Background: The North Carolina protection and advocacy (P&A) system, providing advocacy and legal services to people with disabilities. P & A originated at Willowbrook State School from a class action lawsuit in New York. PAIMI Advisory Counsel (out of SAMHSA) works with Disabilities Rights (DR) to educate the public about DR purpose, issue targets, and activities.
Group exercise- William’s story: background was given and each group was assigned a specific role (Parents, DHHS, Agency, Provider, etc…). After reviewing William’s history, the groups decided how to assist this child according to where his needs fall. And who should be at the table helping with the decisions concerning treatment. Each group reported out.
A settlement agreement signed Oct. 14, 2016, between DR-NC vs DHHS. DR was asked to work collaboratively instead of suing DHHS and use an approach to help meet the need for those with DR. Although there were some changes that helped the current caseloads, it did not fix the system. The outcome in October was to file a complaint in the federal district court.
In the settlement agreement, children with complex needs were defined, services paid through EPSDT Early and Periodic Screening, Diagnostic and Treatment Services. Benefits must outweigh the cost of services. Kids with the waiver, it is easier to work with them because of the rehabilitative piece. Through their agreement settlement, there is 7 local management entities and MCOs administer services. To access HELP anyone who works with the child or is related to the child can call the local MCO to talk about whether the child may have complex needs. Under NC START, accessible through LME/MCO, there is a comprehensive program that provides community-based crisis prevention and intervention services for an individual with IDD and challenging behaviors. The children will get to stay in their home while being provided with this service.
There is an assessment pilot being conducted in several counties in NC and will begin in April 2017. By May 1, 2017, DHHS will offer training to providers that are dedicated to serving children with complex needs. Case management is a big part of this and it has been brought back to be offered to families in an attempt to keep children in their home. Topic: Revised CFT 1 rollout: CFT revision rollout will be happening and we have two locations currently where the training is being offered, Fayetteville and Asheville. Emails have gone out announcing the revised training. Originally, we had three locations, however, we need to schedule another date for the CFT in Dare County hopefully before the March Train the Trainer training.
