National American Miss2017 Ford Mustang Convertible Drawing Rules

GENERAL CONDITIONS: Spirit Productions, Inc. (Sponsor), 5821 W. Sam Houston Parkway N. Suite 100, Houston, Texas 77041, is the Sponsor of the National American Miss 2017 Ford Mustang Convertible Drawing (Drawing). The Drawing is open to Nationals Participants in the 2017National American Miss pageant Finals in Anaheim, California (Nationals Participants). By entering, you agree that you have complied with and will be bound by these official Drawing Rules (Drawing Rules). As a Nationals Participant, you agree to the use of your name, photograph, voice, likeness or demographic information related to the Drawing in any manner and for any purpose in any media now known or hereafter developed by Sponsor, its owners, affiliates, directors, officers, employees, subcontractors, sponsors and agents, including without limitation its advertising and promotions agencies without further compensation, except in Tennessee or where otherwise prohibited. The winner will be required to sign and return one or more documents, including an affidavit of eligibility, a publicity/liability release and a waiver and release of liability form upon being notified that she is a winner. If applicable, the winner's parent or guardian must execute the required forms. If a winner does not sign and return the required documents within 14 days of the selection of the Winner of the Drawing, that Winner will be disqualified from the Drawing. All entrants warrant that they are not subject to the verification requirements of the Children’s Online Privacy Protection Act (COPPA). Void where prohibited.
Any attempt to deliberately damage the content or operation of this Drawing is unlawful and subject to legal action by Sponsor. Sponsor can, at any time, without recourse, decide to terminate or modify the Drawing if the integrity of the Drawing appears to be compromised.

ELIGIBILITY:Drawing is open only to persons who, according to the pageant rules for the National American Miss, are qualified for and participate in the 2017 National Finals of the National American Miss pageant (Finals). There are many ways to qualify to be a Nationals Participant; participation is not limited to only State Queens. The finals are held in Anaheim, California during Thanksgiving holiday week. For a list of ways to achieve qualification, go to To win,entrants must be present at the Finals, and in attendance at the Drawing in the ballroom, at the time of the drawing on Thanksgiving Day 2017.
TO ENTER:Nationals Participants are entered in the drawing as they arrive at the ballroom and check in for the Drawing on Thanksgiving Day 2017.The time of the check-in and drawing are shown in writing on the final schedule that is mailed to all registered Nationals Participants prior to the event. If, for any reason a qualified participant does not have the schedule, they may request one by email to . If there is not an immediate reply, then that is an indication that the email was not received and addressed, whereupon the office must be called and a schedule obtained or other written means of obtaining the times. Nationals Participants may not make extra entries to increase chances to win.
ENTRY PERIOD:Nationals Participants will be determined during the 2017 National American Miss state pageant events (Entry Period). For a list of 2017 National American Miss state pageant events, go to
SELECTION OF WINNER: TheWinner will be chosen in a random drawing by Sponsor at 2017 Finals of the National American Miss Pageant on November 23, 2017 in Anaheim, California. Winner will be notified at the time of the drawing.
PRIZE: There will be only one Winner of one Prize.The randomly-selected Nationals Participant will be given one prize of a 2017 Ford Mustang Convertible (basic model) Approximate Retail Value (ARV) of the prize is $28,398. ARV is determined by search on KelleyBlueBook. com which is performed by Sponsor within 60 days of the actual drawing. At the sole choice of Sponsor, a 2017 Ford Mustang Convertible may be substituted. Odds of winning depend on the number of Nationals Participants. Sponsor expects anywhere from 500-800 Nationals Participants at the 2017 National American Miss pageant finals, but the actual number may exceed those estimates. Prize winner must take delivery of the Prize at the Ford Dealership of Sponsor's choosing; any desired transportation of the car to a different city is at the expense of the winner. All expenses, including but not limited to vehicle registration, title, license, insurance, and after-market options, are the sole responsibility of the winner. All applicable state, local, and federal taxes on prize are the sole responsibility of the winner. Winner will be given the option to take a monetary prize in lieu of the car; the choice is totally up to Winner. The monetary alternative is a lump sum monetary payment of $19,000.00, or $1,007 monthly for 24 months, or $703 for 36 months. There will be no substitution of prizes unless the prize cannot be awarded due to circum-stances beyond the control of Sponsor. In that event, Sponsor will substitute another prize of greater or equal value.The selection of a substitute prize will be final and binding on the winner. The Prize is non-transferable. Sponsor's decisions are final on all matters related to the Drawing.
RELEASE AND LIMITATIONS ON LIABILITY:As a condition of entering this Drawing, you agree that: (1) under no circumstances will you be permitted to obtain awards for any losses or damages, and you hereby waive all rights to claim actual, punitive, incidental and consequential damages and any other damages, including claims for damages relating to any negligent acts or omissions or willful misconduct of Sponsor, and attorneys’ fees and costs; and (2) any and all disputes, claims and causes of action arising out of or connected with this Drawing, or the prize awarded, including those claims for the negligence or gross misconduct of Sponsor, shall be resolved individually, without resort to any form of class action, and exclusively by binding arbitration to be conducted according to the rules of the American Arbitration Association in Houston, Texas.By entering this Drawing, the winner agrees to release and indemnify the Ford Dealership, National American Miss, National American Miss, Inc. and its respective affiliates, directors, officers, employees and agents, including without limitation its advertising and promotions agencies, from and against any and all liability for loss or damages arising out of or in connection with awarding, receipt, use or misuse of the prize or participation in any prize-related or Drawing-related activity, including those claims for the negligence or gross misconduct of the indemnified parties.
SPONSOR MAKES NO WARRANTY OF ANY NATURE WITH RESPECT TO THE DRAWING OR ANY PRIZE, WHETHER IN RESPECT OF FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY OR OTHERWISE. ENTRANTS ACKNOWLEDGE THAT, EXCEPT AS SPECIFICALLY AS SET FORTH HEREIN, SPONSOR HAS NOT MADE AND DISCLAIMS ALL LIABILITY FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATED TO THE DRAWING OR ANY PRIZE.
