IB 2. Interpretation of Bidding Documents / The following terms supplement the Definitions contained in the proposed Contract Documents and shall apply to all Bidding Documents.
.1 / Addendum (a): means those documents, written or graphic, issued during the Bidding Period that add to, or delete from, supplement, clarify or otherwise change, enhance or supersede the proposed Contract Documents.
.2 / Bid(s): means an offer to perform the Contract for a stipulated price within a stipulated time in accordance with the requirements of the proposed Contract Documents and Addenda issued during the Bidding Period.
.3 / Bid Bond: means the document to be provided by the Bidder as described in Article IB 7 in these Instructions to Bidders.
.4 / BidClosing: means the event occurring precisely at the time and date specified, and at the location specified, in Article IB 1 in these Instructions to Bidders and Bid Closing Date means the time and date specified in Article 1B.
.5 / Bidder(s): means the entity submitting a Bid at, or before, BidClosing in accordance with the requirements of these Instructions to Bidders.
.6 / Bidding Documents: means those documents listed in Article IB 3 of these Instructions to Bidders.
.7 / Bidding Period: means the time occurring between the call for Bids and the date and time of Bid Closing which time can only be extended by issuance of an Addendum during the Bidding Period.

.8 / Bid Label means the label prepared by the Owner specifically for this Project and marked with the words “BID” and “MAY ONLY BE OPENED BY THE OWNER” to be used by the Bidder to label the Bid and other supporting documentation required and as described in Article IB 6 of these Instructions to Bidders.
.9 / BidForm(s): means the form prepared by, and issued by, the Owner specifically for this Project to be completed in full by, and submitted by, the Bidder.
.10 / Bid Price: means the Stipulated Price(s) quoted on the BidForm.
.11 / BidRevisions: means any revision to the Bid, made in writing by the Bidder in accordance with Article IB 9 of these Instructions to Bidders.
.12 / Consent of Surety Letter: means the document to be provided by the Bidder at the time of Bidding described in Article IB 8 in these Instructions to Bidders.
.13 / Contract Documents: shall consist of the documents set out in Article IB 3.4.
.14 / Definitions: means the Definitions of the Stipulated Price Contract CCDC 2-94.
.15 / Owner: means The National Museum of Science and Technology operating under the name Canada Science & Technology Museum Corporation,
.16 / Unit Price: means the price per unit acquired of the Bidder and indicated in the Bid Form for Work performed under the Contract Documents.
Terms which are not defined in Article IB 2 shall have the means set out in the definitions of Stipulated Price Contracts CCDC 2 1994 which form parts of the Contract Documents.
IB 3. List ofBidding Documents / The Bidding Documents shall consist of the following:

The proposed Contract Documents shall consist of the following:

IB 4. Guidelines for Completing the Bid Form / .1 / All Bidders must complete the Bid Form by filling in all the blanks.
.2 / Alterations, corrections, changes or erasures made to statements or figures entered on the Bid Form are to be initialled by the person or all persons executing the Bid Form.
.3 / All Bidders shall use the Bidder’s legal name written out in full together with the address the Bidder wishes to use when receiving notices or communications for contractual purposes.
.4 / All Bidders shall list, by number, in the space provided on the Bid Form, each and all Addenda received during the Bidding Period.
.5 / All Bidders shall insert the Project Number and Project Title on the Bid Form as described on the cover sheet or title blocks of the drawings. [NTD: It would be preferable to insert the project number and project title on the Bid Form in the standard form provided to Bidder]
.6 / The Contract Time will usually be specified in Division 1 of the Specifications. Where such Contract Time is not specified, insert in the space provided on the Bid Form, the number of weeks required by the Bidder to perform all Work, from date of commencement of the Work to the date of Substantial Performance of the Work.
.7 / All Bidders shall complete the Bid Price section of the Bid Form by filling in the amount in words AND numbers.
.8 / All Bidders shall list the names and addresses of the requested Subcontractors.
.9 / All Bidders shall Complete the Unit Price schedule, extend the units and indicate the total value of each unit Price Bid.
IB 5. Guidelines for Executing the Bid Form / .1 / All Bidders shall execute the Bid Form over the word “SEAL”. [NTD: You may want to delete this requirement of the SEAL]

IB 6. Bid Submission Requirements / [Note: All Bid Documentation should be included in an envelope which should be clearly marked with the word “BID” in large letters on both the front and back of the envelope, and be labelled with the project title, project number, date and time of bid closing, and the bid delivery address. Sufficient space should be allocated for the Bidder to insert it’s name address and telephone number on the front of the envelope.
The Bid Label located on page 10 of Section 00100, Instruction to bidders is provided for this purpose.
.1 / Bidders should submit their Bids on the Bid Form provided. Do not add any qualifications to the Bid.
.2 / Bidders should prepare their Bids based only on the contents of the proposed Contract Documents including all Addenda issued during the Bidding Period.
.3 / Bidders should properly complete and execute the Bid Form following the guidelines specified in Articles IB 4 and IB 5 above.
.4 / All Bids should include the Bid Bond or appropriate Bid security as specified in Article IB 7.
.5 / All Bids should include the Consent of Surety Letter or other security required as set out in Article IB 8.
.6 / Do not submit any letters, other explanatory information or any material other than the contents required by these Instructions to Bidders. Any other material submitted by the Bidder will not be considered by the Owner.
IB 7. Bid Bond / .1 / Each Bidder shall provide a Bid Bond made out in the name of the Owner signed under seal by the Surety, and executed by the Bidder.
The Bid Bond shall be in the amount of ten percent (10%) of the Bid Price. The Bid Bond shall follow the wording of CCDC 220-1979 and be issued by a bonding company acceptable to the Owner.
.2 / In lieu of providing the Bid Bond as set in item .1, security deposit by certified cheque payable to the Owner in an amount that is equal to not less than 10% of the Bid Amount shall be acceptable.
IB 8. Contract Security Requirements / .1 / The successful Bidder shall be required to provide contract security in accordance with the following requirements and the Contact Documents within fourteen (14) days after receipt of a notice in writing that his Bid was accepted by the Owner.
.2 / The performance bond in an amount that is equal to not less than 50% of the contract amount, or
.3 / a labour and material payment bond in an amount that is equal to not less than 50% of the contract amount.(NTD: Any chance that both Bonds are required, in which case the word “o” should be changed to “and”)
.4 / in lieu of bondingas stated in items .2 & .3 above, a security deposit by Certified Cheque payable to the Corporation in an amount that is equal to not less than 10% of the Bid Amount may be submitted plus an additional amount that is equal to 10% of the contract amount. [NTD: Will the Bid Amount be different than the contract amount?]
IB 9. Bid Revisions / .1 / A Bid submitted in accordance with these instructions may only be revised in writing, provided it is received at the address for submission of Bids on or before the date, and before the time, of Bid Closing, and provided that the Bid Bond accompanying the Bid is equal to, or greater than, the amount specified in these Instructions to Bidders. Such revisions are hereinafter called Bid Revisions.
.2 / Letters of Bid Revisions must bear the Bidder's authorised signature(s) in accordance with the requirements for execution described above.
.3 / In all cases the latest Bid Revision will govern.
.4 / The irrevocability provisions of the original Bid as amended by the Bid Revision will remain in full force and effect.
.5 / Under no circumstances will faxed Bid Revisions be accepted.
IB 10. Listing Subcontractorson the Bid Form / .1 / In the place provided on the Bid Form, all Bidders shall list the names and addresses of the Subcontractors and the Bidder’s first alternative Subcontractors that the Bidder will employ when performing the following trade Work:
- Division 15Mechanical
- Division 16Electrical
.2 / In addition to the foregoing, the Owner may, at its option, request that prior to award of a Contract, the selected Bidder shall, within 48 hours of receipt of a notice of request in writing from the Owner, submit the names and addresses of the Subcontractors and Suppliers that the Bidder will employ when performing part or parts of the Work listed in the said notice.
IB 11. Listing of Unit Prices on the Bid Form / .1 / Bidders shall complete the list of required Unit Prices in its entirety by inserting the cost of each Unit in the place provided on the Bid Form and extending the cost of each Unit Price multiplying it by the estimated number of Units to complete the right hand column of the Bid Form.
.2 / Where there is an honest error in the extended price, the Unit Price stipulated shall govern and shall be calculated accordingly with the estimated quantity. For greater certainty any failure by a Bidder to insert a Unit Price where required shall be deemed to be $0 value.

IB 13. Enquiries

Clarifications issued as a result of oral or telephone enquiries are not binding unless supported in writing by the issuance of Addenda. All Addenda will be considered part of the Contract Documents. The Owner will attempt to provide all Addenda to all known Bidders but it is the Bidders responsibility to ensure that the Addenda are incorporated into their Bid.

Should a Bidder find omissions or discrepancies in the Contract Documents or should the Bidder be in doubt as to the meaning of any part of such documents, the Bidder should notify the Corporation in writing without delay.

The Bidder recognizes that the information contained in the Contract Documents represents the most thorough data available at this time. While the Owner has made a special effort to identify as accurately as possible the scope and quality of the products for services required, all Bidders are responsible for obtaining the exact information they need to present their Bid to the Owner. All Bidders must become familiar with the terms of the Contract Document to meet the requirements of the Contract Documents at no cost to the Owner. The Owner cannot be held responsible for the accuracy of the information contained in the Contract Documents or for which the information is used or interpreted by the Bidder.

IB 14. Site Assessment/Security / .1 /

The Bidder shall visit the site and surrounding area to fully satisfy itself as to the nature and extent of the entire Work and to assess any local factors that may influence the manner in which the Work is to be delivered. [NTD: Are there any compulsory visit]

A security clearance must be process before gaining access to the Owner’s place of work. The Contractor shall fax a list of employees (Last, Middle and First Name) and their date of birth (Year/Month/Date) to Protection Services (613-998-7908) 48 hours is required for any security clearance when scheduling commencement of Work. The Contractor shall take this into consideration.

B 15. Substitutions and Alternatives / .1 / The Bidders shall complete the Bids based on the materials, products or systems indicated or specified in the proposed Contract Documents.
.2 /

Bidders wishing to offer a substitute or alternative material, product or system to those indicated or specified in the proposed Contract Documents shall:

.1a) / Submit before Closing Date a written request accompanied by such detailed documentation necessary for the Consultant to properly evaluate the properties of the offered substitution or alternative.
b) / Allow a minimum of ten (10) days for review by the Consultant prior to the date and time set for Bid Closing.
.3 / Acceptance of a substitute or alternative material, product or system will be communicated by issuance of an Addendum.
.4 / Substitutes or alternative materials, products or systems requested by a Bidder, but not accepted by the Consultant and communicated in an Addendum, are rejected.
IB 16. Addenda / .1 / Addenda may be issued during the Bidding Period.
.2 / Addenda may include clarifications, additions, deletions, substitutions, alternatives and other changes to the Bid Documents.
.3 / Addenda will be considered as being part of the Contract Documents and therefore all costs associated with such Addenda are to be included in the Bid Price.
.4 / Bidders shall mark the number of Addenda received in the appropriate location on the Bid Form.
IB 17. Availability of Bidding Documents / .1 / Two copies of the Bidding Documents are available from the Canada Science and TechnologyMuseum, Door N-4, 2421 Lancaster Rd.Ottawa, ON., K1B 4L5. upon receipt of a deposit or cheque in the amount of $100.00. The deposit/cheque can be returned to the Bidder upon return of the Bidding Documents in their complete and original form.
IB 18. Bid Acceptance, Rejection or Negotiation / .1 / The Bidder, in submitting the Bid, acknowledges that the Owner shall have the right to deal with any Bid submitted in such manner as is, in the Owner’s view, in the Owner’s best interests.
.2 / The Owner shall have no obligation to any Bidder as a result of this call for Bids or the receipt of a Bid from any Bidder except as may be expressly stated in the Bidding Documents.
.3 / The Owner shall have the right to reject any or all Bids regardless of the amount of the Bid or of any competing Bid, to accept any Bid it might choose, or following receipt of Bids, to negotiate with any Bidder a Contract for the performance of all, or any portion, of the Work described in the proposed Contract Documents, without obligation or liability to any Bidder.
.4 / The Owner may at any time amend, alter or cancel the Bid process in whole or in part at no cost or penalty to the Owner. No reason for amendment, alteration or cancellation need be given. In the case of such cancellation, the Owner reserves the right to approach other companies to order the contract or negotiate a contract with any one of the Bidders.
