At their meeting on 12 December 2007 the Planning Committee of the Regulatory Committee on behalf of the County Council resolved, for the purposes of Regulation 3 of the Town and Country Planning General Regulations 1992 to grant planning permission for the development referred to above and a copy of the Decision Notice is attached.

Therefore, in accordance with Regulation 3 would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

In pursuance of their powers under the above mentioned Act, Order and Regulations, the Council as the local planning authority hereby GRANT PLANNING PERMISSION for Construction of a new single storey pitched roof, timber framed and brick clad nursery building. Cross in Hand C E Primary School, Sheepsetting Lane, Cross-in- Hand, Heathfield. (Within land edged red on applicants plan no. 1186/01) in accordance with your application validated by the Director of Transport & Environment of East Sussex County Council on 1 October 2007 and the plans and particulars submitted in connection therewith and listed below and subject also to due compliance with the condition(s) specified here under:-

1. The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990.

2. No development shall take place until plans and full details of both hard and soft landscaping works have been submitted to and approved in writing by the Director of Transport and Environment and these works shall be carried out as approved. These details shall include:

Hard Landscaping

- Proposed finished levels or contours

- Hard surfacing materials

Soft Landscaping

- Planting plans

- Written specifications (including cultivation and other operations associated with plant and grass establishment)

- Schedules of plants, noting species, plant sizes and proposed numbers/densities where appropriate

- Indication of how mounds would be reconstructed

- Implementation programme

The landscaped areas shall be maintained thereafter in accordance with the approved management plan.

Reason: To integrate the development effectively into the surrounding environment and to comply with Policies S1 and EN1 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.

3. Development shall not commence until the following details have been submitted to and approved in writing by the Director of Transport and Environment showing: -

(a) details of the species, the approximate height, and an assessment of the general state of health and stability, of each retained tree and of each tree which is on land adjacent to the site and to which paragraphs (b) and (c) below apply;

(b) details of any proposed topping or lopping of any retained tree, or of any tree on land adjacent to the site;

(c) details of any proposed alterations in existing ground levels, and of the position of any proposed excavation within the crown spread of any retained tree or of any tree on land adjacent to the site.

(d) details of the specification and position of fencing and of any other measures to be taken for the protection of any retained tree from damage before or during the course of development in accordance with BS 5837 2005 provided for retained trees.

Reason: In the interests of visual amenity and to comply with Policies S1 (b) & (f) and EN1 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.

4. The materials to be used in the construction of the external surfaces of nursery shall match those used in the existing school building.

Reason: To ensure the appropriate appearance of the development in the area in accordance with Policies S1 and EN1 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.

The Development Plan policies of relevance to this Decision are:-

East Sussex and Brighton & Hove Structure Plan 1991-2011: Policies: S1 (a), (b), (d), (u) (general development considerations); EN1 (environment); TR3 (accessibility).

East Sussex and Brighton & Hove Waste Local Plan 2006: Policy WLP11 (reduction, reuse and recycle principles).

Wealden Local Plan 1998: Policies: EN27 (building design); EN28 (design of development for people with disabilities).

Non Statutory Wealden Local Plan 2004: Policy BE1 (design and impact on amenities).

Reasons for approval

The proposal provides the local community with a purpose-built nursery building that will improve local facilities. It will not cause a detrimental impact on the local residential amenity. It complies with Policies S1 (a), (b), (d) and (u), EN1 and TR3 of East Sussex and Brighton & Hove Structure Plan 1991-2011; with Policy WLP11 of East Sussex and Brighton & Hove Waste Local Plan 2006; with Policies EN27 and EN28 of the Wealden Local Plan 1998 and Policy BE1 of Non Statutory Wealden Local Plan 2004.
