Monthly Meeting Minutes

ForMarch 1, 2006

Members Present:Hollis Warren (HW), Byron Jefferson (BJ), Kenny Darling (KD), Scott Kline (SK), Phil King (PK), Dave Schepens (DS) and Matt Brill (MB)

Members Absent:

Meeting began at 9:15 a.m.

  1. MB made a motion to add additional items to agenda, PK seconded, all approved.
  2. SK made a motion to approve the February 1, 2006 meeting minutes as submitted, PK seconded, all approved.
  3. PK made a motion to add Anna Sollenberger to the agenda, MB seconded, all approved.
  4. MB made a motion to move Bruce Bagley up on the agenda, PK seconded, all approved.
  5. The OSSAB members introduced themselves to Mr. Bagley.
  6. Jack Hayes speaking on behalf of DNREC with regards to site evaluations submitted to the Georgetown Office (SussexCounty).
  7. Explained Mr. Bagley’s background with DNREC and Laural Oak.
  8. Requested that Mr. Bagley take more time on the site evaluations, slow down and check for accuracy, and if needed take less work.
  9. Has heard (however is not confirmed) that other individuals are doing the work under Mr. Bagley’s license.
  10. Michele Adkins speaking on behalf of DNREC with regards to site evaluations submitted to the Dover Office (Kent & New Castle Counties).
  11. Requested that Mr. Bagley take more time when performing site evaluations.
  12. Stated that she has spoken with Mr. Bagley several times regarding the issues outlined in the letter.
  13. Has heard (however is not confirmed) that other individuals are doing the work under Mr. Bagley’s license.
  14. Reiterated to Mr. Bagley that it is his license and he is held accountable for the work performed under the license.
  15. BJ read a copy of Mr. Bagley’s letter dated February 8, 2006.
  16. Mr. Bagley stated:
  17. The soil descriptions are his own, he does have someone else digging the holes.
  18. He questioned his abilities when he received the letter from DNREC and the OSSAB.
  19. He stated he is not taking the time necessary on individual site evaluations and providing the details as he would with a community system.
  20. Apologized to Jack and Michele for using their resources.
  21. Restated that no one has ever described the soils other than himself.
  22. Apologized to the OSSAB for taking time away to deal with something that should not have been an issue.
  23. BJ advised that DNREC is not recommending action on his license but rather a warning.
  24. Discussion continued with questions regarding Mr. Bagley’s current work load, plan for improvement and how this plan will be implemented.
  25. The OSSAB thanked Jack and Michele for their thorough documentation of the situations.
  26. DNREC will continue to monitor Mr. Bagley’s work and report to the OSSAB.
  27. Marion Shulties
  28. Sue Marsett provided an overview of deficiencies to the Board.
  29. Issues outlined in the Manager’s Warnings dated 11/14/05 and 11/03/05 have been resolved, however some items not in a timely manner.
  30. BJ advised that DNREC is not making a recommendation to the OSSAB to have his license acted upon but rather to get his attention to the problem areas.
  31. Discussion continued regarding the importance of paperwork and the implementation of a system to improve upon this deficiency.
  32. DNREC will continue to monitor Mr. Shulties’ work and report to the OSSAB.
  33. Hilary Moore spoke to the OSSAB regarding work performed by Gary Moore.
  34. Advised that plans for large and community systems are returned for numerous errors frequently.
  35. The OSSAB requested that DNREC issue their Managers Warning and provide supporting documentation.
  36. The OSSAB requested Mr. Moore’s appearance at the April meeting.

  56. Generate letter to Secretary Hughes with recommendation.
