Terms and conditions for allotment of Markfed Agencies
for operating of Markfed booths
Markfed is producing a vast range of edible products which are marketed under SOHNA brand. The products like Haldi, Honey, Sarson Ka Saag, Tomato Ketchup, Atta, Rice, Refined Oils, Mustard Oil, Gur, Shakkar, Ready to eat curries etc. are prepared from the raw materials procured from the farmers which help them in marketing their agriculture produce. Some of these products such as Haldi, Gur are outsourced directly from farmer’s Cooperative thereby enabling them in marketing their products. These products are being processed under hygienic condition and meet all the required standards prescribed by the regulatory authorities. Markfed products are also competitively priced. Markfed intends to provide these products to the public directly at discounted prices by opening new booths. Agency for operating the Markfed booth will be allotted to the individuals for which the applications are being invited. The detail procedure and terms & conditions for allotment of the Agency are given as under:
1. Applications are invited for allotment of Markfed agencies for 71 number of Markfed booths. The district wise list of booths offered for allotment is attached as Annexure ‘1’
2. The applications for allotment of Agency will be received in the concerned district. The draw will be held site-wise at district level. The applicant should select the site and submit the application to the concerned District Manager.
3. Application form duly filled in alongwith earnest money must reach concerned district office of Markfed latest by 11.00 AM on or before 2.1.2018. In case the last date of receipt of application is declared a holiday then the applications shall be received upto the next working day upto same time at same place as specified above for which no further intimation will be conveyed.
4. The applications will be scrutinized and list of eligible applicants will be placed on the notice board and Markfed website www. markfedpunjab. com within 15 days. In case of any objection, It will be entertained and settled by the committee within 7 days from the posting of list of eligible applicants on the Markfed website. Final list will be displayed on Markfed website. For allotment of Agency, draw of lots of eligible candidates will be carried out in the concerned district office of Markfed as per schedule given in Annexure-IV. In case of any change in the date of draw or change in venue, notice will be given through Markfed website www.markfedpunjab.com.
5. In case of any applicant find any difficulty/ problem in submitting the application, he may contact at mobile no. 94172-78918 on any working day from 9.00 AM to 5.00 PM and/ or submit its difficulty/ query through E.mail at .
6. Only one application per person will be entertained. One person can apply for one site only. In case one person applies for more than one site then all the applications of that candidate will be rejected.
7. In case more than one applications are received for one booth, application shall be decided by holding a draw.
8. A waiting list for each site upto 3 persons shall be prepared through the draw.
9. The waiting list shall be valid for one year.
10. That in case the opening date is declared a holiday, then the draw shall be held on the next working day at the same time and place specified above for which no further intimation will be conveyed.
11. Draw of allotment will be held in the concerned district office of Markfed by the committee constituted for the purpose.
12. The application form should be clearly filled properly in ink duly signed giving full name and address of the applicant.
13. If the applicant does not attach the earnest money alongwith the application, his application shall be out rightly rejected.
14. No interest will be paid on amount of earnest money deposited by the applicants. EMD of Rs. 25,000/- will be converted into security of successful applicants and EMD of unsuccessful candidates will be refunded.
15. Markfed Agency shall be alloted on monthly rent of Rs. 2000/- (Rs. two thousand only). GST shall be borne/ paid by the Markfed Agency. The list of the booths/ sites alongwith addresses is attached herewith. This rent would be increased by 10% increase over the rent of first year and similarly the calculation of rent for subsequent years will be done with 10% increase over the rent of the preceding years.
16. Markfed Agency holder will deposit rent before seventh of every month in the bank account supplied by Markfed. In case the rent is not deposited within prescribed period, the allotment of Agency will be cancelled and rent shall be recovered from the security of the Markfed Agency holder.
17. Applications received through telephone/ Fax/ E-mail are liable to be out rightly rejected .
18. The eligibility criteria for allotment of Markfed Agency may be as under:
i. The applicant will deposit earnest money amounting to Rs. 25,000/- in the shape of Demand Draft/ RTGS/NEFT in favour of “Punjab State Cooperative Supply and Marketing Federation Limited” in account number of concerned district office as per detail given in Annexure-V (Attach copy of UTR No. in case of payment through RTGS/NEFT)
ii. The applicant will deposit form fee amounting to Rs. 200/- in the shape of Demand Draft/ RTGS/NEFT in favour of “Punjab State Cooperative Supply and Marketing Federation Limited” in account number of concerned district office as per detail given in Annexure-V (Attach copy of UTR No. in case of payment through RTGS/NEFT).
iii. The applicant should not be less than 18 years and not more than 37 years of age as on last date of receipt of applications (Attach copy of Matriculation certificate as proof of age).
iv. The applicant should possess minimum qualification of 10+2 or equivalent from recognized Institution/ Board as on last date of receipt of applications (Attach copy of proof of qualification).
v. The applicant should be bonafide resident of Punjab. The applicant shall attach copy of the one of the following document as resident proof:-
a) Election ID card with present address
b) Aadhaar Card
c) Phone bill with current address
d) Gas Connection
e) Bank Passbook
f) Rental agreement if staying in rented house.
vi) The person whose family member ( spouse/ children) is working in Government office/ Board/ Corporations/ Cooperative Institutes are not eligible for allotment of Markfed agency. The applicant shall attach a self declaration with the application form in this regard.
19. If the successful applicant after signing the agreement with Markfed does not take possession to start sale of Markfed products within 30 days from the allotment of booth, in that case the allotment of the booth shall be cancelled and security amount of the applicant shall be forfeited and the booth shall be alloted to the next person from the waiting list.
20. Offers should be strictly according to the terms and conditions of application form, failing which the same shall not be considered.
21. The Markfed Agency will be allotted for 2 years and may be further extended depending upon the performance of the Markfed Agency and the satisfaction of Markfed. However, Markfed may terminate it by giving one month notice.
22. There will be no sale target for first three months from the allotment. After that the target for sale of Markfed products shall be Rs.1.00 lakh per month in the first year and after one year the target will be increased @ 20% per annum for the year on year basis.
23. The performance of the Markfed Agency shall be evaluated after six months from the date allotment. In case Markfed Agency holder fails to achieve monthly average basis targets, then Markfed may be at liberty to cancel/ terminate the Agency allotment. Security amount will be forfeited after cancellation/termination of the agreement.
24. All expenses for operating the booth and electricity bill shall be borne by the Markfed Agency. Markfed Agency shall maintain the booth in good condition. He will hand over the possession of the booth to Markfed in good condition after the expiry of the agreement. In case of any damage, he shall be responsible for rectification at his own cost, failing which the cost of damage will be deducted from the security amount and through other lawful course.
25. Products of Markfed shall be given to the Markfed Agency at dealer rate against advance payment/ bank guarantee/ pledging of fixed deposit. In case of delivery against bank guarantee/ pledging of fixed deposit, Markfed Agency will be allowed 15 days credit and shall make the payments within 15 days of date of invoice. Markfed Agency will be allowed to sell Markfed approved products only.
26. The orders from Markfed Agency will be accepted in multiples of Rs. 1 lakh.
27. Delivery of Markfed Sohna range of products shall be made on FOR destination from the plant/ nearest depot.
28. Local taxes and octroi etc. as applicable shall be borne by the Markfed Agency.
29. Markfed Agency shall ensure proper display of the products at the booth.
30. Products having quality/ packaging problems if any shall be replaced by Markfed free of charges. For this the complaint from the Markfed agency must be made within one week of receipt of material.
31. Markfed Agency will be responsible for maintaining hygienic condition of the booth. He will upkeep the booth and surrounding areas at his own cost.
32. The stocks stored in the booth shall be insured by the Markfed Agency at their own expenses.
33. Markfed Agency shall comply any legal requirements for running the business/ booth. He will not indulge in unlawful product/ activity.
34. Markfed Agency shall not make any alteration in the booth without the written approval of Markfed
35. Markfed Agency will not write/ paint any thing on the walls of the booth without the permission of the Markfed.
36. Markfed Agency shall not sublet the booth or part thereof to any other party.
37. The authorized representative of Markfed reserves the right to inspect the booth at any time on any working day.
38. Markfed Agency shall apply license of FSSAI within 15 days from issuing of allotment letter.
39. If any site is not developed in booth due to one or the other reasons, the applicant shall have no right for any claim from Markfed for allotment of any site or any other damages, if any and the security shall be refunded.
40. In case allotment of site to Markfed is cancelled by the concerned authority then Markfed Agency will not claim any damage/ loss from Markfed and allotment will be cancelled.
41. ARBITRATION:
In case of any disputes or difference which may arise between the Markfed and Markfed Agency with regard to the consideration, interpretation and effect of the agreement or any other part thereof, the matter shall be referred to Managing director, Markfed or his nominee for the adjudication of the dispute, under the Arbitration and Conciliation Act 1996, as amended up to date, whose decision shall be final and binding on both the parties.
All the proceedings under the agreement or otherwise shall take place within the jurisdiction of Chandigarh Courts only.
