Note: Contractor shall have its insurance company furnish Dundee Community Schools with an original proof of insurance certificate; directly by U.S. Mail. Copies or facsimiles are not acceptable.
INSTRUCTIONS TO BIDDERS
A mandatory walk-through will be held on Monday, April 3, 2017 at 1:00 p.m. Please meet at the Middle School North Parking Lot located at 420 Ypsilanti Street, Dundee, MI.
Dundee Community Schools, at their discretion, may elect (without penalty) to reduce or delete any scope of work at any location. Thirty (30) day notice of any such election shall be delivered to the selected contractor by the School District.
All licenses required by the State of Michigan, and/or the Village of Dundee, which is necessary to perform this work, must be obtained prior to the aware of contract. Bidders shall b licensed with the Michigan Department of Agriculture as a “Commercial Applicator” of chemicals necessary for the treatment of right of way pest control category 6.
This request for bid does not commit Dundee Schools to award a contract, to pay any costs incurred in the preparation of the proposal to this request, or to procure or contract for services. All proposals submitted in response to the bid shall become the property of Dundee Community Schools.
Dundee Community Schools reserves the right to reject any or all bids and or parts of any bid, and also the right to hold bids for up to sixty (60) days before action thereon. In awarding a contract, the School District has the right to consider all elements entering into the question of determining the responsibility of the Contractor.
Any bid, which is incomplete, conditional, and obscure, or irregularities of any kind may be cause for rejection of bid.
The proposer shall not subcontract any or all portions of the work.
The contractor shall comply with all published rules, regulations, directives, and orders of the Michigan Civil Rights Commission relevant to Section 206, 1976 P.A. 453, as amended.
In the case of any discrepancies, the subject shall be referred to the Dundee Community Schools for decisions and such decisions shall be binding; and without such decision, adjustment shall not be made by the Contractor save at his own risk.
For problems or deficiencies of significant importance or of a continual nature, a time period of compliance shall be established after discussion and mutual agreement. Failure of the Contractor to correct the deficiencies within the time period agreed upon shall constitute cause for determination of the services and/or withholding of payment. Dundee Community Schools reserves the right to terminate the contract without penalty upon thirty (30) days written notice due to poor performance or for reasons deemed to be in its best interest of the school district. A designated representative from Dundee Community Schools will be solely responsible for determining acceptable performance levels. His/her decision will be deemed in the School District’s best interest and will be final. Dundee Community Schools reserves the right to re-award the contract to the second most qualified proposal, re-bid the contract, or to whatever is deemed to be in the best interest of the School District.
Dundee Community Schools may modify the bid prior to the deadline for submission of proposals by issuance of an addendum to all parties who have been furnished the Bid for proposal purposes.
All work shall be done in compliance with all applicable Local, State and Federal laws, rules, regulations, zoning ordinance, as well as OSHA guidelines in effect at the time of the signing of the agreement.
Contractor’s employees must pass a complete state and federal background check prior to beginning any work at Dundee Community Schools.
INSURANCE REQUIREMENTS
The Contractor shall not commence work under this contract until he/she has obtained and submitted to Dundee Community Schools the insurance required under this paragraph. All coverages shall name Dundee Community Schools as certificate holders and shall be with insurance companies’ licensed and admitted to do business in the State of Michigan. All coverage shall be with insurance carriers acceptable to Dundee Community Schools.
1. Commercial General Liability Insurance: The Contractor shall procure and maintain during the life of the contract Commercial General Liability Insurance on an “Occurrence Basis” with limits of liability not less than $1,000,000 per occurrence and/or aggregate combined single limit, Personal Injury, Bodily Injury and Property Damage. Coverage shall include the following extensions: (A) Contractual Liability; (B) Products and Completed Operations; (C) Independent Contractors Coverage; (D) Broad Form General Liability Extensions or equivalent.
2. Motor Vehicle Liability: The Contractor shall procure and maintain during the life of this contract Motor Vehicle Liability Insurance, including Michigan No Fault Coverages, with limits of liability of not less than $1,000,000 per occurrence combined single limit Bodily Injury and Property Damage. Coverage shall include all owned vehicles, all non-owned vehicles, and all hired vehicles.
3. Workers’ Compensation Insurance: The Contractor shall procure and maintain during the life of this contract, Workers’ Compensation Insurance, including employer’s liability coverage, in accordance with all applicable statutes of the State of Michigan. Sole Proprietors, not subject to the Workers’ Disability Compensation Act of the State of Michigan, may submit a certificate of exemption from the state.
4. Additional Insured: Commercial General Liability and Motor Vehicle Liability Insurance, as described above, shall include an endorsement stating the following shall be Additional Insured: “Dundee Community Schools”, all elected and appointed officials, all employees and volunteers, commissions and/or authorities, and board members, including employees and volunteers thereof. This coverage shall be primary to the Additional Insured, and not contributing with any other insurance or similar protection available to the Additional Insured, whether other available coverage is primary, contributing or excess.
5. Cancellation Notice: Workers’ Compensation Insurance, Commercial General Liability Insurance and Motor Vehicle Liability Insurance, as described above, shall include an endorsement stating the following. “Should any of the above described policies be canceled before the expiration date thereof, the issuing company will mail 60 days written notice to the certificate holder named to the left.”
WORK HOURS AND SAFETY STANDARDS
Dundee Community Schools will allow a mowing schedule any day during daylight hours. Exceptions would include areas such as play grounds, practice fields, and other areas where students are present. No mowing shall take place in the presence of students, no exceptions. Dundee Community Schools offers flexibility in this regard, but will not allow students to come into contact with any mowing or weed removal equipment.
Contractor’s employees shall be especially aware of the large number of students at each location, and shall take all necessary precautions to safeguard their well-being.
Contractor’s employees shall follow all applicable safety standards including operating all equipment in conformance with the manufacturer’s operating instructions for each piece of equipment, and in compliance with OSHA and MIOSH standards and requirements.
Contractor agrees to comply with all federal, state, local laws, procedures and training requirements.
Precaution shall be exercised at all times for the protection of persons, (including employees) and property. The safety provisions of applicable laws, building and construction codes shall be observed. Machinery, equipment and all hazards shall be guarded or eliminated in accordance with applicable safety provisions.
Mower discharge shall at all times be aimed away from people, buildings, children, and vehicles. Mower Guards MUST BE used as intended at ALL times for safety. Discharge shall not be made into the streets.
Mowers, weed trimmers, and other equipment shall be properly maintained to operate at “normal” operating sound levels. Equipment that is generating excessive noise or is otherwise objectionable to the School District shall be discontinued from use, at the School District’s request, until repairs can be affected. The School District’s Administration shall be the sole judge of acceptable equipment under this section.
SCHOOL DISTRICT PROPERTY
Wherever any existing material, equipment or facility is damaged by the Contractor, the cost of repair or replacement shall be charged to the Contractor. Items covered by this provision include, but are not limited to curbs, sidewalks, lawns (to include scalped areas), plantings, trees, shrubs, signs, down spouts, fences, light poles, mailboxes, and refuse containers.
Injuries to any person and damage to School property, the property of employees, customers, or any property not belonging to the Contractor shall be reported immediately to the School District Administration. Any costs for this damage or injury will be reimbursed by the Contractor.
Repair work due to damages caused by the Contractor shall be coordinated through, and subject to the approval of the School District’s Administration. Repairs shall be made with like materials in a manner acceptable to the School District’s Administration.
The Contractor shall acquaint themselves with the locations of utilities, which may be encountered or be affected by their work, and shall be responsible for damage caused by neglect to provide proper precautions or protection.
The Contractor shall repair to its original state, any landscape damage by failure to provide proper and adequate protection, to the satisfaction of the School District’s Administration, or remove and replace with new materials or planting at the Contractor’s expense.
The School District, respectfully, at their discretion, may conduct site inspections before, during, and after each service to evaluate the quality, and completion of the work performed by the Contractor.
The Contractor shall defend, indemnify and hold Dundee Community Schools harmless from any and all loss, obligations, claim, liability, settlement, payment, award, judgment, fine, penalty, interest, charge, expense including costs of suit and reasonable attorney’s fees and disbursement, damages or deficiency, or other charges incurred or required to be paid due to any claim resulting from the Contractor’s negligence or willful misconduct in the performance of this agreement (or final agreement).
