Themes
Communication (could work for either side):
Pl: Coach Dempsey did not check up with Mia nor inform Casey Perez of Mia’s injury at Monday’s practice
Def: Mia withheld symptoms from all but Chris Durant
Not just Mia's failure to communicate, but also O'Reiley's, Mr/Ms Perez, and Durant.
Team work requires communication / Def’s depended on Mia to communicate
"This is a case about a playing field that was far from level...when all of the information is not shared, someone loses."
This is a case about showcases: (college showcase); (showcasing the Rubicon Soccer Club as "winners");and showcasing that the Rubicon Soccer Club is irresponsible, _____ and _____ .
Expectations; responsibility (applies to both sides)
Duty of care (comparative negligence): Rubicon et al owed duty of care to Mia; Mia owed Rubicon honest communication about her symptoms
Misplaced priorities: This is a case of undisputed facts vs. excuses. The undisputed facts prevail
Indifference to student safety
Pl: Defendants wanted to win at all costs… and Mia Perez paid the price (OR
safety paid the price.)
Goals (play on word “goal”).
Rubicon had three expressed goals: 1) train elite athletes in soccer to improve their skills and enhance chance for college scholarships; 2) gain notoriety for their club thru outstanding play on the field, and 3) keep club members safe from injury.
Unfortunately, Rubicon achieved only two of those stated goals. Because of Rubicon’s gross negligence, it never came close to achieving the third goal. Repeatedly, Rubicon kicked the ball representing SAFETY out of bounds, by (1) failing to heed warnings, (2) failing to pay attention to medical release forms, and (2) failing to be educated in concussion safety as they were with ACL and dribbling skills.
PL: RECIPE FOR DISASTER
DEF: CRYSTAL BALL, DEF’S WERE NOT MIND READERS
