Rules for storing your water sports and ancillary equipment

at Toward Sailing Club

Introduction

Toward Sailing Club’s (TSC) aim is to encourage people of all ages and abilities to actively participate in a number of water sports. Keel boat and dinghy sailing, power boats, sea kayaking, wind surfing and other paddle sports are all enjoyed by members of the club. Members of the club can apply to have their equipment stored on club premises provided the rules regarding storage are followed. Members must apply each summer and/or winter period as applicable and it should not be assumed that the club will agree to continue to store the equipment or in the same place from year to year. The contract with the club is for that period only. Storage is available on application for either the boat store, the caged area below the clubhouse or outside storage. Places will be allocated by the Board of Trustees or their delegates.

The space available at TSC is limited and the club is not in a position to store equipment that is not in active use and in a sea-worthy or road-worthy condition for a number of reasons.

·  Limited space at TSC means potential active members of the club may be lost.

·  Equipment that is in poor condition poses a risk to others using the facilities

·  We may need to move equipment for safety or ground maintenance purposes

·  Equipment that is abandoned or in a state of disrepair is unsightly giving the wrong impression to the public, visitors and potential members

Storage Rules – Boats referred to in these rules include ALL water craft and surf equipment.

1.  Boats stored at TSC must be in a sea-worthy condition

2.  Boats and equipment must be insured to the agreed minimum as indicated on current membership documents

3.  All trailers must be fit for purpose

4.  Fuel must not be stored in any boat in unauthorised containers

5.  All equipment must be kept in a safe, clean, and tidy manner.

6.  Boats or trailers not properly maintained and not in use during the summer season will not be authorised for further storage and the owner will be asked to move them within one month of the date of the notification.

7.  The correct and full storage fees must be paid by the date agreed on the application form.

8.  A member who sells their boat must inform the Board of the new owners contact details including name and address. Storage is for members only.

9.  Members must undertake to move equipment when requested for safety or ground maintenance purposes by the date given on the notice.

10.  Members can apply to the Board for exemption, for a limited period, from any of these rules due to exceptional circumstances

Abandoned Boats/Equipment

Boats, trailers and equipment will be classed as abandoned or unauthorised in the following circumstances:

1.  Non-payment of fees. Membership and storage fees must be paid in full by the date agreed on the invoice including any financial penalties for late payments. The club will take all reasonable steps to contact the member and make them aware of the money owed. A final notice will be issued to the member. Members failing to pay by the date given on the final notice will be issued with a Notice of Obligation to Collect Goods from TSC premises by the date given on the Notice.

2.  Failure to remove any equipment refused storage under rule 6 above. Members failing to remove their equipment will be issued with a Notice of Obligation to Collect Goods from TSC premises by the date given on the Notice.

3.  Failure to inform the club or a change of ownership. Full information on the new owner must be given as soon as possible after the sale. The club will take all reasonable steps to try and contact the new owner at the beginning of the new payment period.

4.  Failure to move equipment when requested under rule 9. Any member failing to do this by the agreed date must accept that the club can move their equipment for safety or ground maintenance.

Once boats or ancillary equipment have been classed as abandoned the Police will be informed as per the law in Scotland and steps taken to dispose of the goods under their guidance.
