Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002
1Objective
The objective of these Regulations is to prescribe safety standards for bunk beds.
2Authorising provisions
These Regulations are made under sections 34 and 165 of the Fair TradingAct 1999.
3Commencement
These Regulations come into operation on 1November 2002.

4Prescribed safety standard in respect of bunk beds
(1)In these Regulations—
bunk bed means—
(a)a set of components that is assembled or is ready for assembly into single beds or double/single combination beds which can be stacked one over the other; or
(b)any single bed, other than a hospital bed, where the upper surface of the mattress base is at least 800mm above the floor surface;
AS/NZS 4220:1994 means Australian/New Zealand Standard AS/NZS 4220:1994, Bunk Beds as approved by Standards Australia and varied by these Regulations.
Reg. 4(2) substituted by S.R. No. 89/2003 reg.3.
(2)For the purposes of section 33(1) of the Fair Trading Act 1999, AS/NZS 4220:1994 is the prescribed safety standard for bunk beds supplied as an item of furniture or part of an item of furniture, other than—
(a)portable bunk beds designed for camping; and

(b)bunk beds that are built-in fitments in caravans, camper trailers, tent trailers, camper vans, motor homes, trains, ships, aircraft and other types of conveyances.
(3)The following variations are made to the AS/NZS4220:1994—
(a)Omit the following clauses—1, 2, 4, 5, 6.1, 6.2, 6.5, 6.6, 6.7, 6.9, 7.1(c), 7.2, 7.3, 7.4, 7.5, 7.6, 7.7, 7.8, 7.9, 7.10, 8, 9(b)(i) and 9(d), and appendices A3(b), B, C, D, E, F, G, H, I and J;
(b)For subclause 3.1 substitute—
"3.1 Bunk bed—
(a)A set of components that is assembled or is ready for assembly into single beds or double/single combination beds which can be stacked one over the other; or
(b)Any single bed, other than a hospital bed, where the upper surface of the mattress base is at least 800mm above the floor surface.";
(c)In subclause 7.1(b) for "75mm" substitute "95mm";
(d)In subclause 9(c) for "A distinct" substitute "For the upper bed, where the height of the guard rail is less than 360mm above the mattress base, a distinct";
(e)In Appendix A—
Reg. 4(3)(e)(a) re-numbered as reg.4(3)(e)(i) by S.R. No. 89/2003 reg.4(2)(a).
(i)in Part A3(a)(iv), for "75±05mm" substitute "95±05mm"; and
Reg. 4(3)(e)(b) re-numbered as reg.4(3)(e)(ii) by S.R. No. 89/2003 reg.4(2)(b).
(ii)in Parts A5(e) and A6(c) for "75mm" substitute "95mm";
r. 4
(f)In Appendix A, Part A5(a), omit "Place a mattress on each of the mattress bases of the bunk bed.".

1.General Information
The Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002, S.R.No.98/2002 were made on 22 October 2002 by the Governor in Council under sections 34 and 165 of the Fair Trading Act 1999, No.16/1999 and came into operation on 1 November 2002.
The Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002 will sunset 10 years after the day of making on 22 October 2012 (see section 5 of the Subordinate Legislation Act 1994).
2.Table of Amendments
This Version incorporates amendments made to the Fair Trading (Safety Standard) (Bunk Beds) Regulations 2002 by statutory rules, subordinate instruments and Acts.
