Ifyouthinkadecisionmadebythe NationalDisabilityInsuranceAgency(NDIA)aboutyouiswrong,youcansubmitanapplication forinternalreviewof a decision.Anypersondirectlyaffectedbya decisionofthe NDIA canrequestsucha review.

Thereisalistofreviewabledecisionsinthelegislation.Many decisionsmadebytheNDIAare reviewable,includingthingslikebeingacceptedasaparticipant, the provisionofreasonableandnecessarysupports,andbecomingaregisteredproviderofsupports.

Whenyouaretoldabout an NDIAdecision,youwillbetoldhowtorequestaninternalreview.A request for internalreview ofadecisionmustbemadewithinthree monthsofreceivingnotice ofthedecision fromtheNDIA.

Thestaffmemberwhoworksontheinternalreviewwillnothavebeeninvolvedintheearlierdecision.Theymay wantto talkto youdirectlyaspartofthisprocess.

Whathappensnext?

TheNDIAstaffmember responsiblefor theinternalreviewwillmakea decision toconfirm,varyorsetasideandsubstitutetheearlierdecision.Thisdecisionwillbemadeassoonasreasonablypracticable.

Whatifyouarestilldissatisfiedaftertheinternalreviewofthedecision?

Ifyouarestillnothappyafter theinternalreviewofthedecision,youcanapplyforareviewbythe AdministrativeAppealsTribunal(AAT), atribunalthatexistsoutsidethe NDIA.

YoucannotasktheAATtoreviewa decisionbythe NDIAuntil the decisionhasbeeninternally reviewedbytheNDIA.
