Belmont HOA Cabana Rental Agreement: Terms and Conditions

The purpose of this Agreement is to specify rules and conditions for the rental of the Belmont HOA cabana. By signing this Agreement you are subject to the terms written herein. Any violation of the Agreement will result in the loss of your deposit, and cabana use privileges will be suspended indefinitely, subject to Board reinstatement.

1.RESERVATIONSare on a first-come, first-served basis and must be made at the management company office. Current picture ID showing Belmont HOA address or proof of ownership is required. Absent Belmont HOA Board of Director (the “Board”) approval, only Belmont homeowners or their documented renters (“Cabana Renters”) may reserve the cabana. Moreover, the cabana may not be rented to anyone who is not current with all other HOA fees or who is in violation of any of the HOA Rules and Regulations.

2.CANCELLATION OF RESERVATION. If you must cancel an event, please contact GM Management as soon as possible so the date will be open for someone else who may which to rent the clubhouse.

3.RENTAL / CLEANING FEES / DAMAGE / SECURITY DEPOSIT: : A DAMAGE / SECURITY DEPOSIT of one-hundred dollars ($100.00) (“Deposit”) must be paid at the time of reservation with a check or cashier’s check -- not with cash. If a Cabana Renter ‘s HOA account is not current and he or she wishes to bring it so in order to reserve the Cabana, those monies are also due at the time of the reservation with a check or cashier’s check.. IMPORTANT NOTE: All or part of the Deposit will be returned only once it has been determined (in the sole discretion of the Board and/or its management company) whether or not there have been any violations of this agreement. Absent extraordinary damage or investigation issues, this process generally takes one week.

4.DAMAGES: The burden of proof is on the Cabana Renter to report any existing damages to the cabana PRIOR to the rental period. Report damages to GM Management Inc. (805) 526-0303. Any damages unreported prior to rental, but noted in subsequent inspections, will be charged to the most recent Cabana Renter(s). This includes both monies being subtracted from the Deposit or a forfeiture of the Deposit and invoicing to the Cabana Renter for any resulting damage caused that costs more than the Deposit to repair.

5.OCCUPANCY IS LIMITED TO 30 PERSONS. One responsible adult over 21 years old must be present for every 10 minors under the age of eighteen in attendance. The Cabana Renter is responsible for all persons attending the event whether invited or not. In no event shall more than 30 people be permitted within the cabana for an event.

6.ALCOHOL IS NOT PERMITTED at any cabana event. If alcohol is found, the event will be immediately terminated and no refund of the Deposit will be provided to the Cabana Renter.

7.RENTAL HOURS.Because the cabana is in a residential neighborhood, no event may begin earlier than 9:00 AM. Events must be over by 10:00 PM. The cabana must be cleaned up (as noted in the Agreement documents) and everyone gone by 10:00 P.M. except by the express written consent of the Board . Groups not out by 10:00 PM. are subject to the loss of their Deposit.

8.AREA RENTEDFor purposes of this rental agreement, the area covered consists of the interior of the cabana only. Under no circumstances is the Cabana Renter allowed to congregate in front of the clubhouse or use the pool area. This rental agreement DOES NOT PERMIT THE CABANA RENTER AND HIS OR HER GUESTS TO EXCLUSIVELY USE THE POOL, POOL DECK OR ANY OTHER AREA APART FROM THE INTERIOR OF THE CABANA ITSELF. The cabana front door is to remain unlocked at all times during the event. The pool gate and bathroom doors are to remain closed and locked at all times.

9.DECORATIONScausing holes, removing paint or other damages are not allowed and will result in the loss of the Deposit and an invoicing to the Cabana Renter for any resulting damage caused that costs more than the Deposit to repair.. All decorations including fasteners used to hang decorations must be removed prior to receiving the Deposit back.

10.NOISE CURFEWS. Because the Clubhouse is located in a residential neighborhood, noise must be kept to a minimum DURING THE RENTAL PERIOD. Keeping the cabana doors and windows closed helps contain noise, but it does not eliminate it from annoying our neighbors. Music must be kept low and all music must stop by 10:00 PM when the Cabana rental period ends. Live bands are not permitted.

11.AFTER THE EVENT: The cabana is a SHARED SPACE. Other potential Cabana Renters may want to use it on the same weekend or quick turnaround period, therefore it is REQUIRED that the Cabana Renter do the following AT THE CLOSE OF THE EVENT ON THE DAY OF THE RENTAL:

(a) Remove all personal belongings and decorations.

(b) Remove and dispose of all trash from the site – this DOES NOT mean placing the trash in receptacles within the pool or pool deck areas.

(c) Wipe clean all chairs

(d) Wipe clean all tables, counters, and appliances.

(e) VACUUM THE FLOOR

(f) Turn off all lights as well as the heating and air conditioning timer.

(g) Lock doors and windows.

We, the Board of Directors of Belmont HOA, reserve the right to enter, and terminate, if necessary, your activity if we receive any complaints about excessive noise or misuse of alcohol, facilities, or grounds.

I, THE UNDERSIGNED, AGREE THAT THE ABOVE INFORMATION IS CORRECT. I HAVE READ THE RENTAL INFORMATION SHEET AND AM FULLY AWARE THAT I ALONE AM RESPONSIBLE FOR ANY LOSSES, DAMAGES OR MISCONDUCT WHICH MAY BE INCURRED BY MYSELF OR ANY OF MY GUESTS. I AM AWARE THAT I MUST REPORT ALL DAMAGES AND THAT ALL PERSONAL ITEMS AND DECORATIONS ARE TO BE COMPLETELY REMOVED WHEN I AM FINISHED WITH MY EVENT. MY DAMAGE DEPOSIT WILL BE RETURNED ONLY AFTER ALL HAS BEEN COMPLTED ACCORDING TO THE RENTAL AGREEMENT AND THE CLUBHOUSE IS LEFT IN SATISFACTORY CONDITION. THIS IS GENERALLY A WEEK AFTER THE EVENT. I AM AWARE THAT ANY DAMAGES TO THE FACILITIES THAT EXCEED THE AMOUNT OF THE “DEPOSIT” WILL BE BILLED TO THE HOMEOWNER. THIS WILL BE UP TO THE FAIR JUDGMENT OF THE BOARD OF DIRECTORS .
