SUMMARY OF THE ISSUE(S)

Specific authority is provided in California Education Code (EC) Section 52863 to allow the State Board of Education (SBE) to waive the Schoolsite Council (SSC) requirements contained in EC Section 52852 of the School-Based Coordination Program (SBCP) Act that would hinder the success of the program implementation. These waivers must be renewed every two years.

SUMMARY OF KEY ISSUES

The Black Butte Union Elementary School District is requesting a shared SSC with composition change for two small schools: Black Butte Elementary School (9 teachers serving 136 students in kindergarten through grade five) and Black Butte Junior High School (4 teachers serving 68 students in grades six through eight). Parents are stretched thin as many of them volunteer in clubs and activities on both campus which are located in a small rural area.

The Chawanakee Unified School District is requesting an SSC composition change for a small school: Spring Valley Elementary School (8 teachers serving 185 students in kindergarten through grade eight). The school is located in a rural area.

The Jamestown Elementary School District is requesting to renew a shared SSC for two small schools: Chinese Camp Elementary School, a small necessary school (2 teachers serving 29 students in grades three through six), and Jamestown Elementary School (18 teachers serving 297 students in kindergarten through grade eight). To have a shared SSC would allow for better coordination and efficiency of student services. The two schools are located in a rural area.

The Nevada County Office of Education is requesting a shared SSC with composition change for two small schools: Earle Jamieson Educational Options (2 teachers serving 5 students in grades seven through twelve) and Sugarloaf Mountain, Juvenile Hall Program (2 teachers serving 14 students in grades six through twelve). The two schools share a principal and an administrative secretary, and parents are rarely involved due to the nature of the schools. The schools are located in a rural area.

The Pixley Union Elementary School District is requesting a shared SSC for two schools: Pixley Elementary School (17 teachers serving 344 students in kindergarten through grade five) and Pixley Middle School (42 teachers serving 778 students in grades six through eight). The two schools share many of the same parents with children attending both schools. They are located in a rural area.

The Santa Paula Unified School District is requesting an SSC composition change for a small school: Renaissance High School (5.66 teachers serving 120 students in grades nine through twelve). The school serves at-risk students and enrollment is fluid and mobile. It is located in an urban area.

The Whitmore Union Elementary School District is requesting an SSC composition change for a small school: Northern Summit Academy (1 teacher serving 99 students in kindergarten through grade twelve). The school offers independent study opportunities to students and parents. It is located in a rural area.

SUMMARY OF PREVIOUS STATE BOARD OF EDUCATION DISCUSSION AND ACTION

The CDE has previously presented requests from local educational agencies (LEAs) to waive some of the SSC requirements in EC Section 52863 or to allow one shared SSC for multiple schools. All of these requests have been granted with conditions. The conditions take into consideration the rationale provided by the LEAs, a majority of which are due to the size, type, location, or other capacities of the schools.

52852. (a) A schoolsite council shall be established at each school

that participates in school-based program coordination. The

schoolsite council shall be composed of the principal and

representatives of: teachers selected by teachers at the school;

other school personnel selected by other school personnel at the

school; parents of pupils attending the school selected by the

parents; and, in secondary schools, pupils selected by pupils

attending the school.

(b) (1) At the elementary level, the schoolsite council shall be

constituted to ensure parity between (A) the principal, classroom

teachers, and other school personnel; and (B) parents or other

community members selected by parents.

(2) At the secondary level, the schoolsite council shall be

constituted to ensure parity between (A) the principal, classroom

teachers, and other school personnel; and (B) an equal number of

parents, or other community members selected by parents, and pupils.

(3) At both the elementary and secondary levels, classroom

teachers shall comprise the majority of persons represented under

subparagraph (A) of paragraphs (1) and (2).

(c) Existing schoolwide advisory groups or school support groups

may be utilized as the schoolsite council if those groups conform to

this section.

(d) The Superintendent shall provide several examples of selection

and replacement procedures that may be considered by school site

councils.

(e) An employee of a school who is also a parent or guardian of a

pupil who attends a school other than the school of the parent's or

guardian's employment is not disqualified by virtue of this


employment from serving as a parent representative on the school site

council established for the school that his or her child or ward

attends.

Outcome Rationale: After much recruitment, our small, rural school is unable to get enough parents to meet the requirements of 5 parent members at the elementary school level and 3 parents at the middle school level. Because of the small community population, parents are stretched thin as many of them volunteer on both campuses in school clubs and activities. The Black Butte Elementary School District has a total of 11 teachers. The waiver is requested to allow the district to operate a combined elementary/middle School Site Council with 8 members instead of 12 members. The Site composition would consist of 1 administrator, 2 teachers, 1 classified employee, and 4 parents/community members/students. This composition would allow for a majority of teachers on the staff side and would ensure parity between staff members and parent/community members.

Outcome Rationale: Spring Valley is a very small school with only 185 students. It has been very hard to get community and parent members on the council and with 5 parents we need 5 staff member, 3 that need to be teachers. We have a really small staff with only 8 teachers. This put a huge strain on the teachers to be available for other duties.
