In terms of regulation 3(b) of Regulation 1352 dated 12 November 1999 a person who uses water as contemplated in section 21

of the National Water Act, 1998 (Act No. 36 of 1998) must, when called upon by the responsible authority to do so, register the

water use.

I, Johannes Malherbe van Aswegen in my capacity as Regional Director: Mpumalanga duly delegated by the Minister of Water

Affairs and Forestry hereby request that all persons who use water as set out below must register their water use.

1) Water Use

The following water uses in terms of section 21 of the National Water Act, 1998 must be registered--

a) taking water from a water resource

b) storing water

c) impeding or diverting the flow of water in a watercourse

d) engaging in a stream flow reduction activity

e) engaging in a controlled activity: irrigating with waste or water containing waste generated through any industrial

activity or by a waterwork

f) discharging waste or water containing waste into a water resource through a pipe, canal, sewer, sea outfall or

other conduit

g) disposing of waste in a manner which may detrimentally impact on a water resource

h) disposing in any manner of water which contains waste from, or which has been heated in, any industrial or

power generation process

i) altering the bed, banks, course or characteristics of a watercourse

j) removing, discharging or disposing of water found underground if it is necessary for the efficient continuation of

an activity or for safety of people

k) using water for recreational purposes.

2) The Extent of the Water Use to be Registered is

(Any volumes or abstraction rates are the aggregate of all volumes or rates on a separately registered property or parcel

of land)

a) The taking of more than 20 cubic metres from surface water or 10 cubic metre from groundwater an any given

day.

b) The taking of groundwater within 50 metres from the edge of a watercourse.

c) All dams on any separately registered property or parcel of land in the

i) Crocodile River catchment upstream of Kwena Dam

ii) Elands River catchment upstream of Waterval-Onder

iii) Komati River catchment upstream of Swaziland.

d) Storing of more than 10 000 cubic metres of water on any separately registered property or parcel of land in the

remaining catchments of the Nkomati Water Management Area.

e) Stream flow reduction activities (afforestation): All species of wattle, blue-gum, poplar, pine or any other exotic

tree species planted in commercial plantations (including woodlots).

3) Exclusions

The following water use(s) are excluded from registering in terms of this Notice--

a) Schedule 1 uses in terms of the National Water Act

b) Scheduled water use by members of an Irrigation Board or Water User Association in a distribution system

where they are supplied by the Board or Association (The Board or Association will be registered as a bulk

supplier. Other water uses must be registered separately).

c) The taking of water from a bulk supplier or a communal domestic water supply scheme, where the bulk use will

be registered as a whole.

4) Area of applicability

This Notice is applicable to all water uses set out in paragraph one above that takes place in the Nkomati Water

Management Area, which includes the catchments of the following rivers:

a) Crocodile River

b) Komati River

c) Sabie River and

d) Sand River.

5) Registration Forms

1) Only official registration forms may be used. Registration forms are obtainable on written request from:

4) Registration Forms

The Regional office of the Department of Water Affairs and Forestry in Pietersburg is going to co-ordinate the registration

of water uses on a drainage region basis. Before registration takes place in a drainage region, the Department will inform

water users by means of the media, posters, etc of the date of water use registration for that drainage region and also of

the address where officials of the department will assist water users with the registration process. Registration forms will

be available at the address mentioned or on written request from:

register their water use.

1) Water Use

The following water uses in terms of section 21 of the National Water Act, 1998 must be registered--

a) taking water from a water resource

b) storing water

c) impeding or diverting the flow of water in a water course

d) engaging in a stream flow reduction activity (afforestation only at this stage)

e) engaging in a controlled activity: irrigating with waste or water containing waste generated through any industrial

3) Extent of Water Use to be Registered within the Usuthu to Mhlathuze Water Management Area

3.1 Within the Mhlathuze and Mkuze catchments, as well as the catchment above the Klipfontein Dam

The extent of the water use to be registered is:-

§ The taking of more than 25 cubic metres from surface water or 10 cubic metres from groundwater on any

given day for any purpose.

§ Storing of more than 10 000 cubic metres of water on any separately registered property or parcel of land.

§ The taking of groundwater at a rate that exceeds 2,5 litres per second.

3.2 Areas other than the Mhlathuze, Mkuze and Klipfontein Dam catchments:

The extent of the water use to be registered is:-

§ As in paragraph 3.1 above, except that the taking of 25 cubic metres from surface water on any given day,

for any purpose, be replaced with 50 cubic metres per day.

4) Exclusions

The following individual water users need not register in terms of this Notice-

§ Schedule 1 uses in terms of the National Water Act (essentially domestic use)

§ the taking of water from a bulk supplier or a communal scheme, where the bulk use will be registered as a

whole. (The bulk supplier i.e. Mhlathuze Water or the Local Authority will register).

The following water uses in terms of section 21 of the National Water Act, 1998 must be registered--

a) taking water from a water resource

b) storing water

c) impeding or diverting the flow of water in a watercourse

d) engaging in a stream flow reduction activity (afforestation only at this stage)

The extent of the water use to be registered is:

§ The taking of more than 50 cubic metres from surface water or 10 cubic metres from groundwater on any given

day for any purpose.

§ Storing of more than 5 000 cubic metres of water on any separately registered property or parcel of land.

2) Exclusions

The following water uses are excluded from registering in terms of this Notice--

§ Schedule 1 uses in terms of the National Water Act, which includes:

a) the taking of water for reasonable domestic use in a person's household, directly from any water resource

to which that person has lawful access;

b) the taking of water for use on land owned or occupied by that person, for-

i) reasonable domestic use;

ii) small gardening not for commercial purposes; and

iii) the watering of animals (excluding feedlots) which graze on that land within the grazing capacity of

that land, from any water resource which is situated on or forms a boundary of that land, if the use is

not excessive in relation to the capacity of the water resource and the needs of other users;

c) store and use run-off water from a roof.

§ Scheduled water use by members of an Irrigation Board or Water User Association in a distribution system

where they are supplied by the Board or Association.

§ The taking of water from a bulk supplier or a communal scheme.

3) Area of applicability

This Notice is applicable to all water use set out in paragraph one above that takes place in the catchment areas of the

given day.

The following water uses are excluded from registering in terms of this Notice--

§ Schedule 1 uses in terms of the National Water Act.

§ Scheduled water use by members of an Irrigation Board or Water User Association in a distribution system

where they are supplied by the Board or Association (the Irrigation Board or Water User Association will be

registered as a bulk supplier, but other water use must be separately registered).

§ The taking of water from a bulk supplier or a communal domestic water supply scheme, where the bulk use will

be registered as a whole. (The bulk supplier will register).
