LV-4rTHREE-DAY NOTICE OF SUBSTANTIAL VIOLATION OF RENTAL AGREEMENT (USDA-RD Properties Only)
This form is used to terminate the Rental Agreement for any "substantial violation" other than non-payment of rent. This notice is based upon SUBSTANTIAL VIOLATION of the Rental Agreement. A ”substantial violation” would be a drug-related offense, use of a deadly weapon, a violent felony or criminal property damage. For more guidance and information, call your Property Supervisor.
The form specifies the exact day the Rental Agreement terminates (normally on the 4th day after delivery). If the Supervisor wishes to give the resident more time, the termination date may be up to 30 days after the delivery date of the notice.
THE RESIDENT DOES NOT HAVE A CHANCE TO CORRECT THE VIOLATION, this notice is FINAL.
VERY IMPORTANT: Since lease violation evictions can become very complicated, this form MUST be completed according to instructions from the Property Supervisor. When a Manager feels a notice is appropriate, the matter shall be discussed with the Supervisor and then completed according to his/her instructions. If advice from our attorney is needed, the Supervisor shall contact the attorney and report back to the Manager. All notices will be prepared by the Manager and faxed to the Supervisor prior to being delivered to the resident.
This notice will be delivered and distributed according to the instructions on the form. Managers should be careful to perform appropriate follow up action according to the time frame given on the notice.
In the event that an eviction is necessary, copies of ALL appropriate notices and backup pertaining to the eviction shall be copied and delivered to the Supervisor. The Supervisor shall review the material; then, confer with and deliver the appropriate information to the attorney for eviction processing. This procedure is required for all "substantial violation" evictions. Please reference the "Instructions to file for Writ of Restitution" and proceed as directed.
