INCIDENT

A PCR call was made at 100 by Ravinder Kumar, father of Jhonny Gupta at 11.35 PM on 03/04/2012 from his residence BG-6/284 Paschim Vihar, Delhi stating that his son Jhonny, who is a site Engineer working with a private contractor in Model Town, Delhi has not come back from his job. Later on at around 11.59 PM he received a call from his son’s mobile on which an unknown person demanded ransom amount of Rs. One Crore. The local enquiry revealed that he was last seen with one of his friend Ashok in the area of Police Station Keshav Puram. Based on these facts an FIR No. 83/12 u/s 365/364A IPC was registered and the investigation was taken up by SHO/Keshav Puram.

INVESTIGATION

All the friends, acquaintances, relatives and employers were interrogated and it was found that he met Ashok in the evening and thereafter had gone to meet Anoop in the area of Punjabi Bagh. He was on his motorcycle that evening.

On interrogation of Anoop, it was found that he was giving contradictory statement about his meeting with Jhonny that evening. And the same time he was unable to explain his presence between 7 to 9 PM on that evening. On his sustained interrogation he broke down and confessed his role into the kidnapping of Jhonny in collaboration with his two associates namely Anil and Avinash Srivastav @ Master ji. On his instance both Avinash and Anil were apprehended from their respective houses.

INTERROGATION

On sustained interrogation of Anoop, Anil and Avinash it was found that they had hatched the conspiracy to kidnap Jhonny one week back, but were unable to execute it as Avinash was out of Delhi for few days. All three accused wanted to earn quick money the easy way. In furtherance of this cause they all hatched a conspiracy to kidnap Jhonny and to seek money from their parents as ransom. Anoop gave an information that Ravinder Kumar had recently received huge sum and can easily give ransom one crore. Anil, who is the resident of Rewari, Haryana arranged for four packets of salt (Total 40 Kgs.) to facilitate rapid decomposition of dead body and Avinash offered to detain Jhonny in his rented semi constructed godown at Kamruddin Nagar, Nangloi.

On 03/04/2012 at around 6.40 PM Anoop called Jhonny asking him to meet at Punjabi Bagh flyover. Jhonny was on his motorcycle that evening. Anoop falsely lured Jhonny Thereafter they both had gone on Anoop’s M/Cycle parking his M/Cycle at Peera Garhi Metro Station and reached the rented godown of Avinash. They met Avinash and Anil there. Anoop left the place on pretext of some urgent work. At around 9 PM when Jhonny tried and insisted to leave, then Anil and Avinash both resisted. During this struggle both Avinash and Anil strangulated Jhonny using a wire and then buried his body in the pit, which they have already dug up a week back. To enable a rapid decomposition, they placed salt over his body and then left the place on M/Cycle. While moving out, they took purse, mobile and cash from Jhonny’s dead body. When they reached Wazirpur, they made the ransom call using Jhonny’s mobile to Ravinder Kumar. During this conversation they claimed that they have kidnapped Jhonny and asked them to deliver one crore rupees at a place which they will declare later on. Thereafter they left for their respective homes.

They were planning to call Ravinder Kumar father of the deceased in the night asking him to board Gomti Express from Delhi to Lucknow and were planning to receive the ransom amount during the journey. However, they were arrested before they could make this call.

RECOVERY

On their instance following recoveries were made:-

2. Mobile phone of Jhonny, which was used make the ransom call, was recovered from Anil.
