I.CURRENT ISSUES.

A.2017-2018 TSBP Legislative Appropriation Request (LAR)

  • Senate Finance Committee Hearing – Tuesday, February 14, 2017

B.Pharmacy Technician Examinations

At the February 7, 2017, meeting,the Board approved allowing pharmacy technicians to take the ExCPTexamination as well as the examination offered by PTCB.

C.Texas Prescription Monitoring Program.

  • Statistics for FY2017 – 1st quarter (September – November)
  • Phone calls – 7,630 phone calls
  • Registered users – 43,227
  • # of searches – 800,041
  • # of prescriptions submitted – 10,304,073

D.USP 800 Task Force

  • 1st Meeting – January 31, 2017
  • 2nd Meeting to be scheduled

II.ADOPTED RULES (February 7, 2017 Meeting – The rules will become effective inMarch 2017)

A.Amendments to §291.93 Concerning Labeling Requirements– The amendments update the rules for Class D pharmacies to be consistent with other sections; and clarify the labeling requirements to allow an auxiliary label to be used for adding certain information to the prescription label.

BAmendments to §291.106 Concerning Licensing Requirements for Class E-S Pharmacies – The amendmentsspecify that a Class E-S pharmacy may not renew a pharmacy license unless the pharmacy has been inspected by the board or its designee within the last two year renewal cycle to be consistent with other sections.

C.Amendment to Chapter 297.3 Concerning Pharmacy Technician Registration Requirements– The amendmentsremove the reference to the Pharmacy Technician Certification Board’s National Pharmacy Technician Certification Examination and specify that a pharmacy technician must have taken and passed an examination approved by the board.

III.PROPOSED RULES (February 7, 2017, Meeting)

A.Amendments to §281.61 Concerning the Definition ofDiscipline Authorized – The amendments, if adopted, update the definition of probation and revocation.

B.Amendments to §291.3 Concerning Notification – The amendments, if adoptedupdate the requirements for a change of name for a pharmacy; update the notification requirements for internet sites verified by NABP; add a requirement for pharmacies and pharmacists to report disciplinary action by another state to TSBP as required by §562.106 of the Act; and clarify requirements to be consistent with other sections of the rules.

C.Amendments to §291.52 Concerning the Definition of Full-Time Pharmacist – The amendments, if adopted, add the definition of a full-time pharmacist to the Nuclear (Class B) pharmacy rules.

D.Amendments to §315.3 Concerning Earliest Fill Date for Schedule II Prescriptions– The amendments, if adopted, clarifies the requirements for dispensing schedule II prescriptions when issued as a multiple set.
