

(639)TheIranianexportingproducer, theBrazilianexportingproducer CSN, supported by itsrelatedPortuguesecompanyLusosider, theBrazilianexportingproducerUsiminas, theUkrainianexportingproducerMetinvestsubmittedpriceundertakings. TheRussianexportingproducer NLMK already had submitted a priceundertaking to theCommission on 13 February 2017.

(666)Fiveexportingproducersofferedpriceundertakings on 26 and 27 September 2017. TheCommissionobservedthatthoseoffershavebeenreceivedwellafterthedeadline set by Article 8 ofthe basic Regulationread in conjunctionwithArticle 20 ofthe basic Regulation, whichrefers to thefinaldisclosure, and not to theadditionalfinaldisclosure.
(667) Article 8 ofthe basic Regulationforeseesthepossibility to offer (and accept) priceundertakings in exceptionalcircumstancesafterthatdeadline.
(668) TheCommissionwillassesswhetherthosecircumstances are met, and whetherthepriceundertakingscanbeaccepted. However, sincetheadditionalfinaldisclosuretook place late in theinvestigation, theCommissioncould not performthenecessaryanalysiswhether such priceundertakingswereacceptable prior to theadoptionofthepresentRegulation. ThereforetheCommissionwillexceptionally and in viewofthecomplexityoftheissue, notablytherightsofdefenceoftheinterestedparties, completeitsanalysis at a laterstage in duecourse. Thisisexplicitlyforeseen by Article 8 ofthe basic Regulation, whichprovidesforthepossibilityofacceptingpriceundertakings in exceptionalcircumstancesalsoafterthedefinitivemeasure has beenimposed. In thiscontext, theCommissionwillalso analyse thesignificanceofthe EU-UkraineAssociationAgreement.--
(669) ConcerningtheallegationthattheCommissiondid not reply to thepriceundertakingoffersubmitted to theCommission on 13 February 2017 by NLMK; theCommissionreferred to Article 8(1) ofthe basic Regulation, providingthatundertakingscanonlybeofferedafterprovisionalaffirmativedeterminationof dumping and injury has been made. In thisparticular case, no such determination had been made in February 2017. Therefore, thepriceundertakingoffered by NLMK willbeanalysed at a laterstagetogetherwiththeotheroffers.
(670) Moreover, with reference to Lusosider's comment thattheconstruction market on theIberianpeninsulawouldbe in futurewithouttheappropriatesupplyofrawmaterials, thisclaimwillbeanalysedwhenreviewingthepriceundertakingoffer by CSN/Lusosider.
