ADDITIONAL CONDITIONS APPLICABLE TO ORDERS WHICH

RELATE TO WORK TO PREMISES

Employer
The Employer is the Northamptonshire County Council
Premises In Occupation
Staff at the premises concerned must be advised in advance of when it is proposed the work will be executed. If it is intended to carry out the work during the school holidays, the headteacher must be informed before the end of the preceding term and arrangements made for access.
Work shall be carried out with a minimum of inconvenience to the users and occupiers of the building. No guarantees can be given that any particular part of the premises will be available at any given time.
Materials and Workmanship
Where and to the extent that materials, products and workmanship are not fully specified they shall be suitable for the purpose of the Works and in accordance with good building practice including the relevant provisions of current BSI documents.
Statutory Obligations
The Contractor shall comply with all notices, statutes and byelaws applicable to the Works and shall pay all fees and charges.
Health and Safety
The Contractor shall comply with all relevant health and safety legislation, regulations, approved codes of practice and guidance.
Prior to commencing work on the site the Contractor shall meet with the headteacher/premises manager in order to discuss and agree the order in which the Works will be executed. They shall jointly assess and agree any risks associated with the Works, the safety measures to be adopted and the procedures for their adequate control including any necessary supervision and inspection. Examples of the types of risks to be assessed are as follows:
a) Restricted access to or caused by the Works.
b) The effect of the Works on means of escape.
c) Risks from wind-blown material.
d) Work at high level, particularly above access routes.
e) Any other similar risk arising from the specific work being executed.
The Contractor shall take to the above meeting an up-to-date written assessment of the major risks / associated with his type of work and the measures which will be adopted to control these adequately. The Contractor shall ensure that any sub-contractor employed on the Works complies with the above health and safety requirements in so far as they apply to the work to be executed by him.
Safeguarding the Works
The Contractor shall safeguard the Works, materials and plant against damage or theft including all necessary watching and lighting for the security of the Works and protection of the public.
Injury or Death of Persons and damage to Property
The Contractor shall be liable for and shall indemnify the Employer against any expense, liability, loss, claim or proceedings whatsoever arising under any statute or at common law in respect of personal injury to or death of any person

Without prejudice to his liability to indemnify the Employer, the Contractor shall maintain and shall cause any sub-contractor to maintain insurances to an amount not less than £5 million for any one occurrence or series of occurrences arising out of one event to cover the liability of the Contractor or, as the case may be, of such sub-contractor under these clauses.
Accounts
The number of this order must be stated on all invoices and other related correspondence. Accounts where exceeding £1000.00 are to show in detail number of hours worked, workmen’s rates per hour and materials and plant separately priced with any supporting invoices.
Other Contract Conditions
Where amplified contract conditions are agreed between the parties they shall prevail over the above terms. If this order is for the supply only or the supply and delivery only of goods, Northamptonshire County Council’s Standard Conditions of Contract shall apply as if repeated herein at length.
