Theactivities,controlsandassessmentcriteriaintheunderlyingGeneralCoastalMarineandCityCentrezonesandAuckland­widerulesapplyinthefollowingprecinct,unlessotherwisespecified.

3.Developmentcontrols

ThedevelopmentcontrolsintheCityCentreandGeneralCoastalMarinezoneapplyintheCentralWharvesprecinctunlessotherwisespecifiedbelow.

3.1 Building height

Purpose:managetheheightofbuildingstoachievepolicy5oftheCentralWharvesprecinct.

1.Buildingsmustnotexceedtheheightsspecifiedonprecinctplan2.

3.2Siteintensity

Purpose:managethescale,formandintensityofdevelopmenttomaintainthecharacterofthePrincesWharfprecinct.

1.ThegrossfloorareaofallbuildingsonPrincesWharfmustnotexceed100,000m2.

3.3Publicspacesandaccessways

Purpose:managepublicspacesandaccesswaystoachievepolicy8oftheCentralWharvesprecinctand

policy25oftheCityCentrezone.

1.PublicaccesswaysmustbeprovidedatgroundlevelaroundtheperimeterofPrincesWharfandQueensWharf.Thepublicaccesswaysmusthaveminimumdimensionsasfollows:

a.PrincesWharf:6m

b.QueensWharf:10m

2.AllpublicaccesswayswithinandaroundPrincesWharfandQueensWharfmustbeavailabletothepublicatalltimesexceptwhenwrittenapprovalhasbeenobtainedfromthecounciltotemporarilyrestrictaccessforsecurity,safetyoroperationalneedsassociatedwithportactivitiesoreventsorwhereaccessisrestrictedforoperationalorsafetyreasonsspecifiedintheconservationcovenantsapplyingtothearea.

3.Buildingsorstructuresmustnotlocatewithintheaccessways.Thiscontroldoesnotapplytoverandahsorlawfultemporarybuildingsorstructures.

4.OnPrincesWharf:

a.Aminimumof35percentoftheoverallwharfdeckareamustbemaintainedasexternalpublicspace.Aminimumof30percentofthisspacemustbelocatedatthenorthernendofthewharf.Foralengthof64m,externalsteps,rampsorlandingsmustbeprovidedtoenableaccessfromwithinthedevelopmentdowntothepublicareasatwharfdecklevel.

b.Aminimumof15percentofthetotalgrossfloorareaofthewharfdecklevelandthefirstupperlevelofallbuildingsmustbeintheformofinternalpublicspacesandaccesswaysandmustinclude:

i.internalpedestrianaccesstothenorthernendofthefirstupperlevelofanydevelopment,

leadingtothestairsorrampsrequiredtoprovideaccessdowntothewharfdeck

ii.

aninternalpublicspaceofatleast500m2onthefirstupperlevelofanydevelopment,commencingwithin80mofthenorthernexteriorwall,anddesignedtoenablemaximumviewsoftheCMA.

3.4Viewshafts

Purpose:managedevelopmenttomaintainsignificantpublicviewsfromthecitytotheharbourandadjacentlandscapefeatures.

1.Buildingsorstructuresmustnotlocatewithinthoseareasoflandidentifiedaslandwardviewshaftsonprecinctplan2.Thiscontroldoesnotapplytoverandahsorlawfultemporarybuildingsorstructures.

2.BuildingsandstructuresmustnotlocatewithinoroverthosepartsofwharvesandwaterspaceidentifiedasCMAviewshaftsonprecinctplan2.Thiscontroldoesnotapplytolawfultemporarybuildingsorstructures.

3.Developmentthatdoesnotcomplywithclauses1­2aboveisanon­complyingactivity.

4.Assessment­Restricteddiscretionaryactivities

4.1Mattersofdiscretion

ForactivitiesanddevelopmentthatisarestricteddiscretionaryactivityintheCentralWharvesprecinct,thecouncilwillrestrictitsdiscretiontothefollowingmatters,inadditiontothemattersspecifiedfortherelevantrestricteddiscretionaryactivitiesintheCityCentrezoneandGeneralCoastalMarinezonewheretheactivityisintheCMA.

4.2Assessmentcriteria

ForactivitiesanddevelopmentthatisarestricteddiscretionaryactivityintheCentralWharvesprecinct,thefollowingassessmentcriteriaapplyinadditiontothecriteriaspecifiedfortherelevantrestricteddiscretionaryactivitiesintheCityCentrezoneandtheGeneralCoastalMarinezonewheretheactivityisintheCMA.

1.Declamation

a.Theadverseeffectsofdeclamationmustbeavoided,remediedormitigatedinrespectoftheeffectsofthefinalland/waterconfigurationon:

themarineenvironment(includingcoastalprocesses,waterquality,sedimentqualityandecology)oftheCMA

hydrogeology(groundwater)andhydrology

sedimentaccumulationandtheneedforongoingmaintenancedredgingoftheCMA.

b.Declamationworks,includingtheconstructionofseawalls,shouldavoid,remedyormitigatetheadverseeffectsofconstruction,particularlythroughthemanagementofsilt,contaminatedsoilsandgroundwater,andothercontaminants

c.Declamationshouldbelocatedanddesignedsothattheadjacentlandareacanprovideadequatepublicopenspaceadjacentto,andpublicaccessaroundalongthewatersedgewhetheronlandorontheadjacentwaterspace.

2.Maintenancedredgingandcapitalworksdredging

a.Theassessmentcriteriainclauses5.2.1and5.2.11oftheGeneralCoastalMarinezonerulesapplyinadditiontothecriteriabelow.

b.ThedredgingshouldbenecessarytoachievetheoutcomessoughtbytheobjectivesandpoliciesfortheCentralWharvesprecinct.

5.2Assessmentcriteria

Inadditiontothegeneralassessmentcriteriainclause2.3ofthegeneralprovisionsrules,thecouncilwillconsidertherelevantassessmentcriteriabelowfortherelevantdevelopmentcontrolinfringement.

1.Buildingheight

a.Buildingheightmaybeexceededwhereitwouldprovideanattractiveandintegratedroofformthatalsomeetsthepurposeofthecontrol.

b.Wherebuildingheightisexceeded,policy5oftheCentralWharvesprecinctandpolicy17oftheCityCentrezoneshouldbeconsidered.

2.Siteintensity

a.Developmentshouldbeofascaleandformappropriatetothesetting.

b.ThescaleandformofthedevelopmentshouldbeconsistentwiththecurrentandfuturecharacteroftheCentralWharvesasestablishedthroughtheobjectivesandpoliciesfortheCentralWharvesprecinct.

c.Adverseeffectsonthetransportationnetworkshouldbeavoided,minimisedormitigated.

d.Developmentshouldnotcompromisemarineandportactivities,includingmaritimepassengeroperations.

3.Publicspacesandaccessways

a.Publicaccesstothewater’sedgeshouldbeprovided.

b.Operationofmarineandportactivitiesshouldbeenabled.
