Nathan asked what was the interesting aspect for engaging into Jurisdiction?
Answer: The need to know how and the desire is there.
Jurisdiction Community Coordinator Position has been posted on FNESC website.
Tl’azt’en First Nation BCR Update:

  • A FN has come forward wanted to become a participating FN, only 24 have been eligible to engage in Jurisdiction, INACs position is that is the cabinet response is hard to change.
  • Tl’azt’en FN wanted to become negotiating FN, a letter was written to Chuck Strahl, and the letter was a request to open opportunity to all FNs.
  • INAC has received the BCR from Tl’azt’en FN.

Political Update:

  • Election is being called; there has been a hold on INACs mandate.
  • Leadership Council of BC is participating in the election in various positions, lobbying, and they did ask for a briefing note, for positions, for Assembly of BC, and Assembly of First Nations.
Update provided:
  • Provincial side, FNESC is putting a lobby strategy for Assembly of First Nations.
  • Met with Premier Campbell, who provided a commitment to close the gap for FN school funding, Campbell has requested FN examples of how FN schools put more into their schools, as positive examples, to focus on the positive.
  • FNESC will be looking at this, and researching this, to provide these examples.
  • The BC Government is becoming more aware of Reciprocal Tuition, and is now looking at how to support this issue.

Capital Sub Committee Update:

  • Update provided.
  • Kathi Dickiesent out the capital survey, to all 63 IFNs. Very few were completed. It was recommended to be re-sent to all IFNs.
  • Contacted INAC and received a comprehensive response.
  • Inquired INAC if any FN is on the Capital Committee, and the response from INAC indicated a vacancy.
  • Public schools went up to 5 billon for operational costs, and First Nation schools are continued under funded.

Action Items: / On Day 2: Email from INAC was provided to IFNs.
Capital Survey were distributed to IFNs at the meeting.
Pearl Morgan – to Resend the Capital Surveys to 63 IFNs, to be completed by next Jurisdiction meeting.
Reciprocal Tuition:

  • Province has agreed to discuss Reciprocal Tuition, for those living off-reserve attending a reserve school.
  • Initially, all independent schools would have no problem for Reciprocal Tuition, as they are set-up, have assessments, and supervisions.
  • Province asked about First Nation schools, and FNESCs response, was accountability would be met.
  • 1701/1601 forms were provided by Ministry of Education, and requested for FNESC to review and confirm how these questions could show accountability.
  • FNESC received an update from Ministry of Education In July; legislation needs to change, for Reciprocal Tuition.
  • The main object is to continue this initiative, and will be requesting Ministry to back date Reciprocal Tuition.
  • FNSAs assessment was hopefully to be used to recognize the high standard.

Review Counter Offer In Preparation for INAC (Indian and Northern Affairs Canada):

  • Provincial averages were used in the agreement for comparison for counter-offer.

Important Negotiating Points:
  • There needs to be inflation protection.
  • Enrolments need to be recognized.
  • There needs to be adequate provision for technology.
  • Funding for capital is required.
  • Concern of how this could affect the small schools, by LEAs,
Recommendations or Concerns:
  • More information for Interested First Nations, when reviewingthis counter offer and process.
  • Is it possible to do a mock counter offer for all IFNs?
  • As an IFN, the issue is that government might use this as a template for all FNs.
  • What flexibility does IFNs have to make necessary changes, as this current model fits the 13 NFs”.
  • Is there flexible timeframe, to set this?
  • Who to follow-up for non-status students to receive funding on reserve, attending reserve schools.

English First People 12 Update:

  • 3 Day Training Session was held in August 2008.
  • 50 English 12 Teachers were trained.
  • 90% were Non- Aboriginal Teachers.
  • Most Post Secondary Schools have approved FP English 12,
  • Currently, starting FP English 10 & 11
  • Question: Is it available on line?
  • Answer:First promoted the program, second step was for program to be implemented, and eventually it can be distance learning.
  • Question: Is there a call for FP 10 & 11 teachers, does it go to the schools? Answer: Goes to BCTF, it can go to FN Schools through Marie Matthew. To include the First Nation schools who have Secondary schools.
  • Background, in 2007, September to December, piloted 40 schools, in English 12 programs.
  • In Public Schools, they are now offering English 12 and FP 12, which is now approved by Ministry of Education.

  • FNESC will have to check to see what FNEA (First Nations Education Authority)provides; the task is to take this now how it works it into their current central services.
  • This service level page identifies why the counteroffer is at 41 million,provides rationale for the 41 million vs. 23 million dollar current offer.
  • Total Requirements page was reviewed.
Concerns by IFNs:
  • Recognition of off-reserve FTEs
  • First Nation Formula
  • New Paths?
  • Connectivity
  • O&MNonINACBuildings, Landscaping, playgrounds,
  • Special Education
  • Counseling Ratio should be lower – and more money
  • Busing- is not enough, right now INAC uses a formula rate, should be higher.
  • Computer Technology – foundation skills are starting to be done, and this should factor in this
  • Resource Workers need honorariums.
  • Presenting to Bands – need to show exactly how it affects each band, and FNESC should communicate to all bands about this
  • Library Technician / is not included, but should be considered in this offer.
  • Some places security is needed for some schools – currently not included in this offer.
  • Language Teachers are currently not included as a line item, should be included as a separate item.
  • School Completion Budget is not included; upgrades and renovations should be included.
  • Band Operated Schools are currently funded,
  • INACs formulas – they need to show the difference why each offer to each community.
  • Request for to show / explain an overall School Startup.
  • All bands to be informed, could submit a BCR,
  • Explanation of different of levels, of Allocation Funding can this be explained by FNESCs, Answer: 34K for NFs, and the other was based on meeting attendance.
  • Base $ = even in declining enrolment.
  • Insurance is currently not included.
  • Curriculum Updates not include.
  • What do Public Schools get for Sports Programs, this should be included.
  • Fuel Escalates each year, how can this counteroffer include increasing costs, over the agreement
  • Is there a Provincial Language comparison, School Districts currently offer different Language Programs in public schools, - request if the counteroffer could look at the comparison of the actual costs that public schools get for language for Course Development.
  • Make sure capital is on summary page of counteroffer.
  • Governance Accountability should be included in this document.

  • FNESC to email or fax a transportation form, for IFNs to complete with their annual transportation costs.

Community Updates
Interested First Nations (IFNs) /
  • Snuneymuxw – Dawn McGuire-Reeves gave headlines from Nanaino newspaper “FN Schools must improve”. The Editorial was positive, spoke about nominal roll. In addition, met with Chief and Council, about Jurisdiction.
  • Lower Similkameen Indian Band – putting in newsletter, putting a package together for community, in summer student worked on policies,
  • Kamloops Indian Band – 4 communities were coordinated and met, in Nesconlith, the communities had different issues, to promote Jurisdiction.
  • Seabird Band – held a deal or no deal, in July, sent out questions 3 weeks prior to this event, for this competition,
  • Fort Nelson – A subcommittee will continue to meet.
  • CanimLake – went over budget to look at the 5 year agreement, next meeting of council will bring up
  • Kathi Dickie provided two Presentations in Okangan.
  • Greg Louie – met with School Lawyer.
  • Tyrone McNeil – Sto’lo Nation put together 2 different districts groups, which will make up an advisory group.

Nancy Morgan - Transfer of Jurisdiction Handbook on Employment Issues September 2008

  • Overview of document, Part One deal with general principles relating to employment issues in the case of a transfer of employment. Part Two is a checklist of information to gather and steps to take in preparing for a transfer. Part Three contains a summary of changes to the law since the December 2006 version of the FNSA handbook.
  • Clarified, that Labour Relations is for Union Issues.
  • Review document was completed by Julie Owen.
