Recommendation:
  1. That approval be given to enter into a Special Event Agreement with Telus Communications Inc., for the purpose of supporting the 1999 Telus Edmonton Open, in accordance with the terms and conditions contained in Attachment 1. The Special Event Agreement shall be acceptable in form to the Law Branch of the Corporate Services Department and in content to the General Manager of the Community Services Department.
  2. That approval of the Special Event Agreement shall include the approval of such corrective, conformance and incidental amendments to its form and content as necessary or desirable to give effect to, or implement the Special Event Agreement, and as may be subsequently approved by the General Manager of the Community Services Department.

Report Summary

·  This report recommends that The City of Edmonton enter into a Special Event Agreement with Telus Communications Inc. regarding the use of Wm. Hawrelak Park in support of the 1999 Telus Edmonton Open. This golf tournament will be held at the Mayfair Golf and Country Club from July 1-4, 1999.

·  Telus Communications Inc. has requested the use of Wm. Hawrelak Park in support of the hosting of the 1999 Telus Edmonton Open. The request is specific to five main items:

  1. Creation of the main public entrance to the Mayfair Golf and Country Club from the north end of Wm. Hawrelak Park;
  2. The operation of a “Park and Ride” service into Wm. Hawrelak Park during the Tournament;
  3. Establishment of a temporary driving range in Wm. Hawrelak Park;
  4. Operation of a temporary concession during the Tournament in Wm. Hawrelak Park;
  5. The restriction of public vehicular access into the Park between the hours of 7:00 a.m. and 6:00 p.m. each day of the Tournament (July 1-4, 1999).

Non vehicular public access to the Park will be maintained at all times.

Legal Implications

·  If the recommendation is approved, the City of Edmonton will enter into a Special Event Agreement with Telus Communications Inc. as per the terms and conditions outlined in Attachment 1.

Justification of Recommendation

·  This Agreement will serve to clarify the responsibilities of Telus Communications Inc. and the City of Edmonton and specify the conditions under which Wm. Hawrelak Park may be used in support of the 1999 Telus Edmonton Open.

Terms and Conditions

  1. The term of the Agreement shall be from June 28, 1999 to July 7, 1999 or such greater period of time as approved by the General Manager of the Community Services Department (the “Term”).
  2. Vehicular traffic may be restricted at the entrance gate to Wm. Hawrelak Park to those vehicles displaying proper accreditation, as issued by the Telus Edmonton Open. Access may be restricted from July 1-4, 1999 from 7:00 a.m. to 6:00 p.m. each day. Vehicles displaying proper City of Edmonton identification will be permitted access at all times.
  3. The Telus Edmonton Open will work with the Community Services Department and the organizer of the Canada Day 15 km Road Race to ensure the operation of the road race is not negatively impacted.
  4. Park and Ride service will be established by Edmonton Transit, at the expense of Telus Communication Inc., into Wm. Hawrelak Park each day. This service will operate from the University of Alberta for park users and golf patrons.
  5. The installation of a temporary driving range will be permitted. The installation schedule, location and operation will all be completed in consultation with the Community Services Department. All costs, including the installation, maintenance and operation of the range, as well as all repair and replacement costs, will be the responsibility of Telus Communications Inc.
  6. The establishment of a public access gate from Wm. Hawrelak Park into the Mayfair Golf and Country Club will be permitted. All costs associated with the establishment of the gate and any required repairs to the Park will be the responsibility of Telus Communications Inc.. Final design and installation methods are subject to approval of the Community Services Department. The fence will be returned to a condition approved by the City of Edmonton.
  7. The establishment of a temporary concession, a volunteer centre and an admissions tent will be permitted. All required permits and licenses must be obtained. The sale and/or consumption of alcohol in Wm. Hawrelak Park will not be permitted.
  8. The City of Edmonton will receive appropriate recognition for its contributions to the 1999 Telus Edmonton Open, in the same manner that all other in-kind sponsors are recognized.
  9. All liability claims that may arise from the staging of the 1999 Telus Edmonton Open will be the sole responsibility of Telus Communication Inc. Telus Communication Inc. is to maintain in full force and effect comprehensive, general public liability insurance of not less than two million dollars ($2,000,000), per occurrence.
  10. This Special Event Agreement shall be in a form acceptable to the Law Branch, Corporate Services Department, and in content acceptable to the General Manager, Community Services Department. This Special Event Agreement may be amended by the General Manager, Community Services Department, for the purpose of carrying out this action.
