Public Hearing for Consideration by the State Program Representative, of Application for a Student Loan Bond Program for Qualified Student Loan Bonds by the Midwestern University Foundation.

The loans in the program will be made under a State supplemental loan program and will provide funds only for residents of the State of Arizona attending Midwestern University at either its Glendale, Arizona campus or its Downers Grove, Illinois campus, and for residents of any state attending Midwestern University at its Glendale, Arizona campus.

Under A.R.S. §38-431.03(A)(3), the State Program Representative may vote to go into executive session, which will not be open to the public, for the purpose of obtaining legal advice on any item on the agenda.

A.  Call to Order

B.  Review of the Application – Adequacy Opinion to State Program Representative

o  Pursuant to A.R.S. § 35-773 for approval of the Application the State Program Representative shall conclude:

1. The origination or acquisition of student loans by the corporation or its agent or agents, a qualified educational institution or an eligible lender to eligible students or their parents will assist the students in attending an educational institution and financing the student's education.

2. Adequate provision has been or will be made for the payment of the principal of or interest on any bonds issued by the corporation to finance the loan program.

3. Adequate provision has been made for the payment of the reasonable expenses of the administration of the loan program.

4. The proposed procedures for application of the bond proceeds, the collection of payments, interest charges and any other matters concerning the administration of the loan program are in conformance with the law.

o  If Approved, the Approval is conditioned upon the confirmation of methodology and submission of documents required prior to closing by the Application review Guidelines.
