Based on article 1.3 point (d) of the UNMIK Regulation No. 2001/19 dated 13 September 2001 on the Executive Branch of Provisional Institution of Self Government in Kosovo and article 10.6 of Law on Hunting promulgated by the UNMIK Regulation No. 2006/41, dated on 11.08.2006;

Approves the following:

ADMINISTRATIVE INSTRUCTION NO. 02/ 2008

USE OF THE WEAPON AND SUITABLE MUNITION FOR HUNTING

Article1

Purpose

The purpose of this Administrative Instruction is the determination of the type, manner of thepermitting and use of the weapon as well and suitable munitions for hinting of wild life.

Weapons of the hunting and their types

Article 2

2.1Weapons of the hunting according of this Administrative Instruction are the fire weapon and separated in these types:

a)Weapon with the muzzle and spherical,

b)Weapon with the smooth muzzle (shot)

c)Combined weapons.

2.2 Based on the number of the muzzles, hunting weapons are separated in: one, two, three and multi muzzle.

Article 3

3.1 Munitions of the hunting in conformity with this Administrative Instruction are in:

a)Hunting munitions for the weapon with the muzzle with the spherical

b)Munitions of the hunting for the weapon with the smooth muzzle

3.2Bullet from paragraph 1 of this article should be composed in that way with the case of shooting in the bestiality the appropriate part deform as well and the biggest part of the kinetic goes in the body of the bestiality.

3.3Ball from the paragraph 1 of this article should be of the appropriate size of the case of the biggest permitted distance of the shooting provide the appropriate density of the spread and the effect in the bestiality.

Article 4

4.1Hunting in the wild life just using the weapons and suitable munitions for hunting.

4.2For hunting of some types of the wild life are permitted the use just of the hunting weapons and munitions in the accordance with the Law on Hunting and of this Administrative Instruction.

4.3Big hunting wildlife are allowed to shoot just with the weapons with the spherical (expect eager pig which is shootwith the weapon on smooth muzzle) usingmunitions of the caliber and weight of the bullet that is suitable power and the resistance for animal.

4.4Tiny animals and poultries are not permitted to be shoot with the weapons with the spherical with those half automatic, but just with the hunting weapon with the muzzle smooth two muzzles.

Article 5

5.1Manager of the hunting place and legal person prior the opening of the hunting season and time after time, when the necessity is presented should control the hunting weapon, their accuracy and hunters who have the permitting for hunting.

5.2Manager of the hunting place shall determine the place of the shooting where it will be done the preliminary control of the accuracy of thehunting weapon and the accuracy of theshooting of hunters.

Way of weapon use and munitions of hunting

Article 6

6.1Weapon and munitions of the hunting may be used just then when it is not risked the security of people and wealth.

6.2Hunting weapon must not be conveyed without permitting and without identification card on the identity.

6.3Hunting weapon must not be used out of the hunting place, place of the shooting or other places that are specified for the exercise of hunting.

Article 7

7.1Weapon and munitions of hunting are used in the accordance with the hunting rules and hunter label.

7.2Use of the hunting place in the shooting of some types of the wild life are determined by the manger of hunting place, in conformity with the provisional of Law on Hunting and of this Administrative Instruction taking into account the management plans and with the program of cultivation and protection of wild life.

7.3Convey of the hunting weapon up to the hunting place should be done in appropriate fiddle – case or in the cash box where it must have munitions.

7.4Hunting weapon filled in suitable munitions for hunting, at the moment of the determination of position for hunting (individual hunting), whereas of the hunting in groups after given of the sign for the commencement of hunting.

Article 8

Hunters have for the obligation that in thehunting to respect rules of the use of weapons and munitions of hunting as specified under of this Administrative Instruction in hunting.

Article 9

9.1Weapon and munitions of hunting are not allowed to be used at the time of reduce of the look destroyed by the climatic storm (floods, fog, wind, etc) as well and night.

9.2As night time is considered time from two hours after the sunset up two hours prior the sunrise.

9.3Exception from the provision of paragraph 1 of this article, weapon and hunting munitions is allowed to be used during the night just at the time with moonlight that enable the preliminary sight, with the case of hunting of the bear, wild boar, jackal, fox, badger, polecat and rabbit.

Article10

10.1With the case of hunting of big hunting animals may be used the weapon of hunting withthe muzzle with the spherical and with the suitable munitions respecting the preliminary conditions as it is given below:

10.2Exception from provision of paragraph 1 of this article, with the case of shooting of wild boar is allowed the use of monitionfrom the weapon of the hunting with the smooth muzzle, whereas the biggest distance allowed for the hunting is 40 meter.

Article 11

11.1Hunting in the tiny wild life may be done with the hunting weapons with the smooth muzzles as well and monitionrespectingpreliminaryconditions as it is given below:

11.2Expect from the provisions of paragraph 1 of this article, Fox (vulpes L), Jackal (Canis aureus), Badger (meles L) , Wild cat (Felis silvestris Schr). Brown Rook (corvus fragilegus L), Rook (corvus fragileus L), Magpie (Pica pica L), Jay (Garulus glandarius L), is allows to be shoot with the hunting gun with spherical muzzle of smaller caliber.

Article 12

In the wild animal wounded is allowed to shoot also in the far distance rather than it is allowed.

Article 13

The present Administrative Instruction enters into force upon the day of its signature.
