1. Introduction

This HHW Program shall have an emergency contingency plan located at the Facility designating necessary actions to minimize hazards to human health or the environment from fire, explosion, or unplanned chemical releases. The plan shall be followed whenever an emergency incident occurs.

2. Regulatory and contractual requirements

The local emergency response number is: 911. Guidelines used for this Program’s emergency contingency plan are established in Minn. Rules pt. 7045.0572, the HHW program and state agency contract (Exhibits A and B), and OSHA standards 29 CFR 1910.38 and 1910.120 (a) and (q). 3. Incident procedures

The designated staff responsible for implementing this emergency contingency plan is the Program Manager. This person shall assign this task to another competent staff in their absence. This Program shall make emergency information available to local emergency response teams or contractors, who could be utilized in an emergency situation, including:

  1. a form letter including a brief response explaining what will be expected of the emergency responder; see the Emergency Responder Notification Form in Attachment A of this SOP
  2. copy of the Facility Emergency Contingency Plan and site plan and evacuation maps; see example Attachment B and Figures 1 and 2 of this SOP. Figure 1 shall include a site map with specific waste type storage locations listed, along with emergency evacuation routes. Figure 2 shall include a map indicating the best route to the closest medical facility. The Emergency Contingency Plan shall:

·  provide instruction on emergency procedures relevant to job duties; see SOP 2.3 Employee Right to Know.

·  provide instruction to Program staff on how the plan will be implemented.

·  be easily assessable.

·  be placed in a highly visible location in the Facility.

·  contain pertinent information as outlined in Attachment A of this SOP.

·  be updated annually.

·  be revised if it fails in an emergency event.

·  be updated if changes apply for contact information, rules or requirements and Facility design, construction, operation, or maintenance.

4. Spill response

Control and clean-up of spills shall not be performed by Facility staff if the scope of the incident is beyond their capability. Only OSHA-designated and trained individuals are able to respond to large spills; see SOP 2.6 Spill Response.

Enclosed is the ______County Household Hazardous Waste (HHW) Facility Contingency and Emergency Procedures Plan (Plan). The Minnesota Pollution Control Agency (MPCA) regulations require all HHW Collection Facility operators to make arrangements with nearby police, fire, hospital, and environmental response contractors to provide an expedient and coordinated response to emergencies.

This letter and attached Plan are to clarify these arrangements and familiarize your agency with the Facility. This is to be used in the event of a Facility fire, an unplanned release of hazardous waste, or a medical emergency. The Plan describes the services your agency would provide and it designates all other authorities and actions. The Plan also details types, maximum quantities and storage locations for hazardous materials or wastes (e.g., floor and plot plans, escape routes).

The Plan will be reviewed annually and be revised if changes are needed. This Facility will forward revised copies to you when these changes occur. This Program appreciates your assistance and looks forward to any recommendations or suggestions to ensure a comprehensive and complete Plan.

4. Emergency response procedures
The designated Facility staff person responsible for implementing this plan:
1.  is authorized and trained to accurately assess emergency incidents
2.  shall provide timely and effective response
3.  shall evaluate the emergency and decide if potential danger merits immediate evacuation of storage facility
4.  shall first attempt to bring the situation under control if the emergency appears to pose no immediate threat
5.  shall contact the appropriate emergency response agency if the incident poses a significant threat to persons and/or property
Spills/releases
Each unplanned spill or release of a chemical substance is unique in character and circumstance. Management of a spill or release shall take into account the amount and risk posed by each incident. A sizeable spill of a low risk material may be easily managed by the designated Facility staff person responsible for implementing this plan. However, a small spill of a high risk material potentially requires the assistance of an appropriate emergency response agency. These decisions are made only by trained and experienced staff; See SOP 2.6 Spill Response.
Minor spills. In the event of a minor spill or release of a chemical substance, staff shall contain the material using the appropriate personal protective equipment (PPE) and containment equipment. Evacuate the area if necessary. Collected wastes and contaminated PPE shall be properly packaged for disposal. Spill area and tools shall be decontaminated.
Large spills. If the spill or release is to the environment, notify the Minnesota Duty Officer and report the nature of the spill and other chemical substances stored at the Facility. If needed, contact the State HW disposal contractor for post emergency clean-up. Contaminated materials shall be properly packaged for disposal. Spill area and tools shall be decontaminated.
Fire
The designated Facility staff person responsible for implementing this plan shall immediately contact the local fire department. Any spills or releases incidental to the fire or response shall be properly managed.
Explosion
The designated Facility staff person responsible for implementing this plan shall immediately contact the local fire department. Any spills or releases incidental to the explosion or its response shall be properly managed.
5. Arrangements with local emergency responders
Arrangements with the following agencies shall be made prior to an event in which they may be called upon for emergency assistance.
Sheriff/Police
The ______County Sheriff or Police Department may:

·  Assess the potential hazard a material that may be explosive or shock sensitive

·  Assess chemical hazards due to accidents or emergencies such as spills, fires, or explosions
·  Respond to incidents for contamination and control of hazardous materials
6. Measures to prevent the escape of hazardous chemicals into the environment
Emergency response equipment
Emergency response equipment is listed in section 7 of this plan. Equipment is regularly checked to ensure it is available and maintained according to manufacture’s specifications.
Hazardous waste storage containers
All waste collected is sorted into hazard classes and stored in the appropriate UN specification packages. Each package is labeled with a clear description of its contents.
Weekly inspections of stored hazardous waste
A weekly inspection of hazardous waste stored is documented on the facility’s weekly inspection log; see SOP 4.11 Waste Storage. Storage areas and packages shall be inspected weekly for the following:
· 
·  Packages closed and properly labeled with visible and complete labels;
·  Evidence of leaks or spills;
·  Cracks in floor/storage surface;
·  Aisle space is adequate; and
·  Outside storage areas are shaded & secure.
Hazardous waste staff training
All staff processing hazardous wastes shall be trained anually as applicable to specific job duties. Staff training is documented and may include:

8. Evacuation plan
When evacuating the Facility, the dedicated staff responsible for implementing this emergency contingency plan shall direct all persons out of the affected building and immediately contact the appropriate response agency (see Figure 1 of this plan). If unable to fulfill this responsibility, the dedicated staff responsible for implementing this emergency contingency plan shall assign this task to competent staff. This person shall remain onsite until the emergency has been brought under control.
