The proposal would therefore be contrary to Policy 69 (General Design and Layout) (i) and Policy 70 (Design and Layout of New Housing) preamble and (i) of the St Albans District Local Plan Review 1994 and the aims of the National Planning Policy Framework.

The proposed new dwelling is out of scale and character with its surroundings in terms of size, scale, bulk and massing on the plot. Concern is expressed over the loss of existing landscaping with no detailed plans on what replacement landscaping is proposed to screen the dwelling and there is insufficient amenity space around the building for the size of the dwelling. Policies 69 (i), 70 (preamble), (i), (v), (ix), 74 (i) and (ii) of the District Plan refers. SADC: Refuse. 1. The proposal would represent a cramped and unacceptable form of backland development, providing an unacceptable relationship with the existing built form and pattern of development and fails to relate in scale, form or materials to the surrounding Conservation Area to the detriment of its character and appearance. The proposal would therefore be contrary to the provisions of Policies 69, 70 and 85 of the St. Albans City and District Local Plan Review 1994. 2. By reason of its proximity to trees within the application site, the proposed dwelling would be likely to have an adverse impact on these trees and may result in future requests for tree work due to their proximity to the new dwelling. The proposal would therefore be likely to result in an adverse impact on the existing trees to the detriment of local amenity and detrimental to the character and appearance of the Harpenden Conservation Area. The proposal is therefore contrary to the aims of Policies 70 (v) (Design and Layout of New Housing, 74 (Landscaping and Tree Preservation Orders) and 85 (Development in Conservation Areas) of the St Albans City and District Local Plan Review 1994. APPEAL: Dismissed.
