PROPOSED REZONING OF PORTION 3 OF FARM BONATHABA NO.1100, DIVISION MALMESBURY

Your application on behalf of Black Orchard Farming (Pty) Ltddated 24 August 2016 with reference MAL/9733/AC, regarding the subject has reference.

By virtue of the authority that is delegated to the Director: Development Services in terms of the decision of Council No. 7.25 dated 13 May 2015 as determined in Section 69(1) of the Swartland Municipal Land Use Planning By-Law (PG 7420 of 3 July 2015), the application for the rezoning of a portion of portion 3 of farm Bonathabano.1100 (±8521m² in extent), Division Malmesburyis hereby approvedin terms of Section 60 of the abovementioned By-Lawfrom agricultural zone 1 to agricultural zone 2 in order to operate a packing store subject to the following conditions:

1.Town Planning and Building Control

(a)The agricultural zone 2 zoning be restricted to ±8521m² as presented in this applicatoin;

(b)Building plans be submitted to the Director: Development Services for consideration for the erection of any structures;

(c)This approval is in terms of Section 66 (2)(w) of the By-law valid for a period of 5 years;

2.WATER

(a)No municipal drinking water can be provided;

3.SEWERAGE

(a)Sewerage services can only be provided for household sewerage by means of a vacuum truck;

4.REFUSE REMOVAL

(a)If any dump sites within the municipal area are to be used, pre-paid refuse coupons must be obtained from any municipal office and shown at the dumpsite prior to any refuse can be dumped;

5.DEPARTMENT OF TRANSPORT AND PUBLIC WORKS

(a)No new accesses in terms of Roads Ordinance 19 of 1976 may be built or existingaccess layouts or access uses changed without the approval of the Department of Transport and Public Works;

(b)Trees and vegetation must be cleared adjacent to the access on Minor Road5382 to ensure that the shoulder sight distance triangles are open;

6.DEPARTMENT OF WATER AFFAIRS

(a)No abstraction or any use of surface or groundwater may be done without prior authorisationfrom this Department, unless it is a Schedule 1 Use or an Existing Lawful Use;

(b)All the requirements of the National Water Act, 1998 (Act 36 of 1998) regarding water use and

pollution management must be adhered to at all times;

(c)No pollution of surface water or ground water resources may occur due to activities on the

property.

7.TELKOM

(a)Should alterations or relocation of existing infrastructure be required, such work will be done at therequest and cost of the applicant;

(b)Please notify Telkom within 21 working days from this letter of acceptance and if any alternativeproposal is available or if a recoverable work should commence;

(c)As important cables are affected, please contact our representative MARIUS JONCK at telephone number 081 363 7944 at least 48 hours prior to commencement on construction work;

(d)Should Telkom SA infrastructure be damaged while work is undertaken, kindly contact our representative immediately;

(e)All Telkom SA LTD rights remain reserved.
