F I N A L O R D E R

In accordance with the provisions of Section 332(h) of the Public Utility Code, 66Pa. C.S.§332(h), the decision of Administrative Law Judge Michael A. Nemec dated August 10, 2006, has become final without further Commission action;

THEREFORE,

IT IS ORDERED:

  1. That the complaints of the Pennsylvania Public Utility Commission and its Bureau of Transportation and Safety against Donald A. Fix, Jr., t/a Hindman Moving & Storage, docketed at A-00112441C0402, A-00112441C0507, and A-00112441C0602 are sustained to the extent of the approval and adoption of the settlement agreement presented by the parties.
  1. That the request of the Bureau of Transportation and Safety is granted and the complaint of the Pennsylvania Public Utility Commission and its Bureau of Transportation and Safety against Donald A. Fix, Jr., t/a Hindman Moving & Storage, docketed at A00112441C0601 is withdrawn.
  1. That Donald A. Fix, Jr., t/a Hindman Moving & Storage, shall pay a civil penalty of nine thousand, five hundred dollars ($9,500.00) by sending a certified check or money order payable to the Pennsylvania Public Utility Commission, within twenty (20) days after service of the Commission Order, to:

  1. That Donald A. Fix, Jr., t/a Hindman Moving & Storage, shall make all refunds indicated in the complaints hereby sustained and shall notify the Bureau of Transportation and Safety in writing identifying the amounts refunded and the persons to whom refunds were made within twenty (20) days after service of the Commission Order.
  1. That Donald A. Fix, Jr., t/a Hindman Moving & Storage, cease and desist from further violations of the Public Utility Code and the Commission’s regulations.
  1. That the dockets for the four complaint proceedings at A-00112441C0402, A-00112441C0507, A-00112441C0601 and A-00112441C0602 shall be marked closed.
