NOTES TO ACCOMPANY THE REPRESENTATION FORM

Introduction

The Chalfont St Giles Neighbourhood Plan has been produced by Chalfont St Giles Parish Council. The plan was formally submitted to the District Council on the 6th November 2017 and the Council has undertaken the necessary checks to confirm the Plan is valid. Chiltern District Council is now publishing the plan and inviting representations from people who reside in the neighbourhood plan area or who may have an interest in the area concerned.The Plan is published in order for representations to be made during the consultation period. Duly maderepresentations will be considered alongside the published documents, which will be examined by an independent Examiner. The Town and Country Planning Act 1990 (as amended) (TCP) states that the purpose of the examination is to consider whether the plan meets the basic conditions these are set out below.

Basic Conditions

The Examiner will first check that the Chalfont St Giles Neighbourhood Planand associated documents meet the basic conditions

  • The Neighbourhood Plan should have regard to national policies and advice contained in guidance issued by the Secretary of State.
  • The Neighbourhood Plan should contribute to the achievement of sustainable development.
  • The Neighbourhood Plan should be in general conformity with the strategic polices in the development plan for the area. In this case the relevant document is the Core Strategy for Chiltern District Adopted November 2011.
  • The Neighbourhood Planshould be compatible with European Union obligations.
  • The Neighbourhood Planshould have been produced in accordance with the law and the relevant regulations. In this case the regulations are The Neighbourhood Planning(General) Regulations 2012 as amended. The most relevant document relating to the Law is the Localism Act 2011 which made amendments to the relevant planning acts.

Lack of Policy

If you think the content of the Neighbourhood Plan is not adequate because it does not include a policy where it should do, you should go through the following steps before making comments:

  • Is the issue with which you are concerned already covered specifically by national planning policy? If so it does not need to be included.
  • Is what you are concerned with covered by any policies in the Development Plan?E.g. the Core Strategy for Chiltern District Adopted November 2011.Please note that the Neighbourhood Plan cannot deal with planning matters which are classed as county matters. These are minerals and waste related operations. There is no need for repetition between documents in the Development Plan.
  • If the policy is not covered elsewhere, what should the policy in the Neighbourhood Plan say?

General Comments

If you wish to make a comment seeking a change to the Neighbourhood Planyou should try to support your comment by evidence showing why the Neighbourhood Plan should be changed. It will be helpful if you also say precisely how you think the Neighbourhood Plan should be changed. Comments should cover succinctly all the information, evidence and supporting information necessary to support/justify your comment and the suggested change, as there will not normally be a subsequent opportunity to make further submissions. After this stage, further submissions will be only at the request of the Examiner, based on the matters and issues he/she identifies for examination.

Group responses

Where there are groups who share a common view on how they wish to see the Neighbourhood Plan, it would be helpful for that group to send a single comment which represents the view, rather than for a large number of individuals to send in separate comments which repeat the same points. In such cases the group should indicate how many people it is representing and how the comment has been authorised. The number of comments received does not increase the weight that the Examiner places on a particular issue.
