A RESOLUTION TO ACCEPT THE CERTIFICATE OF DEDICATION FOR

SUBDIVISION IMPROVEMENTS FOR SOUTHRIDGE AT

JOCKEY’S RIDGE SUBDIVISION SECTION IV

WHEREAS; on September 17, 2002, the Planning Board conditionally approved the final subdivision plat for Southridge At Jockey’s Ridge Subdivision Section IV with the following two (2) conditions:

1. The applicant shall execute a 20-foot easement agreement and cash surety in the amount of 125 percent of the cost of waterline construction pending the resolution of a property dispute upon which a 20-foot waterline easement serving the proposed development is located with such terms and conditions as recommended by the Town Attorney in a memorandum to the Planning Director dated September 17, 2002; and

2.The subdivider shall be listed as a principal on the required bond for road improvements AND

WHEREAS, on ------the subdivider complied with the Planning Board’s above conditions of final plat approval and

WHEREAS, on ------the Public Works Director approved the final construction of all streets in the Southridge at Jockey’s Ridge Subdivision Section IV and the subdivision’s water main improvements including one-inch water taps, a water main, and five (5) fire hydrants; AND

WHEREAS, the subdivider has paid Dominion North Carolina Power the necessary costs associated with the five (5) street lights to be installed in the Southridge At Jockey’s Ridge Subdivision Section IV

NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the Town of Nags Head in accordance with Section 18-33 (f) of the Town Code accepts the dedication for maintenance of Vansciver Drive, Ridgeview Way, Tamarac Court, Sea Bass Court, and Mariners Way as public streets and further accepts the dedication of five (5) fire hydrants; water main improvements, and five (5) street lights to be owned in accordance with the attached Certificate of Dedication. Acceptance of the five (5) fire hydrants, water main improvements, and five (5) street lights shall immediately vest complete ownership of that item in the town or its duly authorized public utility authorities, as appropriate.
