Regulations Concerning the Labor Protection of Female Staff and Workers

Issuance date: April 28, 2012
Synopsis:
According to the regulations, the maternity leave vacation has extended to 14 weeks( 98 days); Female employees whose pregnancy under four months of abortion should enjoy 15-day leave, whose pregnancy above four months of abortion should enjoy 42-day leave( 6 weeks). Those who have participated in maternity insurance may receive the maternity allowance from the maternity insurance fund on the base of the previous year average monthly wages in the company. Or, the company should pay the allowance on the base of the salary before the employees’ leave.
We call Shanghai Human Security Bureau for details and the fact is that the females who have a baby before April 28th will have 90-day leave and the others will have 98-day leave. The maternity allowance should be paid for 90 days.( Just for reference)
