Confidentiality Agreement for Pre-Service Teachers

One of the most important aspects of ethical behavior for pre-service teachers is the handling and disclosure of confidential information about students and their families. During the normal course of daily activities, the pre-service teacher comes in contact with a wide array of information about students. Information may include test scores, behavior, attendance, family problems and many other kinds of personal information. School personnel, including pre-service teachers, are required by law to keep this information confidential. Confidentiality is an important ethical and legal issue in providing services to students. Both state and federal laws regulate access to information about students with disabilities. The Family Educational Rights and Privacy Act (FERPA) of 1974 and the Individuals with Disabilities Education Act (IDEA) of 1997 both address issues regarding the privacy of students and their parents. Confidentiality issues directly affect pre-service teachers who have access to records and information as part of their placement experience. Information about a student is confidential and should only be shared with teachers and staff who directly work with the student. It is the professional responsibility of the pre-service teacher to fully respect the students’ right to privacy. Each pre-service teacher is individually responsible for complying with FERPA, and violations of the Act will subject the pre-service teacher to a failing grade for the placement experience, as well as possible legal ramifications with students, parents and the school district.

By signing this document, I accept the responsibility for protecting the confidentiality of student information and will engage in professional behavior of the highest order. I agree that I will respect the confidential nature of student information and that I may only give parent or student information to authorized personnel or agencies directly concerned with the student’s welfare.

I also understand that it is unethical to discuss information about my placement experience related to school personnel. I will not engage in disclosing confidential information regarding school personnel.

The Department of Education faculty have informed me of confidentiality issues and I understand that I am individually responsible for complying with the law. I will not hold MWSU or any faculty responsible for my actions regarding confidentiality issues during my placement experience.
