ALSO PRESENT: Attorney Kevin Deneen (Labor Attorney), Les Koziara (BOE Business Manager), members of the Windsor Locks Police Department, Town Residents, and Reporters from the Journal Inquirer and Patch.com

CALL TO ORDER:

First Selectman Wawruck called the meeting to order at 5:35 p.m.

PLEDGE OF ALLEGIANCE:

The Pledge of Allegiance was observed.

PUBLIC INPUT:

● Michael Bracken came forward to read a letter into the record that was previously sent to all three Selectmen.

First Selectman Wawruck stated the Town Attorney has ruled that any correspondence received by the Selectmen does not have to be included as part of the Minutes.

Mr. Bracken commented on civilians and/or non-police personnel being allowed to bear firearms in Town Hall, and also on the proposed appointment of Susan Caldron to the EIDC Commission as listed on tonight’s agenda.

● John Piquette stated his appreciation and support to the Board of Selectmen and especially the Police Department and thanked them for all they do to protect the public.

● William Rousseau had a question regarding the Police Union Contract.

Selectman Wawruck stated that Mr. Rousseau’s question would be answered during the Labor Attorney’s presentation of the Police Union Contract.

APPROVAL OF THE FEBRUARY 19, 2013 REGULAR MEETING MINUTES:

Selectman Gragnolati moved to approve the Minutes of the February 19, 2013 Meeting as published. Selectman Wawruck seconded the motion. Both were in favor. Motion passed.

CORRESPONDENCE: None.

NEW BUSINESS:

a.  Ratify Police Union Contract

Attorney Kevin Deneen gave a brief overview of the proposed Police Union Contract. Some of the areas that he highlighted were:

● Wages:

* A $3,800.00 non-retroactive increase to most positions that will bring wages in line with
other surrounding towns
* A 1.5% salary increase in FY 2013-2014 with a 1.75% salary increase in FY 2014-2015

* The longevity provision has been eliminated

● Health Insurance

* Same platform plan that all other town employees have with the exception of prescription coverage resulting in an insurance savings to the Town

● Cost share increase is 18% by end of the Contract (currently is 16%)

● Changes to management structure allowing more flexibility in the scheduling & promotional
process (appointing positions and seniority provisions)

● Institution of a Drug & Alcohol Testing Program

● Changes to Supervisory positions to allow for every shift to have a command officer or
a Supervisor working

● Increase in bid-cycle from 6 weeks to 12 weeks

● Addition of a Zipper Clause that allows the Contract to supersede any past Contractual
language or memorandums of agreement

● No changes will be made in regards to minimum staffing

Selectman Gragnolati moved to approve the Contract between the Town of Windsor Locks and the Local 523 International Brotherhood of Police Officers for the time period of July 1, 2012 – June 30, 2015. Selectman Wawruck seconded the motion. Both were in favor. Motion passed.

Both Selectmen Wawruck & Gragnolati stated their reasons for being in favor of approving this Contract.

b.  Adopt Resolution for South Elementary School, Middle School & High School Roof Projects

Selectman Gragnolati moved the following Resolution:

Upon Motion duly made and seconded, the Board of Selectmen of the Town of Windsor Locks, at its meeting of March 5, 2013, voted as follows:

THAT;

1.  The Board of Selectmen establishes a Building Committee made up of the members of the Board of Education, which is authorized to take any action required by the provisions of Chapter 173 of the General Statutes of Connecticut, Revision of 1958, as amended, and the regulations of the State Board of Education promulgated there under, in oversight of the South Elementary School, Middle School and High School Roof Projects; and

2.  That the Board of Selectmen authorizes the preparation of schematic drawings and outline specifications for the South Elementary School, Middle School and High School Roof Projects; and,

3.  That the Board of Selectmen authorizes the Windsor Locks Superintendent of Schools to apply for and accept state grants for the South Street Elementary School, Middle School and High School Roof Projects. All grants received shall be applied to the project costs.

Selectman Wawruck seconded the motion. Both were in favor. Motion passed.

Windsor Lock’s Public School’s Business Manager Les Koziara explained that adoption of the Resolution is part of the state’s requirement for the RFP/bid process and also to obtain any reimbursement on the projects.

OLD BUSINESS:

a.  Insurance Consultant Contract

Selectman Gragnolati stated that the Town Attorney received a proposed agreement from R.J. Dean Associates, Inc. to conduct an insurance review for the Town of Windsor Locks. The Town Attorney has revised the proposal to include legal language for the Scope of Services, Term and Termination, Compensation, Reimbursement of Expenses; and Payment, Consultant’s Representations, Independent Contractor, and General Provisions.

Selectman Gragnolati moved to approve the Insurance Consultant Agreement, as written by the Town Attorney, between the Town of Windsor Locks and R.J. Dean Associates, Inc. Selectman Wawruck seconded the motion. Both were in favor. Motion passed.

APPOINTMENTS, RE-APPOINTMENTS, RESIGNATIONS:

Appointments:
a. Nicole Piquette to the IWWC Commission for a term expiring on 02/16/2016
b. Michael G. Wrabel, III to the EIDC Commission for a term expiring on 12/08/2014
c. Susan Caldon to the EIDC Commission for a term expiring on 08/20/2015

Re-Appointments:
a. Robert Crochetiere to the IWWC Commission for a term expiring on 02/16/2015

Selectman Gragnolati moved to approve the appointments of Nicole Piquette to the IWWC Commission for a term expiring on 02/16/2016, Michael G. Wrabel, III to the EIDC Commission for a term expiring on 12/08/2014, Susan Caldon to the EIDC Commission for a term expiring on 08/20/2015, and the re-appointment of Robert Crochetiere to the IWWC Commission for a term expiring on 02/16/2015. Selectman Wawruck seconded the motion. Both were in favor. Motion passed.

TAX REFUNDS:

Selectman Gragnolati moved to approve the Refund Request for March 5, 2013 in the amount of $390.74, as defined in Schedule A. Selectman Wawruck seconded the motion. Both were in favor. Motion passed.

A copy of Schedule A is attached to the Minutes of the March 5, 2013 Board of Selectmen Meeting.

PUBLIC INPUT:

● Michael Bracken spoke regarding the appointment of Susan Caldron to the EIDC Commission, and again inquired why he wasn’t allowed to have his letter as part of the meeting record.

● William Rousseau asked what the cost of the Police Union Contract would be. Selectmen Wawruck and Gragnolati both responded that the cost would be 8.4% over the next 3 years.

● Sebastian Garofalo spoke of incorrect advice that was given out by the Town Attorney regarding an FOI request relating to the Police Union Contract. He referred to Connecticut State Statute I-210, under FOI, Subsection B, #9 which states “Nothing in the Freedom of Information Act shall be construed to require disclosure of: records, reports, statement of strategy, or negotiations with respect to collective bargaining”. He thanked the Board of Finance, the Board of Selectmen, and the Human Resource Director for their collaborative efforts in the successful outcome of the Police Union Contract.

A motion to adjourn the meeting at 6:05 p.m. was made by Selectman Gragnolati and seconded by Selectman Wawruck. Both were in favor. Motion passed.
