November 4, 2003

The Tama County Board of Supervisors met at 9:30 a.m., November 4, 2003. Present: 1st District Supervisor, Larry Vest; 2nd District Supervisor, Keith Sash; 3rd District Supervisor, Jim Ledvina.

Motion by Ledvina, Seconded by Vest to approve the minutes of the October 28th regular meeting. All Voted Aye. Motion Carried.

At 9:30, the Board met with Lyle Brehm, County Engineer, to receive a road projects report.

At 9:45, the Board met with Harold Connolly, CPC, to review information regarding the County Relief ordinance and possible updates to its provisions. The Board also discussed updating the County's policy for recouping of costs associated with services provided to clients receiving services in substance abuse treatment.

At 10:15 the Board me with Dr. Dennis Mallory to discuss medical examiner training and costs associated with transporting a recent case to Des Moines.

The Board received information from the County Sanitarian concerning construction of a confined livestock feeding operation in Section 13 of Otter Creek Township (T83N, R14W) located about two miles northwest of Vining. The Department of Natural Resources has approved a construction permit. The operation is below the 2,500 animal unit capacity and does not require Board action or a public hearing.

Motion by Vest, Seconded by Ledvina to approve the claims for payment as presented on the Auditor’s Claim Register. All Voted Aye. Motion Carried.

Chairman Sash adjourned the meeting at 10:40 a.m.

Board of Supervisors Minutes

November 10, 2003

The Tama County Board of Supervisors met at 9:30 a.m., November 10, 2003. Present: 1st District Supervisor, Larry Vest; 2nd District Supervisor, Keith Sash; 3rd District Supervisor, Jim Ledvina.

The Board canvasses the city election results. The City Election in Tama was canvassed November 6th.

Motion by Ledvina, Seconded by Vest to approve the minutes of the November 4th regular meeting. All Voted Aye. Motion Carried.

At 9:45, the Board met with Susan Jones, Assistant to the County Engineer, to receive a road projects report.

At 9:50, Sheriff Dennis Kucera met with the Board requesting to fill the vacant deputy sheriff position. The officer could begin work next week. No action taken.

At 10:00, Don Paustian, rural Tama, presented a request to use county property in Toledo to install a permanent memorial for Veterans of Tama County. The suggested location was on the corner of Broadway and State streets in the south side enclosure of the county museum. The lighted display would contain the service flags for the armed forces and a few military items. Public funding is not requested; however, all donations for the project are appreciated and will be used to honor the veterans. The Board stated their support of the worthy project.

Motion by Vest, Seconded by Ledvina to support the permanent veterans memorial project on the county's property in Toledo. All Voted Aye. Motion Carried.

Motion by Vest, Seconded by Ledvina to approve the claims for payment as presented on the Auditor’s Claim Register. All Voted Aye. Motion Carried.

November 18, 2003

The Tama County Board of Supervisors met at 9:30 a.m., November 18, 2003. Present: 1st District Supervisor, Larry Vest; 2nd District Supervisor, Keith Sash; 3rd District Supervisor, Jim Ledvina.

Motion by Ledvina, Seconded by Vest to approve the minutes of the November 10th regular meeting. All Voted Aye. Motion Carried.

At 9:30, the Board met with Lyle Brehm, County Engineer, to receive a road projects report.

Motion by Vest, Seconded by Ledvina to approve the following resolution to set weight limits on bridges;

RESOLUTION 11-18-2003A

WHEREAS, the structures at these locations, due to age and design, have reached the point in time where a restricted weight limit should be imposed,

THEREFORE, BE IT RESOLVED by the Tama County Board of Supervisors that the following weight restrictions be imposed on these structures. The structures are located and restricted as follows:

02112 6 ton 0.7 miles east of the NW corner of Section 11-86-14 (was 15 ton)

09064 6 ton 0.5 miles south of the NW corner of Section 6-84-13 (was 10 ton)

Motion by Vest, Seconded by Ledvina to approve the liquor license renewal application for Claudette Lewless, Traer, d.b.a. The Ole Depot restaurant. All Voted Aye. Motion Carried.

At 10:00, the Board met with the Tama County Library Association to discuss library services being utilized by local residents and requested an additional $4,500 for next fiscal year's budget. The Board has reduced the current year request by five percent for all departments due to revenue shortfalls from the State of Iowa placing more pressure on property tax dollars. The Board will be finalizing the 2005 fiscal year budget in February 2004.

It was moved by Vest and seconded by Ledvina that the following Resolution be adopted:

RESOLUTION NO. 11-18-2003B

BE IT RESOLVED by the Board of Supervisors of Tama County, Iowa:

1. That conveyance of the title by Warranty Deed to real estate described as:

The East One Third (1/3) of Lot Two (2) and the East One foot (E. 1 ft.) of the West Half (W 1/2) of the East Two-thirds (E 2/3) of Lot Two (2), Block Seven (7), of Toledo, Iowa.

is approved for Allan Richards, who qualified by the sealed bid.

2. That on September 16, 2003, the Board conducted a hearing to authorize the sale of said property by sealed bid; and on September 9 and 11, 2003, the public notice of the hearing to dispose of the property and the method of its disposal was published as required by law.

3. That no oral or written objection to said proposed disposal have been received.

4. Keith Sash, acting as Chairman of the Board of Supervisors of Tama County is authorized to sign the acceptance on the Offer to Buy Real Estate and Acceptance agreement on behalf of Tama County for the sale price agreed upon by the Board of Supervisors.

5. That Tama County, Iowa, in consideration of the sum of one dollar and other good and valuable consideration, the receipt and sufficiency of which is acknowledged, does hereby approve conveyance of title to the aforedescribed real estate to Allan Richards.

6. That the Chairman of the Board of Supervisors and Tama County Auditor are hereby authorized and directed to execute the Warranty Deed conveying the aforedescribed real estate to Allan Richards, and the Tama County Auditor is authorized and directed to cause delivery of said Warranty Deed to the same.

A roll call was taken and the following Board members voted “aye”: Keith Sash, Chairman; Larry Vest; and Jim Ledvina, and none of the members voted “nay.” The vote being called and the results recorded by the Auditor, the Chairman of the Board of Supervisors declared the resolution duly adopted.

At 10:30, the Board held a public hearing for support homeownership grant application to the Iowa Department of Economic Development. That Tama County will apply for $334,840 of Housing Funds for assisting 10 lower income households purchase quality affordable housing.

No public comments were received. Chairman Sash closed the hearing.

RESOLUTION 11-18-2003C

A RESOLUTION TO SUPPORT THE TAMA COUNTY REHABILITATION TO SUPPORT

HOMEOWNERSHIP APPLICATION TO THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT

WHEREAS, home ownership opportunities for low- and moderate-income homebuyers are limited in Tama County, and

WHEREAS, the average sales price of a home in Tama County has increased three times as fast as the per capita income in the County, and

WHEREAS, many homes available in the “affordable” price range for low- and moderate-income residents in Tama County do not meet Iowa’s Minimum Rehabilitation Standards, and

WHEREAS, the 2000 Tama County Housing Needs Assessment identified 545 homes in the incorporated areas of Tama County that need substantial rehabilitation ($15,000 to $24,999 per unit), and

WHEREAS, the 2000 Tama County Housing Study recommends that countywide efforts to facilitate housing rehabilitation be established, and

WHEREAS, the 2000 Tama County Housing Needs Assessment identifies home ownership as a paramount goal in the County, and

WHEREAS, with the 2001 $395,485 rehabilitation to support homeownership grant, 12 houses were improved (4 in Toledo, 2 in Dysart, 2 in Traer, 2 in Elberon, 1 in Tama, and 1 in Clutier) and all the funds have been exhausted, and

WHEREAS, the 2001 homeownership grant required a 10% of the rehabilitation amount cash match up to $2,499 per house that supported project administration, and

WHEREAS, the new program will have an $80,000 existing housing purchase price limit, and

WHEREAS, the program can provide up to $24,999 of rehabilitation improvements (e.g. siding, roofing, replacement windows and doors, electrical upgrades, painting, etc…) to a house at the time of purchase provided that the household has an annual income that is under 80% of the county median (i.e. 2 person $32,500, 3 person $36,600, 4 person $40,650, and 5 person $43,900), and

WHEREAS, Tama County will know whether this project is funded in March 2004. The rehabilitation work could commence in the summer of 2004 and continue until funds are expended or March 2006, whichever occurs first.

NOW, THEREFORE, BE IT RESOLVED BY THE TAMA COUNTY BOARD OF SUPERVISORS:

Section 1: That Tama County will apply for $334,840 of Iowa Department of Economic Development Housing Funds for assisting 10 lower income households purchase quality affordable housing. The detailed budget is as follows:

Section 2: That Tama County will provide $2,500 or up to 10% of the rehabilitation costs per house, whichever is lesser, for program administration. This funding will come from the participating Cities.

At 11:00, the Board received bids for the sale of a county building at 121 W. High Street, Toledo. The Board received bids from:

PUBLIC MEETING TO DISPOSE OF A COUNTY PROPERTY WITH RESOLUTION TO ACCEPT THE OFFER TO BUY REAL ESTATE AND TO CONVEY PROPERTY TO THE BIDDER BY WARRANTY DEED

On November 18, 2003, the Board, in its public meeting to dispose of a property by sealed bid, has examined the sealed bids and finds that Allan Richards has the acceptable bid of $ 3,200.00. The Tama County Board of Supervisors proposes to convey real estate described as:

The East One Third (1/3) of Lot Two (2) and the East One foot (E. 1 ft.) of the West Half (W 1/2) of the East Two-thirds (E 2/3) of Lot Two (2), Block Seven (7), of Toledo, Iowa.

Unto Allan Richards for the consideration and payment of the acceptable bid.

No objection to this proposed conveyance was heard.

It was moved by Vest and seconded by Ledvina that Keith Sash, acting as Chairman of the Board of Supervisors of Tama County is authorized to sign the acceptance on the Offer to Buy Real Estate and Acceptance agreement on behalf of Tama County for the sale price agreed upon by the Board of Supervisors.

A roll call was taken and the following Board members voted “aye”: Keith Sash, Chairman; Larry Vest; and Jim Ledvina, and none of the members voted “nay.” The vote being called and the results recorded by the Auditor, the Chairman of the Board of Supervisors declared the motion duly adopted.

At 11:10, the Board met with Hank Wehrman and Ruth Izer, coordinator for Iowa Valley Rural Conservation & Development (RC&D) to present the scope of services provided by the RC&D in the six (6) county area including Tama County. RC&D plans and participates in rural development activities including sponsorship of rural water projects, roadside vegetation inventories, "Ioway" trail project (long-term) for recreation development, fire protection planning, grant writing and technical assistance to rural communities, soil loss prevention projects and scenic roadway initiatives.

The Board met with Deb Calderwood, Tama County Economic Development to receive information on a new program for expanding and prospective businesses called MyEntrenet. This new Internet service allows small businesses to access technical assistance and other helpful information.
