Specimen Duranar Warranty

PPG Industries France (PPG) makes the following warranty to :
The Applicator (Applicator) concerning the use : DURANAR * COA T SYSTEM “Colour” / UCF ****** / Batch Number ****” herein called "Product", when applied over properly chemically treated ALUMINIUM PROFILES or PANELS herein called "Metal", for : “The location of the Project”

PPG warrants that the Product, when applied to the Metal by the customer in

accordance with the attached Product Data Sheets and when properly cured, will not under normal atmospheric conditions (which term includes general smog and air pollution of an entire area, but excludes specific areas of concentrated salt spray and/or chemical fumes, such as would be present in or immediately downwind of a chemical plant or directly adjacent to the sea shore or in a defined "fallout" area):

(1)Peel, check, crack, flake or blister for a period of 10 years from the date the Metal coated with the Product is installed;

(2) Chalk in excess of a numerical rating of 8 -for 10--years when measured

in accordance with the standard procedures specified in ASTM 0659-44

Adopted 1944 "Reapproved in 1965 without change in substance;"

(3) Fade or change in colour in excess of- 5 -units (Hunter Colour Difference) for -10- years if calculated from measurements on any spectrophotometer or

colourmeter designed to adequately measure colour by reflectance readings in accordance with ASTM method of test D2244-68, PPG. 3.8.1.4. Numerical

units are defined as the numerical value equal to the square root of the sum of

the squares Delta L, Delta a and Delta b, measured on the exposed paint

surfaces which have been cleaned of external deposits and chalk and

corresponding values measured on the original or unexposed painted

surfaces. It is understood that fading or colour changes may not be uniform if

the surfaces are not equally exposed to the sun and elements.

THIS WARRANTY IS SUBJECT TO THE FOLLOWING CONDITIONS:

1 The warranty will apply only to the Product colours which PPG specifically and in writing designates to the Customer as being covered by the warranty.

*Cleaning and pretreatment must meet ASTM 01730-67, Type B, Method 5 or

Method 7. Processing shall conform to ASTM 8-499-67, section 5. Conversion coating weight shall be a minimum of 30 mgms. per sq~ ft.

2. The warranty will apply only to the Product the Customer applies with six (6) months from the date PPG ships the Product to the Customer, unless PPG

inspects the Product and agrees in writing to extend the six-month period.

3. The warranty will not apply to any coated surface which is not a properly pretreated aluminium surface of a Building Product.

4. The warranty will not extend to or cover:

(a) Damage to the coating occasioned by moisture or other contamination

detrimental to the coating because of improper storage of the coated Metal

prior to installation; or

(b) Water damage due to condensation caused by improper packaging of the

coated Metal prior to installation; or

5 The warranty will not be applicable to damage or failure which is caused by acts of God, falling objects, external forces, explosions, fire riots, civil commotions, acts of war, radiation, or other such dissimilar occurrences beyond PPG's control.

6, In the event of a claim under the warranty, the Customer shall furnish proof of date of the installation of the Metal coated with the Product and shall demonstrate that the failure of the Product was due to breach of the warranty stated herein.

7. PPG's liability hereunder shall be limited to refinishing the defective coated Metal Or replacing non-conforming Product. Refinishing of the defective coated Metal shall be performed by using standard finishing practices and materials as selected by PPG (not necessarily the Product); PPG reserves the right to approve any contract for refinishing of defective coated Metal. Replacement of Product shall be made F.O.B. PPG's shipping point. The customer acknowledges that PPG's liability shall be as stated herein and that PPG shall have no liability for any incidental, special or consequential damages. The warranty on any refinished coated Metal or replaced Product supplied pursuant to the Paragraph 7 shall extend for the remainder of the warranty period applicable to the Metal originally coated.

8.Claims under the warranty must be made to PPG in writing within sixty (60) days after the customer is informed of the defective coating and PPG must be given a reasonable opportunity to inspect the coated Metal claimed to be defective.

9. The Customer shall send to PPG four to six (4-6) Production samples of coated extrusions, sections or parts prepared from each batch of Product purchased from PPG, each exhibit to be identified by PPG Batch Number and date of coating.

10, This warranty is invalidated unless the coating is washed down annually with a neutral detergent and warm water and followed by rinsing off by clean water, and confirmation that this had been carried out on all coated areas must be notified in writing to PPG Industries France.

11 PPG shall at reasonable times and in such a manner as will not unreasonably interfere with the customer's operations, be permitted to inspect and improve the Production line, the coating equipment, metal treatment, curing conditions and quality control facilities of the Customer.

12 This warranty is extended to the Customer alone as the purchaser of the Product. The warranty is non-transferable, and non-assignable and the Customer shall not permit its agents, representatives, and the Customer shall not permit its agents, representatives, Customers, Distributors, Applicators or contractors to claim, represent or imply that this warranty extends to or is available to any one other than Customer. This condition shall constitute a material term of this warranty and its violation by the Customer or its Agents or Representatives shall release PPG from its obligations hereunder.

13 PPG reserves the right to terminate this warranty at any time upon sixty (60) days advance written notice, except with respect to any Product which has already been shipped to the customer.

14 . EXCEPT AS SET FORTH HEREIN, PPG MAKES NO OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF UNMERCHANTABLE OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE PRODUCT .

15. This warranty will apply only to Metal which is coated with the Product by the customer and used within Europe unless PPG otherwise agrees in writing.

16. All notices given under or pursuant to the Agreement shall be in writing and sent by registered mail, postage prepaid, return receipt requested, to the party to whom such notice is to be given, as follows:

Ail such notices when deposited in France mail as set forth above shall be

considered served when so deposited.

17. No terms or conditions other than those stated herein, and no agreement or understanding, oral or written, in any way purporting to modify this warranty shall be binding on PPG unless made in writing and signed by its authorised

representatives.

18. Where the Product during installation or service is scratch or damaged PPG will not accept any liability whatsoever for any subsequent corrosion of such areas.

19. PPG will not warrant the subsequent post forming of any Duranar sprayed coating system. Should for any reason the fabricator wish to post form, then coated test pieces must be submitted by the PPG approved Duranar applicator, and the forming, testing and subsequent performance of such parts will be held to be the total responsibility of the fabricator/extruder.

20. If the Customer agrees to and accepts this warranty such acceptance shall be indicated by signing and returning a copy of this document to PPG Industries France.
