1. INTRODUCTION:

TheSanMateoCountyCommunity College District (SMCCCD) faculty selection procedures areestablishedtoprovidethedistrictwithqualifiedfacultywhoareexpertsintheirsubjectareasandwhopossessesavarietyofotherskillsincluding:

a)Teaching,advisingandservingtheneedsofstudents;

b)Contributingtotheoveralleffectivenessofthecollegesandthedistrict;

c)Demonstratingsensitivitytoandabilitytoworkwithcommunitycollegestudentswhoarefromdiverseacademic,socioeconomic,cultural,linguistic,andethnicbackground;

d)Demonstratingcreativityandinnovation;

e)Demonstrating Leadership;

f)Possessingeffectiveoralandwrittencommunicationskillsandpositiveinterpersonalbehaviors.

InaccordancewithCaliforniaEducationCode(§87359),onlyapersonwhopossessestheminimumqualificationsforserviceorqualificationsthatareequivalenttotheminimumqualifications,asestablishedbytheBoardofGovernorsoftheCaliforniaCommunityColleges,maybehiredtoserveasacommunitycollegefacultymember. Thefaculty,representedbytheDistrictAcademicSenate GoverningCouncil(DASGC),hasaprofessionalresponsibilityinthedevelopmentandimplementationofpoliciesandproceduresgoverningthehiringprocess,whichistoensurethequalityofitsfacultypeers.Thepoliciesandprocedures,aswellascriteriaandstandardsbywhichtheBoardofTrusteesreachesitsdeterminationsregardingfacultyhiringandqualifications,aredevelopedbytheDASGCinconsultationwithdistrictadministrators,theCollectiveBargainingAgent,andapprovedbytheSanMateoCountyCommunityCollegeDistrict(SMCCCD)BoardofTrustees.

TheEquivalency to MinimumQualificationsandFacultyServiceArea(FSA)processisintendedneithertoraisenortolowerstandardsfromtheminimumqualificationsestablishedforaposition,norisitintendedtograntwaiversinlieuofrequiredqualifications.

2.ESTABLISHINGMINIMUMQUALIFICATIONS

SMCCCDfaculty(FullorPartTime)mustmeetminimumqualifications.IdentificationoftheMinimumQualificationsforFacultyintheCaliforniaCommunityCollegesreliesprimarilyontherecommendationsoftheAcademicSenatefortheCaliforniaCommunityColleges(ASCCC)DisciplinesList,adoptedbytheBoardofGovernorsoftheCaliforniaCommunityColleges.Candidatesshallnotbeassignedorpermittedtostartworkuntiltheevaluationofminimumqualificationsor equivalency to minimum qualifications hasbeencompleted.

Where San Mateo County Community College District standards are higher than the state minimum.qualifications,thoselocalqualificationsshallprevail.

TheMinimumQualificationsforFacultyandAdministratorsinCaliforniaCommunityCollegesliststhosedisciplinestaughtintheCaliforniaCommunityCollegeSystemandtheminimumqualificationsrelatedtoeachdiscipline.

Therearethreetypesofminimumqualificationsassociatedwiththevariousdisciplines:

  1. Disciplinesrequiringamaster’sdegree
  2. Disciplines where a master’s degree is generally not available or expected but which requiresabachelor’sorassociatedegree
  3. Disciplineswhereamaster’sdegreeisnotgenerallyavailable.

Forinstructorsofnoncreditcourses,theminimumqualificationshallbethesameastheminimumqualificationsforcreditinstructionintheappropriatediscipline[TitleV,§53412].

Minimumqualificationsaredeterminedfordisciplines,notforindividualcoursesorsubjectareaswithindisciplines.Anapplicantiseitherqualifiedtoteachthefullrangeofcoursesinadiscipline or not,regardlessofwhetherapplyingforafull-­‐timeorpart-­‐timeposition.

LicensedorCertificatedOccupations

Inadditiontootherminimumqualificationsspecified,theminimumqualificationsforafacultymemberteachinganycreditornoncreditcourseshallincludeacurrent,validcertificatetoworkorlicensetopracticeinCalifornia,whenevertheinstructor'spossessionofsuchacertificateorlicenseisrequiredforprogramorcourseapproval[TitleV,§53417].

Alldegreesandunitsusedtosatisfyminimumqualificationshallbefromaccreditedinstitutions[TitleV

§53406]Post-­‐secondaryinstitutionsaccreditedbyanaccreditationagencyrecognizedbyeithertheU.S.DepartmentofEducationortheCouncilonPost-­‐secondaryAccreditation;nottomeananinstitution"approved"bytheCaliforniaDepartmentofEducationorbytheCaliforniaCouncilforPrivatePost-­‐secondaryandVocationalEducation.

ForeignEducationcompletedoutsideoftheUnitedStatesmustbedeemedequivalenttothatgainedinconventional/accreditedU.S.educationprogramstobeequivalent.Determinationofequivalency offoreigndegreesshallbeaccordingtodistrictpolicy. in order for it to be considered for the satisfaction of minimum qualifications. Foreign transcripts must be translated and evaluated by a U.S.-based credentials evaluation service. The District currently accepts evaluations from IERF and will consider evaluations from other agencies on a case-by-case basis

[TitleV,§53410].

§53410.MinimumQualificationsforInstructorsofCreditand Non-Credit Courses, ,Counselors,andLibrarians.

Theminimumqualificationsforserviceasacommunitycollegefaculty member teaching any creditand non-credit course,orasacounselororlibrarian,shallbesatisfiedbymeetinganyoneofthefollowingrequirements:

A.Possessionofamaster'sdegree,orequivalentforeigndegree,inthedisciplineofthefacultymember's assignment.

B.Possessionofamaster'sdegree,orequivalentforeigndegree,inadisciplinereasonablyrelatedtothefacultymember'sassignmentandpossessionofabachelor'sdegree,orequivalentforeigndegree,inthedisciplineofthefacultymember'sassignment.

C.Forfacultyassignedtoteachcoursesindisciplineswherethemaster'sdegreeisnotgenerallyexpectedoravailable,butwherearelatedbachelor’sorassociatedegreeisgenerallyexpectedoravailable,possessionofeither:

1.abachelor’sdegreeinthedisciplinedirectlyrelatedtothefacultymember’steachingassignmentorequivalentforeigndegreeplustwoyearsofprofessionalexperiencedirectlyrelatedtothefacultymember’steachingassignment;or

2.anassociatedegreeinthedisciplinedirectlyrelatedtothefacultymember’steachingassignmentorequivalentforeigndegreeplussixyearsofprofessionalexperiencedirectlyrelatedtothefacultymember’steachingassignment.

D.Forfacultyassignedtoteachcoursesindisciplineswherethemaster'sdegreeisnotgenerallyexpectedoravailable,andwherearelatedbachelor’sorassociatedegreeisnotgenerallyexpectedoravailable,possessionofeither:

1.anybachelor’sdegreeorequivalentforeigndegreeplustwoyearsofprofessionalexperiencedirectlyrelatedtothefacultymember’steachingassignment;or

2.anyassociatedegreeorequivalentforeigndegree plus six years of professionalexperiencedirectlyrelatedtothefacultymember’steachingassignment.

3.ESTABLISHINGEQUIVALENCYTOMINIMUMQUALIFICATIONS

Inthecasethatanapplicantor current faculty doesnot possess the exact minimum qualifications as stated in the Minimum Qualifications for Faculty in the California Community Colleges for the position towhichhe/sheisapplying,averificationproceduremustincludeaprocessfordeterminingwhen anapplicantforafacultyposition,thoughlackingtheexactdegreeorexperiencespecifiedintheapproveddisciplinelist,nonethelessdoespossess"qualificationsthatareatleastequivalent"[TitleV,§53430;EdCode,§87359]tothosespecified.Candidatesforalldistrictfacultypositionsandthosecurrentfacultymemberswhoaremakingapplicationstoserveinanacademicpositionoutsideoftheircurrentfacultyservicearea[s]willapplyforequivalence.

Thethreemeansofdemonstratingequivalencyto minimum qualifications are:

1.Degree Equivalence

  • Theemployeeorapplicantpossessesadegree(s)withsimilarcontenttothoselistedfortherelevantdiscipline.ThenameofthedegreeisclosetothatspecifiedontheDisciplinesListbut thedegreeeither hasadifferent titleor areaof expertiseor thecourseworkisslightlydifferent.

2.AcademicBackground Equivalence

i.RelatedtodisciplinesinwhichaMaster’sdegreeisnotgenerallyexpectedoravailable.Theemployeeorapplicantmusthavecompleted at least 24 semester units ofcourseworkintheacademicfieldandmustpossessatleasttheequivalentlevelofachievementandtheequivalentinbreadth,depthofunderstanding,andrigorineachofthefollowing:

ii.abroadculturaleducationusuallymetbythegeneraleducationrequirementsforanyBachelor’sorAssociate’sdegree,and

  • adetailedstudyofthedisciplineinbreadth,depth,andrigor,usuallymetbycourseworkrequiredforthedegreemajor.

3.Professional Achievement Equivalence

  • TheemployeeorapplicantmusthavecompletedtheGeneralEducationrequirementsforthatdegreeandshowevidenceofoutstandingprofessionalachievementand/orsubstantialtrainingintherequestedfield.Theemployeeorapplicantmustsubmitsubstantial evidence, which demonstrates that his/her preparation, teaching experience,workexperience,andabilityareequivalenttothoseexpectedfromapersonwhomeetstheminimumqualifications.

Theemployee or applicantor employee shallprovidesupporting documentation, such as official transcripts,credentials,licenses,certificates, employerattestations,publications, etc.whichwill validatetheequivalencyrequest. Verificationthat anapplicant meetsminimumqualifications(directlyor throughequivalency)willoccurpriortoconsiderationforemployment.Itshallbetheresponsibilityof theapplicanttoprovideHumanResourceswithacompleteapplicationandalldocumentation(transcripts,credentials,teachingexperienceandverificationofworkexperience)necessarytoevaluatetheirqualifications. This application will then be evaluated by the Faculty Qualification Committee (FQC).

TheFacultyQualificationsCommitteeshalldetermineappropriateequivalences.EachFacultyQualificationsCommitteewillbecomposedofthree full timefacultydisciplineexpertsone from each college andtheappropriatedean.Thedean’sresponsibilityistooverseetheprocessandisnotavotingmember.Thecompositionofthecommitteeshallvarydependingonthepositionthattheindividualisapplyingfor:

1.Applicantsforfull-­‐timefacultypositions,bothtenuretrackandtemporary;

2.Applicantsforpart-­‐timefacultypositions;

3.Or cCurrent faculty members applying for an FSA in a subject area other than the one(s) forwhichtheymeetsubjectarearequirements.

4.REVIEWANDREVISIONOFPOLICIES,PROCEDURESGUIDELINES

MinimumqualificationsarereviewedandmodifiedbyactionoftheStateAcademicSenateregularlyandattherequestofdisciplinefacultythroughtheirlocalSenateGoverningCouncils.TheSMCCCDpoliciesandproceduresregardingestablishingminimumqualifications and ,equivalency to minimum qualificationsies,andFSA’saresubjecttoreviewandrevisioneverythreeyearsormorefrequentlyifrequiredbyeithertheDistrictAcademicSenateortheBoardofTrustees.ChangesinthispolicyrequirethejointagreementoftheCollectiveBargainingAgentandtheBoardofTrusteesinconsultationwiththeDistrictAcademicSenate

ARTICLE14:LAYOFFS

14.1UNIONWILLBENOTIFIEDOFPOTENTIALLAYOFFS:Whenitisreasonablycertainthatfacultylayoffsaretoberecommendedinspecificareas,the Union will be notified of thecontemplatedactionandthereasonstherefore.ItisunderstoodthattheEducationCodeprohibitstheretentionofajunioremployeewhenamoresenioremployeewhoholdsanFSAandiscompetenttoperformtheserviceislaidoff.

14.4SENIORITYLISTSPROVIDEDTOTHEUNION:TheDistrictwillprovidetheUnionwithcurrentsenioritylistofcontractandregularemployees,whichwillincludetheemployee,theirworksite,andthecurrentFSA(s)onfile.AnychangeorrevisioninthesenioritylistwillbereportedimmediatelytotheUnion.Seniority,worksite,andFSAinformationmaybeprovidedthroughseparatelistsiftheDistrictsochooses.

ARTICLE19:PART-­‐TIMEEMPLOYMENT

19.1 SENIORITYLISTS:

EachDivisionorsimilarunitthatemployspart-­‐timeemployeeswillestablishasenioritylistbasedonthefirstpart-­‐timeemploymentatthespecificcollege.

19.1.1

Regularfacultywhoareassignedanoverloadwillbeincludedinthedivisional-­‐basedpart-­‐timesenioritylist.

19.1.2

Senioritylistsshallbeupdatedwithnewnamesand start dates that are added to the lists.Copiesofthelistshallbemadeavailabletofacultywhomakesucharequest.InadditionacopyofthesenioritylistsshallbeforwardedtoHumanResourcesbythedateofthefallandspringfirstcensus.

19.1.3

Ifabreakinserviceexceedsthreesemesters,thentheperson’snameistoberemovedfromthesenioritylist.Ifaparttimefacultymemberrequests,butisnotgiven,anassignment,itwillnotconstituteabreakinservice;however,ifthefacultymemberisnotgivenanassignmentafterrequestingitforaperiodoffiveconsecutivesemesters,theperson’snamewillberemoved fromthesenioritylist.

ARTICLE20:FACULTYSERVICEAREAS(FSA)

20.1FACULTYSERVICEAREAS:

FacultyServiceAreas(FSAs)intheSMCCCDwillcorrespondtotheDisciplinesListasapprovedbytheBoardofGovernors. Theterm“competence,”asrelatedtoFaculty Service Areas, will bedefinedasmeetingtheminimumqualificationsapprovedbytheBoardofTrustees.

  • FacultyQualificationCommitteeshallconsistofthreefull­‐timefacultydisciplineexpertsrepresentingthethreecollegesinthedistrict.Inaddition,adeanfromtherelevantdisciplineotherthantheapplicantshomecampus,andhastheprimaryresponsibilityto oversee theprocessandisnotavotingmember.Inthecase,wherethereareinsufficientfull-­‐timefacultydisciplineexpertstheAcademicSenatePresidenthastherighttoappointapart-­‐timefacultytoserveonthecommitteeaslongastheyhold the minimum qualifications. If there are caseswherethereisnofull-­‐timefacultythatpossestheminimumqualifications,thentheAcademicSenatePresidentshallseekoutsidefacultydisciplineexpertfromanotherCommunityCollege.
  • Theapplicationcoversheetwill includethenamesofcommitteemembers (faculty disciplineexpertsanddean)andthevote-­‐countofanyaction.Thevote -­‐countwillbefromONLYthethreefull-­‐timefacultycommitteemembers.TheDean’sprimaryresponsibilityistooverseetheprocedureandis anon-­‐votingmember.

3.APPLICANTSFORPART-­‐TIMEFACULTYPOSITIONS

TheapplicationforemploymentincludesquestionstoapplicantsaboutwhethertheypossesstheminimumqualificationsasspecifiedintheMinimumQualificationsforFacultyandAdministratorsinCaliforniaCommunityColleges,and,ifnot,whethertheywishtoapplyforequivalency. Itistheapplicant’sresponsibilitytoapplyforequivalency. Theapplicantapplyingforequivalencymustprovideconclusiveevidencetosupporthis/herrequest(officialtranscripts,credentials,licenses,certificates,employerattestations,publications,etc.),whichwillvalidatetheequivalencyrequest.

TheFacultyQualificationsCommitteeshallbecomposedoftheacademicmembers(alwaysapprovedbythecollege’sAcademicSenate)andtheappropriatedean. TheFacultyQualificationCommitteemustincludethreefulltimedisciplineexperts(onefromeachcollege)inthesamedisciplinetoserveonthereviewboard. Thisequivalencyprocessisintendedneithertoraisenortolowerstandardsfromtheminimumqualificationsestablishedforaposition,norisitintendedtograntwaiversinlieuofrequiredqualifications. WhereSanMateoCountyCommunityCollegeDistrictstandardsarehigherthanthestateminimumqualifications,thoselocalqualificationsshallprevail.

ThewrittenrecommendationofthisFacultyQualificationsCommitteewillbeforwardedtothecollegevicepresidentwhowill,withtheAcademicSenatepresident,makearecommendationtothecollegepresident. Uponconcurrenceofthecollegepresident,theequivalencerecommendationwillbeforwardedtotheBoardofTrusteesforconsideration. AcopyoftheBoardactionwillbeplacedintheemployee’spersonnelfile.

4.CURRENTEMPLOYEES

Currentfacultywillapplyforequivalencebyfilingan“EmployeeApplicationforEquivalencetoMinimumQualifications”formwiththeappropriatecollegevicepresident. TheVicePresident,inconsultationwiththeAcademicSenatepresident,willidentifythreefulltimedisciplineexperts(onefromeachcollege)inthesamedisciplinetoserveontheFacultyQualificationcommittee. Thesedisciplineexpertswillbefacultymembersrepresentingthethreecollegesinthedistrict. Thereviewcommitteewillincludethedeanoftherelevantdisciplinefromotherthanthefacultymember’shomecampus,andhastheprimaryresponsibilitytooverseetheprocessandisnotavotingmember.

Examples for formal academic equivalents to degrees might include:

Formal Education Equivalent to the Master’s degree:

Master’s degree in a related discipline as identified in the Disciplines List, including 18 semester units of upper division and/or graduate work in the discipline;

Formal Education Equivalent to the Bachelor’s degree:

At least 120 semester units, including 18 semester units representing a diversity of courses generally accepted as general education and, for disciplines that require a Master’s degree, 30 units in the discipline, of which 24 are upper-­‐division or graduate units.

Formal Education Equivalent to the Associate degree:

At least 60 semester units, including 18 semester units representing a diversity of courses generally accepted as general education.

Examples of establishing the equivalency of required experience. To establish this equivalency candidates should show possession of thorough and broad skill and knowledge for each of the following:

Mastery of the skills of the vocation thorough enough for the specific assignment and broad enough to serve as a basis for teaching the other courses in the discipline;

Extensive and diverse knowledge of the working environment of the vocation;

Completion of general education requirements.

Theequivalencyprocessisintendedneithertoraisenortolowerstandardsfromtheminimumqualificationsestablishedforaposition,norisitintendedtograntwaiversinlieuofrequiredqualifications.

  • Theequivalencyto minimum qualifications applicationformisattachedtothisprocessandisincludedintheonlineapplicationfor employment. Human Resources prepares the application in consultation withtheAcademicSenate.
  • Theequivalencyto minimum qualifications processshouldtakeplaceinatimelymanner,nolaterthantwoweeksfromsubmission date of the equivalency application .
  • The chair of the faculty selection screening committee will request a Faculty Qualification Committee as necessary
  • ThewrittenrecommendationoftheFacultyQualificationCommitteewillbeforwardedtotheappropriatevicepresident,whowiththeacademic senate president will make arecommendationtothecollegepresident.Uponconcurrenceofthecollegepresident,theequivalencyrecommendationwillbeforwardedtotheHumanResourcesOfficewhereitwillbetakentotheBoardofTrusteesforconsideration.AcopyoftheBoardactionwillbeplacedintheemployee’spersonnelfile.Allapplicantrecordsshallbeconfidential.

5.ESTABLISHINGFSA’SFORNEWHIRES

Followingacceptanceofajobofferbyacandidate,applicationmaterialsmaybesubmittedbythenewfacultymembertotheFacultyQualificationsCommitteeforconsiderationofassignmentofFSAsinadditiontotheprimaryassignment.

6.ESTABLISHINGFSA’SFORCURRENTEMPLOYEES

AnFSAapplicationmustbereceivedintheappropriateVPIorVPSSofficeonorbeforeFebruary15inordertobeconsideredasabasisforreassignmentintheeventofreductionsinforce,programdiscontinuance,and/orlackoffundingpursuanttotheprovisionsofEducationCode,duringthesubsequentacademicyear

UponreceiptofacompleteapplicationsandsupportingdocumentationtotheappropriateVicePresident’soffice(VPIorVPSS),theAcademicSenatepresidentwillidentifytheFacultyQualificationsCommittee(threefulltimedisciplineexpertsfromeachcollegeandapprovetheconstitutedFSAcommittee).TheVPwillidentifytheappropriatedeantoserveonthecommittee.

7.APPEALPROCESS:

Ifanapplicantforequivalencydisagreeswiththedecision,theapplicantmayappeal,bysubmittingnewwrittendocumentationorclarification,totheAcademicSenatepresident.Thisappeal must besubmittedwithintenworkingdaysaftertheapplicanthasreceivednotificationofthe committee’sdecision.TheapplicantmustsubmitawrittenstatementandevidenceexplainingnewmaterialtotheFacultyQualificationscommittee.Thecommitteewilldeliberateagainprivately,andthecommittee’sdecisionshallbefinal.Ifaunanimousdecisioncannotbereached,theequivalencyisnotgranted.TheAcademicSenatepresidentwillprovideawritten response to the applicant and the appeal processends.

8.FACULTYQUALIFICATIONCOMMITTEEGUIDELINES: Moved to #2

1.FacultyQualificationCommitteeshallconsistofthreefull-­‐timefacultydisciplineexpertsrepresentingthethreecollegesinthedistrict.Inaddition,adeanfromtherelevantdisciplineotherthantheapplicantshomecampus,andhastheprimaryresponsibilityto oversee theprocessandisnotavotingmember.Inthecase,wherethereareinsufficientfull-­‐timefacultydisciplineexpertstheAcademicSenatePresidenthastherighttoappointapart-­‐timefacultytoserveonthecommitteeaslongastheyhold the minimum qualifications. If there are caseswherethereisnofull-­‐timefacultythatpossestheminimumqualifications,thentheAcademicSenatePresidentshallseekoutsidefacultydisciplineexpertfromanotherCommunityCollege.

2.Theapplicationcoversheetwill includethenamesofcommitteemembers (faculty disciplineexpertsanddean)andthevote-­‐countofanyaction.Thevote-­‐countwillbefromONLYthethreefull-­‐timefacultycommitteemembers.TheDean’sprimaryresponsibilityistooverseetheprocedureandis anon-­‐votingmember.
