Special Meeting – October 4, 2006

MINUTES

The School Board of St. Lucie County held a special meeting in the School Board Room on October 4, 2006 at approximately 5:30 p.m.

HEARING DISPOSITIONS – EXPULSION

Vice Chairman Carvelli called the meeting to order. Superintendent Lannon informed the Board that there were no student withdrawals in lieu of expulsion to be read into the record at this time.

RECOMMENDED ORDER #1

Recommended Order #1 pertained to a 15 year old (DOB/08-07-90) student from Delaware Avenue School who was charged with a violation of the Student Code of Conduct, Level G3, Intimidation/Threat (2005-06 SY Code charge).

The student was given a due process hearing before a hearing officer on August 30, 2006however; neither the student nor a representative appeared for the hearing. A written summary of this hearing was provided for the Board and the student’s parents. The recommendation for expulsion was reviewed by the Placement Review Committee on which the Exceptional Student Education Department is represented. The Committee recommended that expulsion proceedings continue.

The principal recommended that the student be expelled for the remainder of the 2005-06 school year and the entire 2006-07 school year. The superintendent recommended that expulsion proceedings be continued and that the petition for expulsion be held in abeyance with a probationary assignment to an alternative ed program for the remainder of the 2006-07 school year.

Action:There was a motion to continue the expulsion proceeding, to hold

the petition for expulsion in abeyance,and to give the student

a probationaryassignment to an alternative ed program for the

remainder of the2005-06school year and the entire 2006-07

school year(Miller/Hilson/Carried 3-0).

Neither the student nor a representative appeared for the hearing. The hearing was scheduled for 5:30 p.m. The Board waited until 6:00 p.m. before beginning the hearing.

RECOMMENDED ORDER #2

Recommended Order #2 pertained to a 14 year old (DOB/11-08-91) at Fort Pierce Central High School who was charged with a violation of the Student Code of Conduct, T4, Weapons Possession.

The student was given a due process hearing before a hearing officer on September 25, 2006 and was represented by his Grandmother. A written summary of this hearing was provided for the Board and the student’s parents. The recommendation for expulsion was reviewed by the Placement Review Committee on which the Exceptional Student Education Department is represented. The Committee recommended that expulsion proceedings continue.

The principal recommended that the student be expelled for the remainder of the 2006-07 school year. The superintendent recommended that the Board expel the student for the remainder of the 2006-07 school year.

Action:There was a motion to expel the student for the remainder of

the 2006-07 school year(Miller/Hilson/Carried 3-0).

Neither the student nor a representative appeared for the hearing. The hearing was scheduled for 5:40 p.m. The Board waited until 6:10 p.m. before proceeding with the hearing.

RECOMMENDED ORDER #3

Recommended Order #3 pertained to a 17 year old student (09-12-88) at Fort Pierce Central High School who was charged with a violation of the Code of Student Conduct, M4, Inciting/Leading/or Participating in a Major Student Disorder.

The student was given a due process hearing before a hearing officer on September 14, 2006 and was represented by his parent. A written summary of this hearing was provided for the Board and the student’s parents. The recommendation for expulsion was reviewed by the Placement Review Committee on which the Exceptional Student Education Department is represented. The Committee recommended that expulsion proceedings continue and that the petition for expulsion be placed in abeyance and that the student receive a probationary assignment to an alternative education program for the remainder of the 2006-07 school year.

The principal recommended that the student be expelled for the remainder of the 2006-07 school year. The superintendent recommended that the Board continue the expulsion proceedings, that the petition for expulsion be held in abeyance and that the student be given a probationary assignment to an alternative education program for the remainder of the 2006-07 school year.

Action:There was a motion to continue the expulsion proceedings, that the

petition for expulsion be held in abeyance and that the student be

given a probationary assignment to an alternative education program

for the remainder of the 2006-07 school year (Miller/Hilson/

Carried 3-0).

The student and his mother were present for the hearing and were given the opportunity to make a statement.

RECOMMENDED ORDER #4

Recommended Order #4 pertained to a 14 year old student (DOB/08-07-92) at Forest Grove Middle School who was charged with a violation of the Code of Student Conduct, C4, Assault/Intimidation/Threat of Employee.

The student was given a due process hearing before a hearing officer on September 20, 2006 and was represented by her parent. A written summary of this hearing was provided for the Board and the student’s parents. The recommendation for expulsion was reviewed by the Placement Review Committee on which the Exceptional Student Education Department is represented. The Committee recommended that expulsion proceedings continue.

The principal recommended that the student be expelled for the remainder of the 2006-07 school year. The superintendent recommended that the Board expel the student for the remainder of the 2006-07 school year.

Action:There was a motion to expel the student for the remainder of

the 2006-07 school year(Hilson/Miller/Carried 3-0).

Neither the student nor a representative appeared for the hearing which was scheduled for 6:10 p.m. The Board waited until 6:20 p.m. before proceeding with the hearing.

Following disposition of the expulsion hearings scheduled to come before the Board, Vice Chairman Carvelli adjourned the October 4, 2006 special meeting at approximately 6:25 p.m.
