3.Whereanapplicationforsubdivisionconsentincorporatestwoormoreadjoiningexistingsites,thetotalareaofthelandsubjecttotheapplicationmaybetreatedasonesitesforthesolepurposeofsubdivisionalconfigurationanddesign.“Existingsite”meansallthelandheldinaseparateCertificate

ofTitleon19October2012.

5.1.2Minimumsitefrontage

5.1.3Sitelayout

1.ThelayoutofthesiteswithinthestreetblocksintheClevedonsub­precinct1Aand1Bmustbeconfiguredsothatallfuturebuildingscanbedesignedtofaceandfrontthestreet.

5.1.4Stormwatermanagementareas

1.ThecontrolsbelowapplytotheStormwaterManagementAreasshownonthePrecinctPlan1.

ClevedonPrecinct.

2.AllStormwaterManagementAreaswithintheprecinctmustassumethezoningoftheiradjoiningsub­precinct.WheretheStormwaterManagementAreahasmorethanoneadjoiningsub­precinct,themidpointofthestreamorgullymustbetakenastheboundarybetweenthesub­precincts.

3.TheStormwaterManagementAreasmaybedevelopedinaccordancewiththeunderlyingzoningprovidedthathydrologicalandotherevidencesubmittedwiththeresourceconsentapplicationdemonstratesthatthesubjectlandisnolongerrequiredforthepurposesofstormwatermanagement.

AllbuildingplatformswithinthesubdivisionmustbewhollyoutsidetheStormwaterManagementArea.

4.AllriparianyardswithintheStormwaterManagementAreamustbeplantedinaccordancewithare­vegetationplan/programmeapprovedthrougharesourceconsentapplication.Theplan/programmemustcontaina:

a.Pre­plantingsiteassessment

b.Plantingplanassessment

c.Annualmonitoringprogramme.

5.Allplantingidentifiedintheapprovedre­vegetationplan/programmemustbesecuredbywayofconsentnoticeonthecertificateoftitle,whichmustincludetherequirementforaprogrammeofweedandpestcontrol.

6.Thesubdivisiondevelopermustberesponsiblefortheimplementationoftherevegetationplan/programmeforaperiodof2yearsfromthetimeofplanting.

5.1.5Street trees

1.Forresidentialsubdivision,streettreesshallbeplantedataminimumaveragerateof1treeper20mofroadfrontagetoensure1treeper20malongbothsidesoftheroad.

2.AllspeciesselectedforstreetplantingshallbeapprovedbytheCouncil.

5.1.6Wastewaterservicing

1.Allsites,excludingsitescreatedintheClevedonsub­precinct3,capableofaccommodatingfuturebuildingsshallbeconnectedtoapublicreticulatedseweragesystemwhichisdesignedandconfiguredtoservicetheupstreamcatchmentinitsultimatelanduse.

2.WherelotsarecreatedintheClevedonsub­precinct3,anyon­sitewastewaterservicingshallbesituatedoutsideofthe1%AEPfloodplain,shownasStormwaterManagementAreainPrecinctPlan1.ClevedonPrecinct.Sub­precinct3landidentifiedforeffluentdisposalshallincludeprovisionforanominatedwastewaterdisposalmethodappropriatetothesitecharacteristics.

5.1.7Frameworkplan– sub­precincts 1A,1B,2 and3

1.Aresourceconsentapplicationforaframeworkplan,amendmentstoanapprovedframeworkplanorareplacementframeworkplanmust:

a.Theremustbenomodificationtothe100yearfloodplaintoaccommodatebuildingplatformsandwastewatercollectionanddisposalfields.

b.Allbuildingplatformsandwastewatercollectionanddisposalfieldsmustbelocatedoutsideof100yearfloodplain.

5.2.7Furthersubdivisioncontrolsforsub­precinct3

1.Subdivisioncanbemadeinstagesbymakingreferencebacktotheexistingsite.

2.Inrespectofanysitewithinasubdivisionthatwouldbecapableoffurthersubdivisionunderthesecontrols,furthersubdivisionmustnotbeundertakenofthatsitethatwouldresultinthetotalpermitteddensitybeingexceededwithrespecttotheexistingsite.Thisrequirementmustbesecuredbyasuitablelegalinstrumentwhichmustberegisteredoncertificatesoftitletoensureongoingcompliancewiththiscontrol.

3.WhereanapplicationforsubdivisionconsentisforanexistingsitethatcontainslandbothinsideandoutsideoftheClevedonPrecinct,theareaoflandcontainedwithintheClevedonPrecinct areamustbeconsideredthe“existingsite”or“parentsite”.ThelandoutsideoftheClevedonPrecinctareamustnotbeusedinthecalculationoftheaveragesitesizeforsubdivision.

4.ApplicantsmaywishtorefertotheAucklandCouncilTechnicalPublicationNo.58(TP58)incomplyingwiththerequirementsofthiscontrol.

5.Whereanapplicationforsubdivisionconsentincorporatestwoormoreadjoiningexistingsites,thetotalareaofthelandsubjecttotheapplicationmaybetreatedasonesiteforthesolepurposeofsubdivisionalconfigurationanddesign.

6.Subdivisionthatdoesnotcomplywithclauses5.2.7.1­4aboveisanon­complyingactivity.

5.3RoadingNetwork

ThefollowingrulesapplytotheRoadingNetworkshowninPrecinctPlan2:RoadNetwork:

1.RoadsshallbeprovidedinaccordancewiththeindicativealignmentsandroadtypesinPrecinctPlan1:ClevedonPrecinctandPrecinctPlan2:RoadNetworkandtheUnitaryPlanningMapsexceptthat

thealignmentofindicativeproposedroadsdepictedonthenetworkplanshallbedeterminedatthetimeofsubdivisionandaddressedwithinaComprehensiveSubdivisionPlan.

2.RoadsprovidedtotheeastoftheBusinesszonedlandshallincorporatepublicparkingasshownontheProposedLocalRoad­EastofClevedonBusinesszonelocalroadcrosssectionbelow.

3.Roadsshallbedesignedandconstructedinaccordancewithcouncil'slatestengineeringstandardsandcodesofpracticeunlessotherwiseprovidedforintheassessmentcriteria andtheClevedonDesignGuidedocumentfoundin2.1ofPart6­NonStatutoryDocuments.

4.Roadlevelsshallenableintegrationwithexistingorpotentialroadinglayoutsonadjoiningsites.

5.Allintersectingcarriagewaysshallmeetat90degrees.

6.Thecornerradiusonroadintersectionsshallbe7m,exceptwhereaLocalRoadoraProposedLocalRoad­EastofClevedonBusinesszoneintersectswithaDistrictArterialRoad,wherethecornerradiusshallbe10morwhereCouncilrequiresthatalargerradiusisrequiredtoaddressparticularsafetyortrafficflowconsiderations.

7.AllnewroadsshowninthePrecinctPlan1.ClevedonPrecinctandPrecinctPlan2.RoadNetworkshallbebuiltinaccordancewiththecrosssectionsbeloworstandardcrosssections(forcul­de­sacs)providedforwithinthisPlan,exceptthattheCouncilmayapprovechangestothecross­sections:

a.arisingfromthenatureoftopographyorothersignificantconstraints;or
