Firearms (Amendment) Regulations 2006

The Governor in Council makes the following Regulations:

1.Objectives

The objectives of these Regulations are to amend the Firearms Regulations 1997 to provide for the fee or fees payable in respect of the issue of—

(a)a paintball marker licence;

(b)an antique handgun collectors licence;

(c)a general category handgun licence for reasons set out in section 15(1)(d) of the Act;

(d)a provisional licence; and

(e)a permit issued under section 57A of the Act.

2.Authorising provision

These Regulations are made under section 191 of the Firearms Act 1996.

3.Commencement

These Regulations come into operation on 1 July 2006.

4.Amendments to Schedule 4

r. 4

In Schedule 4 to the Firearms Regulations 1997[1]—

(a)after the item relating to "Longarm licence for category E longarms"—

(i)in Column 1 insert "Paintball marker licence";

(ii)in Column 2 insert "32 fee units";

(iii)in Column 3 insert "58 fee units";

(b)after the item relating to "Firearms heirlooms licence"—

(i)in Column 1 insert "Antique handgun collectors licence";

(ii)in Column 2 insert "47 fee units";

(iii)in Column 3 insert "93 fee units";

(c)after the item relating to "Junior licence"—

(i)in Column 1 insert "A general category handgun licence for reasons set out in section 15(1)(d) of the Act";

(ii)in Column 2 insert "45 fee units";

(iii)in Column 3 insert "117 fee units";

(d)after the item relating to "Category E handgun licence"—

(i)in Column 1 insert "Provisional licence";

(ii)in Column 2 insert "75 fee units";

(iii)in Column 3 insert "N/A".

5.Amendments to Schedule 5

r. 5

In Schedule 5 to the Firearms Regulations 1997—

(a)after the item relating to "Permits to use firearms held under category 1 firearms collectors licence or general category handguns held under category 2 firearms collectors licence"—

(i)in Column 1 insert "Permits issued under section 57A of the Act";

(ii)in Column 2 insert "58 fee units";

(b)the item relating to "Permit under section58A to carry or use general category handguns during probationary period" is revoked.

Fee Units

These Regulations amend the Firearms Regulations 1997 to provide for fees by reference to fee units established under the Monetary Units Act 2004. The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2006 is $10.75. The amount of the calculated fee may be rounded to the nearest 10cents.

The value of a fee unit for future years is to be fixed by the Treasurer under section 5of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in thepreceding financial year.
