Thank you for your email which was received on 4th January 2010 making a request under the Freedom of Information Act and below is this Council's response to the questions you have raised:-
Can you please let me know the following relating to Planning applications featuring a Change of Use from B1/C3 to C3 under the Town and Country Planning (Use Classes) Order 1987 for properties located on the former Rawsons site in Bells Yew Green.
In the last 2 years:
1) How many applications have you received featuring a Change of Use from B1/C3
to C3?
None - there have, however, been four change of use planning applications on this site which may be of interest to you and they are as follows:-
WD/2008/0135 - PLOTS 28-29 FORMER RAWSONS SITE, BELLS YEW GREEN, FRANT - CHANGE OF USE OF GROUND FLOOR UNIT TO MOTORCYCLE COURIER SERVICE INCLUDING PRIVATE HIRE AND DELIVERIES - Refused 2nd April 2008 and Appeal Allowed on 10th September 2008.
WD/2008/0235 - PLOTS 28-29, FORMER RAWSONS SITE, BELLS YEW GREEN, NR. TUNBRIDGE WELLS - PROPOSED INDIAN TAKE - AWAY AT GROUND FLOOR LEVEL AND FIRST FLOOR USE FOR RESIDENTIAL - Refused 9th April 2008 and Appeal Dismissed 10th September 2008.

I am required to advise you that should you not be happy with this response then you may ask for an internal review of this decision. That review would be carried out using the mechanism of the Council’s Complaints Procedure, details of which are attached, but the decision will be taken applying the Freedom of Information Act legislation and codes of practice.
If you are unsuccessful in that internal review you would of course then have the option of applying to the Government’s Information Commissioner under section 50 of the Freedom of Information Act 2000 to make a decision as to whether the information should be disclosed by the Council.
