Policy Statement

Subject:Rental of Homes:

Effective Date:December 1, 2012

The following shall be the policy of the Eagle Preserve Community Association (EPCA) with respect to Rental of any home or parcel of land (Facilities).

The objectives of the Policy are:

  1. To ensure that use of the above mentioned “Facilities” is in the best interest of EPCA
  2. To prevent possible erosion of property values as a result of rentals.
  3. To protect the aesthetic value of the community.

This policy is issued by the board in compliance with a motion made and approved as amended at the Annual meeting February 6, 2010, by the members present constituting a Quorum.

  • A MOTION was made by John Stanwix and seconded by Mark Siewert to put into place a one month minimum rental for all homes in Eagle Preserve. The Motion passed unanimously. The Board is empowered by the bylaws to make policy in accordance with the Covenants. The MOTION was amended by Tom Barrett and seconded by Mark Siewert to add that only one rental will be allowed each year for a minimum of one month for all homes in Eagle Preserve. The Motion amendment passed unanimously. The MOTION was again amended by Tom Barrett and seconded by Mark Siewert to add that only one single family rental will be allowed each year for a minimum of one month for all homes in Eagle Preserve.

The Motion amendment passed with 39 in agreement and 2 opposed.

Rental Limitations:

  1. Any rental of homes in Eagle preserve shall be limited to rentals to a single family.
  2. The minimum rental period shall be one calendar month.
  3. Only one rental per calendar year will be allowed for any residence rented.
  4. Each owner renting properties will ensure that his renters are compliant with the policies and Covenants of EPCA. The owner will be responsible to provide copies of the Covenants and Policies of EPCA as part of his rental agreements and to ensure that his tenants comply.

This Policy will be posted on the Website and Realtors requesting information or arranging rentals for residents in Eagle Preserve will be made aware of this policy. Each owner utilizing Realtors or other Agents will ensure that the Realtor or Agent will provide copies of the EPCA Covenants and Policies to prospective renters.
