RELEASE AND HOLD
HARMLESS AGREEMENT
1. This agreement is entered into between (Pony Paradise Rides, Woodinview Stables Inc., Janie and Paul Philipp, their employees, independent contractors for Pony Paradise Rides and/or Woodinview Stables Inc., owners, officers and agents and owners and lessors of the real property) all referred to collectively as (“Stable”), 8107 224th St SE Woodinviille, Wa. 98072, and 8021 224th St SE Woodinville, Wa. 98072 and 8124 224th St SE Woodinville, Wa. 98072, and the undersigned attendee/releasor (“ Releasor”) as defined in paragraph 2 below.
2. The undersigned Releasor, individualy and on behalf of his or her spouse, children, wards, guests, friends ( all referred to collectively as Releasor), assumes all risk of, and releases Stable from, damages for all property and personal injury and loss of life ( people and animals) arising out of the use of the buildings and grounds and the activities thereon, whether or not it is as a result of the negligence of the Stable, the Releasor, third parties or condition of the premises and therefore, agrees not to present any claim or file any suit for said damages.
In addition to the foregoing, Releasor hereby indemnifies and holds harmless the Stable for all costs, expenses, damages, attorneys’ fees, claims and judgments of third parties and Releasor arising out of or caused by the Releasors and their horses.
Should Attorneys’ fees be incurred by either party enforcing their rights or obligations under this Agreement, the court shall award the prevailing party reasonable attorneys’ fees.
