A RESOLUTION urging the Interim Joint Committee on Labor and Industry to establish a subcommittee to study the feasibility and implementation of a contractor certification program.
WHEREAS, the construction industry by nature poses dangers and risk to persons employed in the industry, and certain dangers and risks are created or compounded by reported failure of some general and independent contractors to fully comply with the laws of the Commonwealth governing unemployment insurance contributions, income tax withholding, and workers' compensation insurance; and
WHEREAS, failure to file and pay the proper amount of income tax or report all wages paid could result in a significant tax loss for the Commonwealth; and
WHEREAS, the House of Representatives recognizes the importance of determining the feasibility of establishing a contractor certification program to require all general and independent contractors doing business in the Commonwealth to register with Kentucky to ensure compliance with the laws of the state governing unemployment insurance, income tax withholding, and workers' compensation;
NOW, THEREFORE,
Be it resolved by the House of Representatives of the General Assembly of the Commonwealth of Kentucky:

Section 1. The Legislative Research Commission is urged to request the Interim Joint Committee on Labor and Industry to establish a subcommittee to undertake during the 1998-2000 interim a study of the feasibility and implementation of a contractor certification program for the Commonwealth.
Section 2. The findings and recommendations of the subcommittee shall be presented to the Legislative Research Commission and the Interim Joint Committee on Labor and Industry no later than October 1, 1999. The findings and recommendations may include proposed legislation relating to contractor certification for consideration by the General Assembly in the 2000 Regular Session.
Section 3. The Clerk of the House of Representative is directed to transmit a copy of this resolution to the members of the Legislative Research Commission and the Co-Chairs of the Interim Joint Committee on Labor and Industry.
