1. SCOPE

The Department of Fish and Game, Massachusetts Division of Marine Fisheries (MDMF) is soliciting proposals from qualified engineers to perform all preconstruction and necessary services during construction for the proposed handicapped accessible shore-fishing pier and associated parking to be located at the Massachusetts Water Resource Authority (MWRA), Deer Island Facility located at Taft Avenue, Deer Island, Boston, MA.

The work at the aforesaid location shall consist of all survey, engineering, including geotechnical engineering, design, permitting, preparation of construction bid documents and services during construction.

Please note, an Activity and Use Limitation has been issued by the DEP, Bureau of Waste Site Cleanup for lots 4 & 5 (release tracking number 3-1283) and has been recorded at the Suffolk County Registry of Deeds on April 3, 2001, instrument # 391 and 411.

The initial contract duration is for two years with an option to renew for one additional year.

6. EXPENDITURES/PAYMENTS

Payments will be made based on the cost/task completed. Refer to section 8 for, outline of required tasks. Invoices shall be submitted indicating the cost for each required task, the cost of each required task completed, the cost of pre-approved reimbursable costs, total of previous invoices and the total due for this invoice

7. CONTRACT SPECIFICATIONS

Work shall include all necessary tests, topographic and hydrographic survey, preliminary and final designs and all ancillary work etc. including preliminary and final cost estimates of the aforementioned. The work must also include all plans, specifications, estimates, all engineering calculations, designs, permits, licenses and meetings with local, state and federal authorities and all preconstruction requirements associated with said project including services during construction other than resident engineering. Costs associated with filing fees, abutter notification and recording costs shall be paid by the consultant and will be reimbursed by the MDMF. Geotechnical boring investigation will also be reimbursed by MDMF. The cost of mailing except as noted, reprographics, travel expenses will not be reimbursed.

Work shall be broken down into the following tasks.

Task 1 – Survey and Data Collection

Perform topographic and hydrographic survey, including wetland resource area and eel grass delineation. Collect and review all data and resource information on record for the project. Consultation and coordination with MWRA shall include but not be limited to researching and obtaining underground and overhead utilities. Work shall include a site evaluation of the existing conditions and review of the project requirements of the MDMF.

Task 2 - Design Development

Preliminary plans and cost estimates including options shall be submitted to the MDMF for review and approval before proceeding with final plans. Perform engineering calculations, including geotechnical engineering and evaluation and proposed development plan.

Task 3 - Permitting

After approval of the proposed development plan by the MDMF, prepare and file the Notice of Intent with the local Conservation Commission and attend meetings (assume 3 meetings) to secure the Order of Conditions. Upon receipt of the Order of Conditions prepare and file all documents to obtain approvals from the U.S. Army Corps of Engineers, DEP Ch. 91 License and Water Quality Certificate, Coastal Zone Management Certificate and MEPA Certificate. Record all documents required with the County Registry of Deeds.

Task 4 – Contract Documents

Upon completion of the permitting phase of the project, final plans, cost estimates, design calculations, quantity take-offs and technical specifications shall be submitted for review and approval. General design methodologies shall follow the requirements of the U.S. Army Corps of Engineers Shore Protection Manual (1984) and the Coastal Engineering Manual. Technical specifications shall follow the format established by Massachusetts Department of Highway, Standard Specifications for Highways and Bridges. MDMF will administer the competitive bid process and will solicit and procure bids on behalf of the Commonwealth of Massachusetts. The vendor shall submit stamped .pdf’s of the final approved contract drawings to MDMF.

Task 5 – Construction Services

Services shall include submittal and shop drawing review, interpretation of plans and technical specifications and site visits (minimum of 4 site visits). Resident engineering services and contract administration will be the responsibility of the MDMF.

8. SUBMISSION REQUIREMENTS

A. A brief outline describing how the project will be developed and monitored, including a time frame for specific tasks and overall completion.

B. Lump Sum costs for performing all services with an estimated cost per task. Tasks shall be as follows:

C. Qualifications of key personnel to be used in conjunction with this project.

D. Listing of experience in the type of work contemplated by this proposal including both overall experience and projects (specific) completed in Massachusetts. Provide the names, addresses and phone numbers of representing clients for recent similar projects.

E. Each firm should make an independent investigation of the proposed project before submitting a proposal. It is required that two (2) proposals shall be submitted to the Massachusetts Division of Marine Fisheries, 1213 Purchase St., New Bedford MA 02740 by Tuesday November 17, 2015 at noon. The proposal shall be submitted in a sealed envelope marked “BID: Sport-fishing Pier, Deer Island Boston, MA, ”RFR-DMF-16005”

F. Complete the enclosed Bidder’s Cover Sheet and Checklist.

G. Submit the forms listed under section 10. Forms.

H. The Vendor and all subcontractors shall conform with the following insurance requirements;

INSURANCE REQUIREMENTS FOR DESIGN CONTRACT

1.1 General.

1.1.1 Each policy of insurance required by this Agreement shall contain a provision that the insurance provided therein may not be canceled or restricted without thirty (30) days prior written notice to the Division of Marine Fisheries (“DMF”) and Office of Fishing and Boating Access (“OFBA”) within the Massachusetts DFG of Fish and Game (collectively referred to as “DFG”) and the Massachusetts Water Resources Authority (“Authority”).

1.1.2 The Consultant shall provide the DFG and Authority with certificates satisfactory to them concerning the effectiveness and the specific terms of the insurance required by this Agreement. Failure to provide and continue in force any insurance required by this Agreement shall be deemed a material breach of this Agreement for which the DFG, at its sole discretion, may terminate this Agreement immediately or on such other terms as it sees fit.

1.2 Professional Liability Insurance Coverage. The Consultant shall carry professional liability insurance coverage for negligent acts, errors and omissions in an amount of not less than One Million Dollars ($1,000,000.00), with such deductible as the DFG, in its sole discretion, may allow. Such insurance shall extend to the Consultant and to its legal representatives in the event of death, dissolution or bankruptcy, and shall cover the negligent acts, errors and omissions of the Consultant's agents, subcontractors and employees and the liabilities assumed under this Agreement. Such insurance shall extend to any negligent act, error or omission in the performance of services under this Agreement committed or alleged to have been committed by the Consultant, its agents, subcontractors, or employees, or any other person or entity for whom the Consultant is responsible. Such coverage shall be in effect from the date services are first provided under this Agreement and shall be maintained in force until the later of (i) the completion of the Consultant's services under this Agreement or (ii) official acceptance of the Project by the DFG; and, provided that such insurance is generally available, shall be maintained for an additional period of six (6) years after the later of (i) the completion of the Consultant's services under this Agreement or (ii) official acceptance of the Project by the DFG.

1.3 Worker's Compensation and Other Insurance. The Consultant shall carry insurance furnishing benefits in accordance with Chapter 152 of the Massachusetts General Laws or such other worker's compensation requirement as may pertain, including Jones Act coverage where applicable. The Consultant shall carry insurance for General Liability in an amount of at least $1,000,000 per occurrence and in the aggregate and Business Automobile Liability insurance with a combined single limit of $1,000,000. If any operations require the use of watercraft the Contractor shall carry Marine Liability insurance in an amount of not less than $5,000,000.

1.4. The DFG and the Authority shall be named as additional insureds on policies for General, Auto, and Marine Liability insurance.
