Quick Explanation of Fixed & Non-Fixed Unit Trusts

Quorum Services can provide two types of Australian unit trusts.

What is the difference between a Fixed Unit Trust and a Non-Fixed Unit Trust?

Fixed Unit Trust — consists of one class of ordinary unitholders,which have the same rights to capital and income distributions of the trust in proportion to their unitholdings.
Non-Fixed Trust — with a non-fixed unit trust you can create two classes of unitholders:
ordinary unitholders, which have the same rights to capital and income distributions of the trust in proportion to their unitholdings;
income unitholders who may, at the trustee's discretion, receive distributions of income of the trust.

You don't need to issue income units at the time the Trust is set up.The deed allows the Trustee to issue them later. Also, income unit holders do not need to sign the deed: so you can issue income units at the start without those unit holders being a party to the deed.

However, at the time the income units are issued, the income unit holders must pay the Trustee $1.00 for each income unit they are issued.
